Trial date set For Stacey Barker Murder Trial

Finally, a July 26 trial date has been set for the Stacey Barker murder trial. Barker is a 25 year old Lancaster, California woman accused of smothering her 18 month old daughter, Emma Leigh Barker, before dumping her body in tall grass at the side of a freeway on March 18, 2008.
There was a hearing yesterday, June 8, 2010 at the Michael Antonovich Antelope Valley Courthouse in Lancaster, CA. Before I get into the details of the hearing, I wanted to share a picture taken last week of the memorial that has been erected in Emma's honor at the spot her body was dumped in Sylmar. A friend (who goes by the hat name A7XMommy) had the opportunity to stop by the site. She was pleasantly surprised by this memorial because this area had always been tall grass and overgrown with weeds before and now someone has not only honored Emma, but the area around it is being kept mowed, even 2 years later. 7XMommy used her cellphone to get this picture and was disappointed by the quality but the message is clear....little Emma will not be forgotten. Thanks for sharing 7XM!
Now, on to the hearing. As noted in earlier posts about this case, friends of katfishponders (Tori, Ange and TD) are attending the hearings in this case. The information provided here is compiled from various posts and e-mail correspondence and phone calls about the hearing details, so this report is not verbatim and may not be reported in the exact order that it occurred in court.
Superior Court Judge Hayden Zackey presided over this hearing. Deputy District Attorney (DDA)S. Kelly Cromer is representing the people and Stacey Barker is being represented by Public Defender (PD) Roberto F. Dager.
This hearing was held in a different courtroom because the air conditioning in Judge Zackey's courtroom wasn't working and as Tori put it, "It was 2 degrees hotter than hell today". She also noted that in this courtroom on the back of the table where the defendant sits was a sign that says, "Do not communicate with prisoners" and stated a PC code violation number.
The reason we mention this is because at the last hearing, when Barker entered the courtroom she said "hiii" to her boyfriend in a flirtatious manner, during the hearing she was bouncy and laughing with her attorney, and when she was led out of the courtroom by the bailiff she turned in a "coy" way and said "BYE" to her family...kind of like she was somewhere other than a court of law.....bidding farewell to her fans. She was definitely in violation.
It should be noted today when the defendant entered the courtroom she was in compliance. The way the girls described her at this hearing was,"SB came out looking thin, sullen, worried and defeated.....looking at the floor the whole way to her seat next to her attorney, she didn't even try to make eye contact with her family or boyfriend."
The regular accredited press from the Antelope Valley News was in court today. Time Warner Cable was also there recording the proceedings. One of the camera guys put a microphone on the attorney's table, Public defender Roberto Dager removed it and handed it to a bailiff, Johnny, who gave it back to the camera man.....so he just set it behind the table and the hearing started.
Judge Zackey started the hearing by announcing the next court date will be June 28 to finish up all pre-trial discovery, motions and whatever else. Then he said we'll be back on July 26 for trial, this will be 40 of 60.
The attorneys for both sides were having a "debate" about some new discovery that the defense hasn't received yet. DDA Kelly Cormer has some CD's that consist of taped visits with civilians that went to see Barker in jail and some letters to and from another inmate at the jail.
Evidently Dager hasn't seen the letters yet because Judge Zackey told Cormer to give the defense a CD of the letters. DDA Cormer told the court she wants to have all of the discovery transcribed to include who Barker is talking to and who is saying what. Hmmm.....must be planning to use some of this in court if the state is going to the trouble of having transcriptions made. What part about "no rights to privacy" is it that people who are incarcerated don't get?
That was the end of the hearing and the bailiff, Johnny, pulled out Stacey Barker's chair and took her by the arm to go back into lockup before she could even say goodbye to PD Dager, she didn't even attempt to look at her family and boyfriend.
Hopefully, both parties will get all the loose ends tied up by the June 28th hearing so the July 26 trial date will stand! There will be justice for Emma soon. As I have said before, Truth = Justice. It is time for the truth to come out, whatever that may be

