Kiefer Sutherland has avoided assault charges stemming from a scuffle outside a New York nightclub, during which Sutherland allegedly head-butted fashion designer Jack McCollough.

Apparently, Jack McCollough was not cooperating with the prosecutors, and he and Kiefer Sutherland have resolved the matter on their own.

Sutherland, the son of actors Shirley Douglas and Donald Sutherland, is currently serving probation as part of a drunk-driving conviction that sent him to jail for 48 days in 2008.
