John & Kate Divorce, but have been Separated for 2 Years?

Jon and Kate Gosselin have filed divorce papers in Reading, Pennsylvania, and their TLC Show has been put on hold for a while, but in the divorce papers, Kate Gosselin states that her and Jon have lived 'separate and apart' for the last two years.

Gosselin filed for divorce Monday in Montgomery County Court in Pennsylvania, saying in papers that her 10-year marriage is "irretrievably broken." The star of TLC's "Jon & Kate Plus 8" also says they have been unable to agree on dividing their assets.

However, it appears that the papers are just a little confusing. When Kate selected that her and Jon have lived 'separate and apart for two years', that doesn't mean that they have been separated living different lives for two years. It means that they must both wait from the moment they considered the marriage to have ended and began living apart, such as in separate bedrooms.

TMZ learned why she may have checked that box:

Jon may not agree that the marriage is irretrievably broken. If that's the case she has to wait the two years. So by checking both boxes, Kate is hedging her bets.

Ultimately, she would have to prove to the judge when she considered herself separate from Jon.

Man, their kids must be mest up. I mean with all the fighting i would would be mest up too. i mean come on, all parents fight but infront of their kids and national tv. my parents got divorced to but they just told me that they were not agreeing on things and they said they were going to seperate. it was hard for me but it must be 8x harder

i def. think that jon and kate should get a divorce. if they fight in front of little kids, 8 to be exact, kids learn from example so when they grow up and get married their example will be also fighting when they have a dissagrement. all this publisity is even making the matter worse. if poperazi followed me around 24/7 where ever i go i would get so pissed, and with them they probably also take out their anger from the poperazi on each other. thats all i have to say about this.