Not sure if this is where we are all blogging but I will put it up at the other one also...
Okay, it seems like Kelly and Dager were playing cat and mouse this morning everytime she whould walk in Dager would have just walked out moments before, then when she would leave he would walk in..this went on for almost an hour!
There were 3 inmate bus's at court today and they have to search each one everytime all the inmates get off so this took a while.
I think Judge Zakey did not feel well today, maybe he has allergy's he was blowing his nose, holding his head and in a bit of a mood..hope he feels better.
Kelly and Dager got into the room and stayed put, they brought SB out, she was lackluster again today yet she had her hair up in a braid, looks like someone helped her with it, it was very neat.
Kelly gave Dager a Disc, she said it contained the letters , taped phone calls and something I did not understand...a wire tap conversation (with who they did not say) the letters and the other phone calls were from Inmate Erin Sutton aka Devil Dude. Here is his Myspace

OK so when that was said "inmate sutton" Judge Zackey said, is that the Erin Sutton that was in my courtroom? Kelly, Dager and another Attorney said Yes it is your honor.
Judge Z looked shocked and had a puzzled look on his face when they said it was the same guy.
No shocked look on BB'S face or the Grandparents.
Judge Z said Everything is complete and THERE WILL BE NO MORE DELAYS.
I have spoken with both PD and DA and learned some of the Wit's and the Investigators as well as Dager and Kelly have prior commitments near the July 26TH date so we will start TRIAL the week of Sept 24th...Monday the 20th we will start trial.
Judge Z said You both want it to stay in this court right? they both said yes, he said alright then there will be NO more delays unless I am in a trial, then you both agree to wait until I am finished to start the trial...the only delays will be from ME, agree? they both said Yes and that was it.
He made it clear that he would not stand for anymore games or delays, he was nice but very firm when he spoke to Kelly and Dager.
For some reason the July 26th date is still showing on the LASD website...I will check it again in a few days and if it still has the 7/26 I will go anyway.
The thing on everybodys mind is why has she befrinded Sutton? TD thinks it is the fear factor...Nurse and I are not quite sure what it is, I know Nurse has a opinion on the why but has to do a little more checking before she tell all of us...it is just strange!
Also Craig was sitting next to us and the Grandfather was making faces and talking about us again...Sorry pops it is going to take more then that to keep us away!

Thanks for the update. Well....September is a ways off but at least it's this year. Is jury selection to start on Sept. 20? Then the trial on 24th? I will check back to see if you think of anything more. I'm sure glad I saved all the devil dude research I saved from the last post. Hmmm that was nice of the judge to clarify the first name for us. LOL

I think Z checks out the blogs...LOL he wants to see if you still think he is a sexy hunk. because he made sure to say Erin Sutton loud when Kelly said Inmate Sutton..he knew from the last hearing that it was sutton but we could not write anything about him without knowing that it was the right Sutton...LOL...yes your Honor, You are still a Cutie, even feeling poorly, you still look good!
I am sure he said they would begin on monday the 20th, he said the week of the 24th..I am not sure about how or when they select a Jury I am sure it takes a day or 2 so maybe that is what he means that it will start the week of the 24th.
I am so courious about the letters and the wit's...no one was there when she did it, also if BB was to be a wit (not that I heard this but.....) why is he in the gallery? Amber does not come to court because she is on the wit list right, or at least that is what I thought I read at one point.
I did a little research on Kelly and found out she is a dog breeder and has her dog in shows, she must be good because she has placed 1st and 2nd a number of times and she belongs to the AKC of america and does some animal rescue work..that woman has a full plate and still has time for animals, what a gal! it was funny today she had to go somewhere else but before she left the courtroom she went behind the judges bench and got a big piece of Angel food cake and some mixed berrys and left, everyone was laughing at her... it was some special day for someone in court because there were also gifts back there. she is so not embarrased by anything..LOL that was a huge piece of cake and she passed by all the people in the court with it...made me hungry...
I am going to find out about the 26th though because I don't want to miss anything...maybe that is for Jury selection, she does not have to be there for JS does she?

