Her attorney Shawn Chapman Holley said that Lohan was unable to fly home in time because she lost her passport, but although that story was found out to be true, it was discovered that Lohan had never applied for a new passport with the U.S. Embassy in Marseille. She has now been issued a temporary passport and will most likely fly back to Los Angeles on Friday.

However, as there is an active warrant for her she will be detained at customs when she enters the United States and will be taken in to custody from there.

She will be allowed to post a $100,000 bond when she arrested until her hearing can be held. She will be under strict orders that she will not be allowed to drink alcohol until her hearing and will be fitted with a bracelet to detect if any alcohol is in her system. She will also have to undergo random drug testing.

"I warned her before," the judge said. "She knew it was very serious."

Lindsay flew to Cannes to promote her new film but always insisted she would be able to make it back in time for court.
