Why is the government lying to you serve on a jury
In the state of New York, an elderly man is being charged with a crime. His crime, telling his fellow citizens that they have a right not to enforce unjust prosecutions. See, it's called jury nullification. What it means is that a jury has the right not only to decide the facts of the case but is the prosecution being brought, just in itself? Judges and prosecutors don't want you to know about jury nullification.
The defense in a case are forbidden from mentioning it. The jury is also told not to consider under what term a person would be sentenced to, if convicted for example of simple drug possession. In fact, that knowledge is also forbidden to them. Do you get the feeling that juries are treated like children? This gentleman, Julian P. Heicklen, is being charged because they don't want juries to know something that has been their right such before we even became a nation. Indeed, early in our history, juries were commonly instructed on their right and ability to judge laws and circumstances, along with facts
The prosecution in this case has stated that it was not just illegal for him to inform pedestrians near a courthouse of this right, but that this right does not exist for anyone, and that it is not protected by the First Amendment. That means this column I am writing could get me prosecuted, under this doctrine. This is not the first time for this kind of prosecution, it happened to a female juror a few years back in Colorado. She had learned of the unjust sentence someone faced for drug possession. Her discussion with her fellow jurors almost put her behind bars.
In February of 2003, a man was convicted of growing marijuana. The jury was not allowed to hear that not only was he growing it for medical marijuana patients, but for the city of Oakland, CA. Jury members stated that they were disgusted that this information was kept from them.
In another case a man who got prescription drugs illegally was given a 25 year sentence. He never sold the drugs, but used them just to treat his own pain. The jury was told they must rubber stamp his conviction if technically guilty of the crime, and not consider how long the government would send him to prison.What is the government trying to hide? Why do they want jurors ignorant of the laws of our land?