Hope all is well with everyone..The reason I dont attend court is because I am a single mother with kids to feed and dont have the time nor the freedom to take off work for all of these court dates.. hope everything turns out for what is the truth

First and foremost Judge Z is my first judicial crush and you know what they say about those firsts. LOL! I like to think I'm a pretty good "judge" of men/character.....I did pick Mr. Katfish 32 years ago (30 years married on 9/19/10) and he was a keeper, though I admit I may have bit on some unworthy bait before I landed my dh. The way I see it Mrs. Z is a lucky gal and so is LA County......I still wonder if he does laundry or cleans around the house at all? Is his desk top orderly?
I haven't got the entry done yet....my sis is flying in late tonight from Tampa so we're trying to get a few things done.(She is here for 1 day only, divorce court after 25 years) :`( Sometimes things are for the best though, they both seem happier now. Poor thing she has to fly back tomorrow night and then fly back here Fri night for a funeral on Sat. Her sister-on-law (and good friend of mine) passed away this week. :`( She couldn't get off work, the company she works for is in vacation mode and there are only so many midwives to deliver them babies. :`( This has been a sad week.
Cormer and Dager will both be there for voir dire ( pronounced vwahr [with a near-silent "r" on the vwahr] deer), that is a very important part of the trial. Some would say the most important part because both sides have the opportunity to question the jurors and attempt to get rid of those they may feel are biased to their case. The judge eliminates for cause (like a health problem, say they can't presume innocence, something that would take their focus from the trial) each side is then allowed a number of peremptory challenges (no cause, suspect a bias, knowledge of the case, etc.). Have you heard any talk of questionnaires for prospective jurors? That is something both sides have to work out, although they may do that off the record. I will have to look up the jury selection process for CA. I used to know but it has been a while since Spector. I doubt they will have to go through as many to seat a jury for this trial.
Amber, it sounds like you have your priorities in order. Are you on the witness list?

Nice to hear from you.. Glad you and the kids are alright. Yes, years ago as a working mom I would not have been able to attend things like this either, my bestie's (high school bestie) son was with someone who commited murder and was being held on the same 187 charge as the shooter, I did attend some of the court dates as support for my friend but not her son, she knew this, I told her I felt if he KNEW the other guy had a gun and would use it, then he deserved what ever he got. he served 5 years before the trial and got time served, the shooter got life, as he should have.
Kat is so correct that you have your head in the right place concerning your kids and Job, that says a lot about you as a parent.
That is what everyone wants, the truth, whether it was an accident or intentional. Her case might have just faded away if she had not drawn so much attention to herself, lied and made it a big drama of Emma getting abducted, it's sorta like watching a soap opera or movie that you get interested in and want to see what happens. (sorry that is the only way I could think to put it) I also want to see Justice for that little Angel.
Anyway I will be at the next pretrial hearing on the 26th of July and will see ya all here.

Hi dear friend, Yup It is almost 1 AM here now, apparently I just missed you. I signed on earlier to check up on the hearing before catching a 20 minute "cat-nap" (goodness I'm witty when I've been up for 3 days straight!) I'm hearing you, Wednesday? really? what happened to Monday and Tuesday?? I'm too old for this kind of schedule! - so glad to see things moving forward in the trial!! Hey, do we know if there is a Mrs Judge Z? He is a very nice looking man and my guess is honest and trustworthy. I would love to talk with Judge Z and ask him what it like to be in his shoes when facing this sort of case - Like Judge S in Oville - some days must be very hard.

Hard to believe there really is another family like the Anthony's running around and covering up for their progeny. What a legacy. Glad to hear you have been able to get online long enough to blog a bit. We have a lot to say and God help those around us if we don't get to say it. LOL I will go check out your posts after I fix dinner. I hope JVS's family has began to accept reality, the fact he did these crimes....I expect them to say he's a sick puppy....he is, but that doesn't absolve his responsibility for what he has done.

