In this case, ask yourself, why was the citizen even charged? Nicholas Batchelor was assaulted by an off duty police officer, John Burke, who never identified himself. Burke thought the other man was referring to him when Batchelor swore at a car that had cut him off. So, after Batchelor had parked, Burke, who was on a bike, angrily confronted him. He ended up hitting Batchelor first, which was not in dispute at all.
After being thrown to the sidewalk, Batchelor in self defense used his legal short blade knife in self defense but stabbing Burke in the rib. Indeed, the prosecutor stated that Batchelor was in the city to buy drugs. Yes, medical marijuana! He had a medical marijuana ID card and was planning to buy some marijuana for his medical condition. How does this excuse an out of control cop? Oh by the way, medical marijuana patients are being denied the right to own firearms. So much for our rights.
