KSDK-TV, the NBC affiliate in St. Louis just reported that a man walked into the city council chambers in the St. Louis suburb of Kirkwood, Mo., said all he wanted was justice and began shooting.

UPDATE #1:  KTVI-TV, the Fox affiliate, is reporting that ambulances are en route to the Kirkwood City Hall, located at 139 South Kirkwood Road.

Kirkwood is the same community that gained notoriety after the kidnappings of Shawn Hornbeck and Ben Ownby by Michael Devlin.

UPDATE #2:  KTVI-TV is reporting that the mayor of Kirkwood was shot and, possibly, two police officers were shot.  Police officers reportedly returned fire and hit the suspect.

UDPATE #4:  KTVI-TV reports that two police officers were killed in a shoot-out, but were able to kill the shooter also.  He has been identified by multiple sources as Charles Lee "Cookie" Thornton.

UDPATE #5:  According to KTVI-TV, six people in total have been shot by a lone gunman at Kirkwood City Hall tonight.

UDPATE #6:  Reporters on KMOV-TV (CBS) and KTVI-TV are awaiting official confirmation about the conditions of all victims who were shot tonight.

FINAL UPDATE:  Five people, including the alleged gunman and two police officers, are being reported dead tonight in Kirkwood.

Stay the course because the only way to change the law is through   developing case precedent, which binds all courts, speaks louder than bullets and does not lead to the loss of human life.  “<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /> When Charles Lee Thornton took the law into his own hands, mistakenly believing that a “bullet spoke louder than words”, it was merely an excuse for acts of revenge.  Justice cannot be brought about by acts of violence as that played out in the Kirkwood City Council Meeting and often not at the local level---it can only come about through a change in the law and through case precedence, which only takes place in the appellate level.  It is not realistic to ask those who have a vested interest in reelection to acknowledge wrongs done perpetuated by “injustice disguised as process” (a term associated with a “Kangaroo Court”) by those who have self-serving interest in denying culpability for their wrongs.   Few lawsuits are brought without a degree of rancor so it is understandable that at least one party in every lawsuit leaves the courtroom with anger and frustration but that does not give anyone justification for taking human life.  Feelings of anger and frustration arises when parties to lawsuits, who are usually representing themselves, do not have the legal foresight or the understanding of the lengthy and often political system they are challenging.   I too, have been fighting “a war against people who I believe are tormenting me and my family” since 2003.  Like Mr. Thornton, I have also recently been “thrown out” of federal court, not based on the merits of any claim, notwithstanding clear liability of several Defendants on several claims but only because I could not draft a complaint based on FRCP 8(a)(2) which requires a “short and plain statement of the claim showing that the pleader is entitled to relief.”   Yes, like Mr. Thornton, I believe the dismissal was unfair because it has the potential to bar any new lawsuit filed based on those claims in federal court, which is the only court I can obtain justice because several of the Defendants are State of Georgia and because the Supreme Court of the United States “rarely grants review based on clearly erroneous applications of state laws” and to pro se parties. (See Petitioning and Opposing Certiorari in the U.S. Supreme Court, Timothy S. Bishop and Jeffrey W. Sarles of Mayer Brown, LLP.)   The only way to make those in the justice system take notice of egregious miscarriages of justice and civil rights violations is to stay the course and fight within the system at the appellate level and develop case precedence which speaks louder than bullets and does not take the form of vigilante justice with consequences which cannot be undone and will ultimately make no difference in the legal system Mr. Thornton was clearly so distraught over.