As far as the witness list goes I know nothing, I don't know what is going on anymore.... It hurts to know someone I thought I knew better than anyone; I didn't know at all...At least a lot of things about her.... If trial is going to start soon, if i am involved at all I am sure that I will be finding out soon enough.. Glad you can keep everyone up to date with this... As I have not spoke to her family anytime recent I hope they are all doing as well as possible.. I miss the Barker family.

Amber, sometimes it is best to take a step back and let things take their course. I imagine the Barkers miss you too, you have been a true friend to Stacy. They are no doubt very hurt as well.....

I really do feel for you. And again, I am very sorry that you are caught in the middle of this god-awful situation. I don't know what is going to happen here, but whatever does happen, I am sure you will find yourself back in the Barker's lives. The dust is still in the air, and the subject is still very sore, Stacey is getting ready to go to trial. I was thinking about it, and on top of the grief and the heartache, there must be conflict amongst Stacey's family and friends. I am sure that even everyone who was close to her has their own point of view on the whole thing. And when those theories differ between people who are close and love eachother, it can be really ugly. But, just hang in there. I have no doubt that somehow, everything is going to be alright.

Amber I could be wrong (it happened once before ; ) but I would imagine the Barkers would be very happy to see you. Remember they have not only lost Emma but for all extents and purposes they have lost sb and everyone she brought into their lives. It must be extremely painful for them too and as long as this goes unsettled, their lives are in limbo.
For most of my life I would dwell on "friends" who were missing from my life, thinking something could have been done to save the relationship; especially when the relationship had ended badly - there must have been something I could have done differently that would have either changed the outcome of a rift or saved a friend from their own demons.
At some point I read the following and really took it to heart:
“There comes a point in your life when you realize who matters, who never did, who won’t anymore, and who always will. So don’t worry about people from your past, there’s a reason why they didn’t make it to your future.”
There was nothing you could have done to save sb, from herself, she is what she is - as someone else pointed out along the way, you have been a very loyal friend to her and that loyalty has not always been returned. You have nothing to feel bad about in regards to sb's troubles, she brought this on herself. There is no way an alert adult can smother an 18 month old toddler by accident, especially the way she described to LASD. It just isn't possible - not to mention the fact that she alone, knew where sweet baby Emma was hidden.

No one who has not walked in your shoes can imagine the pain this has caused you, GOD knows this is not something anyone could in their wildest imagination ever think would happen to someone they know and love - I hope time will help to heal the ache in your heart and you are able to smile when you remember the little angel you had in your life for such a short time and not dwell on the end of her life. A very wise man told me there are things we will never understand in this lifetime but a short life is not an incomplete life - Emma's mission was accomplished and you will see her again. In the mean time honor her memory by loving those you still have in your life and keep Emma in your heart.

These ladies are so right, you learn with time that not everyone is supppose to stay in your life forever...I am sure that the Barkers miss you and your kids also.
I have friends that I will keep forever, some I will see on occation and some I will never see again.... I am sure you and SB were/are great friends and because of what happened it has strained the relationship, if it comes out that it was not a accident and she lied to you, is it going to make a difference in the way you feel about her? I know we all want to believe loved ones but sometimes they don't always let us in on what is really going on with them or hide things from us...I know first hand about that :) LOL
Girls, I was watching the news yesterday and a girl won a essay contest, it was about her dad that was a gangbanger and herion addict while she was growing up, he only made it to the 6th grade then dropped out to sell drugs...even being a drug addict he pushed her to go to school and make something out of herself...She called him her HERO...that is not the part that I liked about this story, I liked her mother always keeping her from the street life and gangs, she said her mother would always tell her "Show me your friends and I will show you your future" what a great saying!

The July 26th hearing is a Pretrial hearing, then the week of Sept 24th is the trial, I don't know how long it takes to select a Jury or when they select one, Judge Z said Monday Sept 20th is the next court date so maybe that is the day they select a Jury.

I sobbed while writing that reply, but feel Amber deserves a verbal hug, with our first several meetings so acrimonious (thank goodness for spell check ; ) I had few words of praise for her, for a long time - but thanks to the many good hearted, really kind people we have met through this case and a bit of self reflection - I have recognized several short comings of my own, that needed an adjustment. It is truly amazing how surrounding oneself with great people, makes one desire to be a better person them self. Not that I am all that good, but I am working on it.

