Judging how her husband is faring in prison, I am certain this Mother will get her Christmas Wish.

ST. THOMAS -- It would have been easier if her husband was dead, she said.

"When a person passes on, you are left with wonderful memories," said the mother of a little girl whose father -- the woman's husband -- sexually abused her live on the Internet.

"This will never be a happily ever after for us."

The woman stood yesterday in front of reporters on the steps of the St. Thomas courthouse, her hands tightly clasping the people who have supported her through a nightmare that shattered her family and shocked the world.

The 35-year-old man pleaded guilty to seven charges in October involving the sexual abuse of his daughter live on the Internet -- a case believed to be a first in Canada.

The charges -- two for sexual assault, three for making child pornography, one for possession of child pornography and one of distribution of child pornography -- stem from an Internet chat the man had with an undercover Toronto police officer Oct. 24, 2006.

The man can't be named to protect the identity of the biological daughter who was three years old in some of the images and four at the time of the chat.

The girl was rescued the same day after Toronto police, OPP and St. Thomas police joined forces to track down the man.

The tall pony-tailed man sat quietly with his head lowered in the prisoner's box during sentencing arguments.

His wife's quiet sobs could be heard in the public seating when the most disturbing details were described.

Assistant Crown attorney Elizabeth Maguire read the explicit transcript of the conversation to Superior Court Justice John McGarry.

The man admitted to the officer he was part of an old chat room that was raided. He enthusiastically offered up the images of his child and bragged he had performed oral sex and touched her sexually in the past.

He talked about how "tempting" his daughter was.

When the officer tells him he cannot save the images on his computer, the man happily took the officer through the steps to keep them.

Then, as a "surprise," he sent fresh pictures of the naked girl before he was to give her a bath.

"Is that right now?" the officer asked.

"Yup," the man wrote back.

McGarry heard the girl told a counsellor "daddy made a big mistake" and the police "put handcuffs on daddy so he wouldn't touch me."

She said she loved and missed him but she wouldn't call him daddy anymore.

His wife's victim impact statement, read by Maguire, told of the fears she has for her daughter. After five years of marriage, her husband "turned out to be a person you didn't know at all."

"It would be easier to accept he died rather than be a cruel and hurtful person," she wrote.

His lawyer, Robert Upsdell, told McGarry the man doesn't admit to oral sex with the girl.

Upsdell said he and the Crown agreed the man's 14 months in custody be counted for the usual two-for-one credit.

He asked for a sentence of 30 months -- leaving only two months to serve.

Upsdell said the man had "profound remorse, regret and shame over all this."

Since he has been in jail, the man has lost 130 pounds and has been beaten twice. He fears he'll be hurt again.

Upsdell said the man knew he had a problem, but didn't know how to come forward. "It was almost as if he was happy to get caught," he said.

Maguire, who asked for another five years in prison on top of the time served, said the man "seems to be enjoying" what he's doing during the chat.

"It didn't sound like he wanted to get help," she said.

Maguire told the judge the Crown's office was unable to find another case in which someone had sexually assaulted their child live on the Internet. Maguire said the case is unique and deserves a stern sentence.

She pointed to murderer Michael Briere, who killed Holly Jones in Toronto in 2003 after watching child-porn images, and suggested the St. Thomas man's behaviour was escalating.

The man, along with offering up his own daughter live for the sexual gratification of others, had a large collection of child pornography images.

McGarry will sentence the man this afternoon.

After the hearing, the man's wife said she remains close to her in-laws, but has only spoken once to the man who abused her daughter,

"I pray that this does not happen to any other family and I need the public to know we have to stop this. These criminal acts against our children are just despicable."

This is a brief excerpt of the disturbing Internet chat during which a St. Thomas man sent live images of his naked daughter to an undercover police officer.

This conversation took place after the man had sent a series of stored sexual images of the girl. He told the officer she is his daughter.

The man: I can prove it if you like.

Officer: LOL (chat short form for laugh out loud) . . . I believe you.

The man: The chair she is sitting in is here and the webcam plugged in. What should I set it on to prove to you?

(The officer tells the man to send him a picture with a piece of paper on the chair with his nickname on it.)

Officer: Wow, is she there?

The man: You like?

(The man then helps the officer figure out how to save the images. They chat more about sexual experiences with children.)

The man: Got a surprise for you.

Officer: What!

The man: You'll see

(The man sends two pictures of his daughter naked.)

The officer: Is that right now?

The man: Yup.

(The officer promises the man they will talk soon. The chat ends.) [/q]
