Examining the NGOs behind the Chevron Ecuador Lawsuit
A ruling in an historic $27 billion lawsuit against Chevron in Ecuador is expected later this year. In anticipation of Chevron appealing that ruling, NGOs financed by a large number of foundations and a Philadelphia-based law firm are staffing up for a prolonged fight.
Amazon Watch and the Rainforest Action Network (RAN), the two major U.S. based NGOs involved in the campaign against Chevron, are attempting to foment a “perfect storm” of activism to put public, political, and shareholder pressure on Chevron to either accept the verdict or settle the lawsuit. The pressure from these groups has been steadily increasing for years. Between 2006 and 2008, these groups received almost $2 million from several large foundations.

Now that it appears that this case won’t end with the ruling in Ecuador, RAN resources are being dedicated to funding the salaries of a Chevron Campaign Director, Chevron Campaign Coordinator and a Development Director. RAN’s description in the job postings for these newly created positions state that, “This will be a multi-year campaign and will be top priority for the organization.”
One of the most vocal organizations is an Ecuadorian-based group called the Amazon Defense Coalition (ADC). It is not clear who is funding the ADC, but most believe they are bankrolled by the Philadelphia law firm of Kohn, Swift & Graf. It is also suspected that the ADC is receiving financial support from the Ecuadorian government.
The ADC was formed in Ecuador so that the organization could hide its financials from the public. If the ADC was a U.S. based organization, it would need to file an IRS Form 990, a "non-profit report card” that lists income from fund raising, in-kind gifts and expenses such as payments to hired experts and others.
Several requests have been made to Hinton Communications, the Washington, D.C. based PR firm representing the ADC, and Andrew Woods, who works for Steve Donziger, the lead attorney for the plaintiffs. To date, the public still has not seen a complete report listing ADC’s funders.
Another interesting fact not mentioned on many of the NGOs’ websites and most media reports is that the ADC and Kohn, Swift & Graft are the financial beneficiaries in the lawsuit, not the 48 plaintiffs or the 30,000 indigenous residents that are depicted in the media and marketing materials of Amazon Watch, RAN and ADC.
After Chevron’s expected appeal, the company will face a multi-faceted and globally-networked campaign to pressure it to settle the case or accept the verdict in Ecuador. Amazon Watch, RAN and ADC, along with a large number of other like-minded groups, will undoubtedly coordinate their efforts in order to maximize the campaign’s impact.

These groups are seasoned practitioners of war-room tactics, letter writing campaigns, public demonstrations and online propaganda. They are preparing to ramp-up the use of these tactics in a coordinated effort to put pressure on Chevron.
Their tactics have already had an effect on several members of the media. Some reports describe the plaintiffs in the lawsuit as the underdog in a “David vs. Goliath” struggle with the second largest oil company in the United States. However, the large informal coalition of NGOs, foundations, misguided celebrities, unsuspecting media, a corrupt Ecuadorian judicial system (pressured by an anti-multinational government), and trial lawyers, makes the underdog narrative questionable at best.

I’m glad “Truth Out”, who is too afraid to reveal his real name, brought up the issue of my wife. Karen Hinton of Hinton Communications, the PR firm representing the Amazon Defense Coalition, went after my wife with repeated personal attacks in a press release and on the internet. Phony rhetoric? This entire article is phony rhetoric. The ADC is paid by the government of Ecuador?? Are you kidding? Your proof? You have none, because it's absolutely false. And your source is Zennie?? The clueless blogger who just spits out Chevron talking points? You just included it because it gets traction in the echo chamber of the Chevron defenders--many of whom are getting all-expense-paid travel to Ecuador to write favorable blogs because the company is losing the battle in the mainstream media. The ADC is in fact, a real grassroots NGO in Ecuador that has monthly meetings, has hundreds of members, has gov't recognition (the equavilent of 501 c-3 status in the US, and it was given by a right wing administration years ago), by-laws, etc. etc. If you bothered to actually look into it, it's extremely evident, and a google search to find the webpage for the group took approximately .24 seconds. But this inconvenient truth doesn't fit well with your rhetoric. But I'm glad you 'exposed' the scandalous fact that foundations fund NGOs...What a bombshell!