I believe this girls' mother is a hero - not only keeping her off the streets, but allowing her to have enough of a relationship with her drug addicted father - to learn he was not in a good place - but allowing her to love him anyway. How often do we see and hear about selfish ex-spouses who decide to keep kids away from a parent out of spite, or even try to trump up charges - to do so legally.

I forgot to ask you if you had looked at the devil dude Inmate (that she has befriended) Myspace page and what do you think the reason is that she has started to write and converse with him?
He is one creepy looking guy, I know you can't judge a book by it's cover but his Myspace says a lot about him.
I can find nothing on him except a Robbery, a Robbery with a 2 million dollar bail??? the only thing I can think of is maybe a 3RD strike felony... strange.

One of DD's friends is none other than the lovely Ms Kat Von D - a link to her public site has her last blog entry regarding her feelings about plastic surgery not being for her (she is not passing judgement on others who have a plastic surgeon on speed dial) - while her profile picture shows the once shapely tattoo artist looking almost anorexic - and her photo's have multiple pictures of her body that appears to be fairly well covered with tats from below her neck down. I am leaving that as "appears" because my current link to the Internet is slower than the old dial up, so I don't have the patience to enlarge the thumb nail sized photos.

DD graduated from Highland High School here in West Palmdale.
That school (back when he went) was pretty upper middle and middle class I wonder if he is in one of the old year books? I will check it out....
Yes, TD and Nurse dubbed him Devil dude that day in court and we were shocked when we went to his myspace the day we found out that he was the one SB was corresponding with and found Devil Doll....we all just looked at each other with our mouth hanging open.
I have 11 Tats, none really big, no more then 4 home made and I had gotten my last one when I was 24 years old, so that goes to show that since the age of 15 when I got my first professional tat I was considered a tramp, a biker, a lowrider and my personal favorite..a lowlife chola! back in the day it was a no no for good girls to have tattoos! now it is a friggen fashion statement to have one or more.
I love pretty tat's but in moderation, I see the people that use their skin as a canvas and think to myself "that is ugly" but if they like it cool. some people use ink as a intimidation thing, you know people see you inked up and are scared of you, I think it's silly to be scared of someone with tats, it's just INK.
I have Biker friends with a parlor in the Valley, when I was MUCH younger I use to hang out there and watch the dude do tats, it amazed me that a girl got her whole back tatted with a peacock from neck to butt crack and didn't make a big fuss but this guy came in to get Harley wings across his shoulders, he bitched, cried and ended up passing out from the pain...what a wuss...(if you come across this, yeah you wuss Gabe) LOL, oh my point to this story is that guys can dish out pain but are not able to take pain....
I am scared of people that have devil worship tattoos, they are in league with Satan himself most of the time.
I did read that he was given life for the argument with the child molester, that is what is strange the CM is still alive and well living in Lancaster and has his mug shot on the Megan's law web site as a child molester. he goes by a alias also, I just cannot remember it right now.
When I went to the LASD website and called the phone number it gives, I gave them the booking number and they said he was in jail for Felony robbery..... we searched the web for anything on him and ZIP, nada, nothing! he has a email that will tell you all the details if you write to him at it, it is like falsleyaccused or something ..I think he has someone taking care of his myspace.
Ps. another thing I was thinking about..look at these murderers Ted Bundy, BTK killer, The Hillside Stranglers, Susan Smith, Darly Ruthier, Bonino and a slew of others...they were NORMAL looking and acting, they had Jobs, family and friends...they were sooo nice but NO ONE knew what they were doing until they got caught. I am sure all of their partners, co-workers and family were in the dark about the evil side of them, Yet none of them looked scarey..sends chills down my spine to think about, you never know the person you are standing beside in the market, DMV, store or just about anywhere.

