High Court Indicates Revision of Judgement Haryana Forests Land
Chandigarh (Haryana Live): The Punjab and Haryana High Court on Friday have agreed to clarify its earlier judgment on a notification issued by the Haryana Forest Department in 1997.
The special bench comprising, Chief Justice T.S. Thakur and Justice Surya Kant has taken this decision after Haryana Government approached the court for a clarification through Advocate-General H.S. Hooda and Narinder Hooda, who submitted that the notification of 1997 was by the general order and was extended to half of Haryana, whereas to make the land as forest land the notification by special order under the provision of the act of 1900was required and all the development activities have been held up due the direction of honorable high court.
But Counsel for the petitioner, Ravi Sharma opposed review of the earlier decision under the garb of application for clarification, thus did not require further clarification, as there was no ambiguity in the judgment delivered by honorable High court on May 15, 2009.
Once, the land is notified under section 3 of the Punjab Land Preservation Act, 1900 it becomes forest land and other notifications of u/s 4&5 whether special or general are complimentary to achieve the same object.
But the HC bench opined that, a clarification was required to clear the ambiguity on the issue.
With this HC’s clarification indicator, the mining lobby in state sees some hope for their business to revive; now it seems sure that High Court has made up its mind to revise its earlier order on the issue.
The political pressure and money power have started to show its effect in this eco- friendly decision made by high court ,the as effected parties are highly political connected and in position to invest money to get decision as per their business and political interests.
Haryana Political tussle on the issue will be the real force behind, if any alteration in interpretation of this court case occurs.
Latest in the issue came, when on Saturday the auction for mining in Panchkula earned more than 45 crore against reserve price of Rs 25 crore.
It is to remember that auction for another mining hub of Haryana; Yamunanagar was suspended to over bidding. i.e. Rs 46against reserve price of Rs 11 crore.
Lat not the least, intention of Haryana Government can be gauge by its action that even on one hand it was requesting High Court for clarification on its judgment, and on other hand it had started process to auction the mining in Haryana.
This clearly indicates that effected parties are so confident about the favored decision.