Fact: ADC has never revealed their funding. If they want to clear up the “misinformation” then they should reveal their funding. Seems like the coward hiding behind the name “Truth Out” doesn’t understand that transparency by ADC would clear all this up. But the coward just keeps pushing the typical propaganda that is so typical of folks supporting these organizations. Talk about phony! Why don’t you tell us who you are?

This is pretty typical spin by folks like “Truth Out.” Let’s just completely unravel his baseless arguments.
1. ADC is a real grassroots NGO with equivalent (Truth Out can’t spell either) status of a 501 C-3. Well, in the US you need to reveal your funding. ADC hasn’t done that. And, how do we know it has hundreds of members if we can’t see the books.
2. If you follow the link to Alex Thorne’s blog, it clearly states that his wife works for Chevron – he’s never denied it. In fact, it was Karen Hinton’s lies that motivated him to start writing about the case.
3. It is a “bombshell” when $2 million is given to organizations that are supporting the baseless lawsuit against Chevron in Ecuador.
4. We still don’t know who Truth Out really is. What’s he got to hide?

Glad you've come to Alex and Chevron's rescue Craig! He call you and ask you to post? Funny thing is, NY courts don't seem to think the case is baseless, and neither does mainstream media. And Chevron's attempts to blame state oil company Petroecuador in separate legal actions have also been defeated in Washington DC courts, and the Supreme court declined to accept Chevron's counter claims. I guess the courts, and CNN, the New York Times, the Washington Post, Vanity Fair, Bloomberg, Forbes, NPR, 60 Minutes, among others ALL got this story wrong. Thanks for setting the record straight--we'll all take the husband with an ax to grind's word for it. You'd think someone writing a blog "exposing" who funds NGOs might also want to declare, at the beginning of the blog instead of having to follow link after link to figure it out, that his wife is a policy advisor for Chevron.

All you Chevron defenders are classic--repeat the company's talking points, bury your heads in the sand when faced with facts, try to claim the case is baseless when the courts and legitimate news sources clearly disagree...it's almost as if you guys worked for Chevron... Or had a family member who does...

Truth Out, you’re the one attacking peoples motives. But no one knows what your motives are. And, you can’t answer a single question put to you about who’s funding ADC. Why are you so afraid to come clean and tell everyone who you are and what your motive are. Until then, you have no credibility.
Alex wrote an entire article about how he got involved with this issue that covered that fact that his wife works for Chevron. You are the only one not coming clean about anything.

And how much does Chevron spend on their propaganda? The full page ads in the U.S. and in Ecuador? The phony "news reports" by Gene Randall? Their DC lobbying to punish Ecuador before the USTR for allowing the case to proceed in its courts? How many millions of dollars in fees to their legal team (s)? Could probably have spent that on some potable water systems, or put it towards ACTUALLY cleaning up the waste pits...

And we still don't know who you all are, who you represent, what your interests are, why you run to Chevron's defense, etc.--other than Alex, who doesn't seem to want to admit it himself here, but whose wife works for Chevron and when she got called on it, he started this here blog). But it's a great smoke and mirrors tactic--don't ask why Chevron used cheap technology in Ecuador that dumped millions of gallons of crude and some billions of gallons of toxic waste water, decided it was too expensive to line waste pits so contamination didn't get into the drinking water of local communities, why it merely pushed dirt over waste pits and called it a clean up, why the company fought for 10 years for the case to be moved to Ecuador and now suddenly, on the verge of a verdict, has decided it doesn't want to be tried here, and on and on and on.....Don't ask these critical questions, just use the ole' Burson-Marsteller play book and yell fire in the other direction to distract the eyes of the world. Too bad for you all, and Chevron, the world isn't buying it.

He did acknowledge that his wife works for Chevron in his first response. He even posted a link which contains an entire article that talks about the issue and the lies that ADC’s pr firm keeps spreading. You’re the one who keeps repeatedly attacking other peoples’ motives without telling us who you are. Based on your cut-and-past talking points, you’re a tool hired by Hinton Communications. That probably explains why you can’t answer any of the questions put to you – you’re just repeating talking points given to you by Karen Hinton. You have no answers to the questions put to you, just talking points that you keep repeating.