This is just getting stranger all of the time. I am so anxious to know what is on those tapes and in those letters. So, there has been yet another change in my school schedule (I just love college BS), so I may actually be able to attend some of the trial hearings. Hopefully. It's not going to begin until September now, right?

You have been missed, sorry you have a cold, I know they are going around here too. What are you majoring in at school? I hope the available classes are not being reduced as badly as they are in AZ.
Oh gal, I cannot wait to find out what the disc holds against sb! Was she dim enough to talk to other inmates? Maybe just another version of her story - as told to one of her old chums, or her placing the blame on someone else! Hopefully we will find out!
She and devil dude both have their not guilty pleas in common! I so hope sb does not end up with a hung jury, like D.D. did.
The hearing July 26(?), going on a very tired brain and shaky memory, I believe KatFish said maybe for both sides to question possible jurors and to rule out those they feel are biased or likely to have prejudged the defendant during voir dire or maybe I misremember and that will happen the week of Sept 20th?? IDK at this point.
Due to most trials involving the police, their statements and investigation vs a private citizen and their possible criminal activity - LE and their immediate family members are usually tossed by the defense, because they will supposedly be biased against the defendant. My mom was called about every two years, every time - she was randomly selected and every time she was dismissed due to my brother being a cop and later a federal agent.
Anyone with a history of perceiving LE in a negative light - say someone questioned about their possible interactions with police, who feels all cops suck because they have had 20 traffic stops and were found guilty every time, probably hold a grudge, because cops and judges work together to make private citizens miserable - will most likely be tossed by the state. Obviously those are silly little examples - but crazy as it is, those things are taken into account.
A defense attorney here claimed to have "mistakenly" received a jury duty notice a few years back - showed up thinking the judge was going to just dismiss him. Instead he was read the riot act from the judge - saying things like no one is above being called for jury duty and too bad if he thinks he is too good to "serve" like the plain ol' riff-raff off the street. LOL I don't recall if he was dismissed or just not randomly picked - but the local press had a field day with him for a few days.
In AZ, they no longer allow nursing mothers to be exempt from serving, a friend of mine was told they have a special room to either pump or nurse and the judge will call a short break for that reason when needed - she showed up with a pump in a backpack and was directed to the bathroom! UGH...
If they were taking volunteers to serve for Ms Thang - I would be the first in line - although I suppose Snidely has had all the blah-blah bloggers investigated and is probably walking around with our photo's in his wallet - making sure we never serve on a trial he is the PD for! Called out for being biased against short men or some such thing! I keep meaning to ask the gals if he is as short as he acts! I hope to find out for myself at the next hearing!
T - if I am recalling correctly, defendants are allowed to have "family" or other such supportive people in the courtroom, if those people are going to be called as witnesses, so be it. For instance the Anthony's (if KC gives-a-carp) can sit in the courtroom - even though they are probably going to be exhibit A and B. I don't know if BB qualifies as such a person. I believe those who will be called as witnesses, who are not her "family-support" can sit in, during pre-trial, anyway.
Hey! I was not pointing out peeps with tats as being criminal! I promise! All of my kids have them and none of them have committed a serious crime or ever served time. None of them are tramps, low-riders or lowlife chola's, My son has a motorcycle he has not been able to ride in a couple years, since some low life driving a BMW - hit him and ran - breaking the bike in half and giving my son a concussion, causing him to have epileptic seizures. He no longer rides, because he does not want to threaten anyone else's life - if he were to have a seizure while on the road, he knows he could cause an accident, endangering himself and others.
Although D.Dude has more than a few tats, he would be scary even if he had none! DO NOT LOOK THAT GUY IN THE EYES. He is one scary devil dude and WTH is Dudette posting about their daughter - "She is so beautiful and full of life. I hope that one day you get the chance to know her. She's awesome!!!!" I wonder if Dudette is taunting the lifer, knowing their daughter will be long grown up, before DD is walking free, if ever!
I thought it was interesting that von D doesn't understand the need for "naturally beautiful people" to have plastic surgery, yet covers her body in tattoos, while she sees her body as a canvas - many plastic surgeons see their work, the same way.
