To Whom It May Concern,

My name is John Mercier. You are required that you accept and investigate diligently this report! Or instead I am filing a complaint against YOU under section 832.5 of the penal code. You have 30 days to respond. Failure to respond to this complaint with written proof and a case number will be considered civil corruption.

On December 7th 2007 I went outside my apartment to be greeted by beer drinking thugs littering and cursing outside my door. I complained about the noise and trash and one of these “thugs” came down the stairs and punched me in the face. I then proceeded to laugh at him and his “thug” friends because I am a law abiding citizen and he just assaulted me, with my 78 year old mother standing in the doorway watching the whole thing, and therefore of course I told him I was going to call the police and have him arrested. Apparently, they beat me to it and called the police before I could because the next thing I knew three police officers walked into my apartment complex and immediately focused on ME! They told me to sit down and I did, I followed all of there instructions to the letter and they’re shameless embellishments of the charges suggesting I resisted arrest or was uncooperative in any way are totally contrived. I was arrested without being told why, my rights were not read to me, and my mother was never asked what happened!

These “thugs” live in the apartment upstairs from me, although they are not on the lease. These same individuals caused a fire in the same apartment upstairs from me only a week or two ago, and have been raided by parole in their short stay there. I gave 30 days notice several months ago after these “thug” neighbors  caused the neighborhood to plunge into chaos after dealing drugs to the whole neighborhood and causing the residents to become out of control. I was promised by Cochrane Management Co. that they would be evicted, so I rescinded my notice and continued my tenancy. Which now has resulted in these terrible people forcing they’re way into the complex and staying here when they are not on the lease, and then assaulting me and making a false police report about me to literally take the complex by force, and the management company has allowed this to happen to me by deceiving me into thinking they were being evicted. This is slum lording!

In jail I was treated with intimidation and torture. They sat me on the floor and crowded around me staring at me taunting me, one individual asked me numerous times; “do we make you want to kill us John?“ This is obviously an attempt to bait me into threatening them and shows the police departments clear desire to sabotage my case against them regarding the foster home reports. then they put me in a cold cell with no shoes or socks and no blanket. I begged all night for a blanket and was terribly cold. I was awakened to being rushed into signing that ridiculous ticket and then pushed out the back door into the rain with no shoes or socks on.

I was just in the hospital a week earlier on November 30th, at which time I was diagnosed with Shingles. This viral infection can be life threatening if it reaches it’s full blown state. I had to readmit myself to the hospital one day after this arrest and was diagnosed with a viral infection. Should my health fail now, and if I succumb to this virus and pass away, I assert that the failure to give me a blanket and to throw me out the door with bare feet in the rain when I am suffering from shingles is a premeditated attempt to compromise my health and constitutes murder! The officer who oversaw me being thrown out the door barefoot and refused to take the report when I called officers to my house was badge number 204. The Sergeant at the police station who refused my report was badge number 16. These obviously disturbed individuals must be held responsible for their unbelievable transgressions!

I went home and took a shower and then drove down to the police department and demanded to file an assault report against the upstairs neighbor who assaulted me, they absolutely refused to take the report. I then said I was filing a report against them under section 832.5 of the penal code for them refusing to take the report and the sergeant on duty laughed in my face and flat out refused to give me any written proof that I was filing a complaint against them. This is clearly blatant civil corruption of the most disgusting kind, laughing in my face denying me my rights as if there was nothing I could possibly do about it.
This is utterly despicable and disgusting behavior, literally spitting in the face of our laws and blatantly boasting their all-powerful civil corruption. This is not the first time I have been discriminated against by the Lompoc Police department, making this accusation even more sound. I attempted to file a police report regarding the abuse of my son in a foster home several months ago which also was refused and resulted in me filing reports against them with the attorney general for civil corruption.

Most incriminating is the fact that on September 19th, 2005 I was arrested and agreed to participate in a route of vindication and assist them. I assisted the Lompoc Police Department Narcotics Unit by wearing a wire and successfully completing a sting operation and therefore I was vindicated of the drug charge. I have  never had a drug possession charge before or after that, and I have never  been convicted of being under the influence of a controlled substance so this was by definition an isolated incident. Unbelievably this information appears on the detention report of my son dated  November 15th 2006. This is clearly the responsibility of the Lompoc police department, for they are responsible for this operations secrecy and clearly have leaked the information to child welfare services in their effort to conspire to cover up the abuse of my son in the foster home, which I tried to file police reports about several months ago.

Therefore the City Of Lompoc Police Department is Guilty of Violating my rights in numerous ways and must be held accountable for this blatant civil corruption. They are clearly against me and the unbelievable embellishment of these misdemeanor charges and failure to properly investigate this case and take my reports is clear evidence of discrimination. I will SUE the Lompoc Police!

The bottom line is this, I have reports currently being investigated by the attorney general, the judicial performance commission and the grand jury in which I am accusing several members of the county of Santa Barbara of conspiring to cover up the abuse of my son in a foster home. I name the Lompoc Police department as one of these conspirators. Should these charges be pursued against me in any way I will consider this an obvious attempt to sabotage my case and I will hold the agencies pursuing these charges responsible. These charges will destroy my entire family all at once. My mother and I have to be out of this apartment by Jan. 15th, 2008. My mother is 78 years old. She will be left to fend for herself, my son will remain illegally detained and drugged in this institution in Beaumont, and I will be at the mercy of the County of Santa Barbara, with a Judicial Performance Committee report and Attorney general report and a Grand Jury report being currently investigated. I am pleading with the higher authorities for help as my family is about to be washed away!

John...have you thought this through, You and only you have set yourself up for an even harder battle in this small town of a little over 41,000 residents.If I might suggest that if you do in the future assist the lompoc narcotics task force , dont let it air in the lompoc record and keep such information to your self. Although their may be some validity to your claims, you have now not only set yourself up for a much harder road, but you have brought your mom and son into the picture also. Claims such as you have described dont make it too far in the legal court system. You have admitted your use of narcotics, and that in itself has done the most damage to your credibility in a court and the judicial system. I am afraid that your outcry plea to the higher up is only a part of what you might need to do for your family. You also need to stop telling the world that you assisted the narcotics task force. You need to STOP and think before you open your mouth in a public manner such as this. A few police officers words against yours (an admitted drug user) and you will NOT prevail. All you have done is jeoperdized your self , your son , and your mother. Good luck john, you have a hard disappointing road ahead of you and your family.

I sympathize with you as I am fully aware of how much they have gotten away with over the years.  When I went to help clean up my mother's vacant house & was spending the night there, the police banged on the door after midnight, waking me up.  I ran out of the house, thinking that someone was after me, probably mistaking me for the previous tenants.  When the police caught up with me, they ordered me to sit on the ground like an animal.  Their poor excuse for waking me up in the middle of the night was that they got a disturbance call.  Common sense would tell you that was not possible as my mother & I were sound asleep and it was super quiet.  They never apologized.  When I was a teenager and had my car parked on Ocean Ave., a policewoman ordered my friends and me to unlock our cars so she could search them.  She threatened to have my car towed if I didn't comply.  She had no grounds for searching it as it had been parked for a while and I had not committed any violations.  My brother also was unnecesarily hassled many times by the police and wanted to file charges.  He was accused of being under the influence of cocaine by an officer who explained that he had training and knew what to look for in someone's eyes/face.  My brother, who has no record of any drug possession as of today, took a drug test on his own so he could sue the dept., but never got around to it.
