Courts may be protecting drug makers from lawsuits because the jury may be wrong

The logic is that the FDA "competently" oversees the drug market and should not be SECOND-GUESSED by courts. Meanwhile, less than a month ago, numerous members of the FDA board and the FDA commissioner himself argued that the FDA is underfunded and lacks the resources to keep up with advanced scientific solutions that are needed to properly perform premarket tests. The other argument in the case, "what worries me is, what happens if the jury is wrong?"
