WILLACY COUNTY DISTRICT ATTORNEY Juan Angel "Johnny" Guerra seems to have made a fast exit after successfully arguing before a Texas grand jury for the indictment of Vice President Dick Cheney and former Attorney General Antonio Gonzales this week.  Guerra was due in court to prosecute Cheney and Gonzales on prison profiteering charges, but instead, he apparently fled.  District judges over the case reportedly replaced Guerra on five of the nine charges he succeeded in putting forward against the accused.  According to the CLG report below, Guerra apparently went AWOL.

Texas rangers reportedly waited for Guerra driving on U.S. 77 southbound from Houston to take him into protective custody.

Wonder what put the bee in his bonnet?

Texas Rangers to escort Guerra to court Friday morning after having been found in Mexico 20 Nov 2008 After being AWOL from the job [?!?] and violating sections of the Texas Disciplinary Rules of Professional Conduct - Willacy County District Attorney Juan Angel "Johnny Guerra" has been replaced in five of the nine criminal cases he convinced a grand jury to file against Vice President [sic] Dick Cheney, former Attorney General Alberto Gonzales, former U.S. Attorney Mervyn Mosbacker, state Sen. Eddie Lucio Jr., District Judges Migdalia Lopez and Janet Leal, former Willacy D.A. Gustavo "Gus" Garza, and District Clerk Gilbert Lozano, along with GEO Corp., and former warden David Forrest.

Presiding District Judge J.Manuel Banales has appointed Asst. Cameron County to Alfredo Padilla to handle the cases for Mosbacker, Lopez, Leal, Garza, and Lozano due to Guerra being absent from court... The Texas Rangers will likely wait for Guerra to cross the international bridge near Reynosa or catch him driving on U.S. 77 southbound from Houston, either tonight or early tomorrow. He will then be taken into protective custody and escorted to court in Raymondville tomorrow morning. Guerra could continue as prosecutor for Vice President Cheney, Gonzales, Sen. Lucio, GEO Corp., and Forrest.

I volunteered to testify against Gonzales at the site of my article on his indictment and gave reasons why I felt my testimony would be evidentiary against Mr. Gonzales (not that I believe he will ever stand trial).  Among other things, Reuters reported that Mr. Gonzales refused to allow investigations having to do with prisoner abuse cases in County correctional facilities.  The case I would like to address to his jury has to do with the refusal by the USDOJ to even investigate a death in a County correctional facility, a death that remains mostly secret these five years later.

Apparently, Mr. Guerra did not show up in court Thursday.

It would be disappointing not to be able to speak with Mr. Guerra, especially after being ignored for literally years.  Mine is the only American family in the 21st Century to have a relative secretly arrested and returned to his family as a corpse with no excuse, explanation, arrest records, full autopsy report, and DENIED any investigation - at least, I hope this is not a common occurrence in America.  This shroud of secrecy surrounding my mentally ill brother's death in that jail has continued for five years, although Memphis/Shelby County Jail was already accountable at the time of Larry's death to the USDOJ for full reports on any injuries or deaths of inmates.

Apparently, however, Mr. Guerra could not take the heat and presumably fled to Mexico, according to the article quoted above.  I have been chased by up to four cars at a time and a US DOT truck, and was cornered at my neighborhood Chevron station for about an hour a few weeks ago, and I did not flee from the fight for justice in America.  I am disappointed in Mr. Guerra, if fear is why he left his area.  Sometimes, democracy and justice require sacrifice.  Hopefully, afternoons in the park with my grandkids are all I will be required to give up in pursuit of justice, which is such an illusive thing in the American justice system these days.  

Many have high expectations that next administration in Washinton will do a better job of protecting citizens' rights than the present administration, especially that most important of all inalienable rights:  The Right to Life - even for institutionalized persons, handicapped persons, and Georgia grandmothers who dare to ask, "What did y'all do to my poor brother?  Why was he secretly arrested?  Why did the jail deny having him, knowing he needed his prescription heart drugs to survive?  Why did the Johnnie Cochran Firm take our wrongful death case, with Julian Bolton being both the managing partner of the Memphis office AND a Shelby County Commissioner?  Why was he promoted to County Treasurer after that law firm tricked my 80-year-old mother into thinking we had good lawyers to help us with Larry's wrongful death case?"  My family is hoping for CHANGE!

Perhaps Mr. Guerra believed he would have an ordinary life after being so bold.  I have not had an ordinary life since serving The Johnnie Cochran Firm with their lawsuit last December for defrauding my family as our wrongful death attorneys after the secret arrest and wrongful death of Larry Neal in Memphis/Shelby County Jail in 2003.  The USDOJ steadfastly refuses to lift a finger to investigate Larry's death, although it had a supervisory role over Shelby County Jail at Larry's time of death.

I worked in the legal field for about 15 years before filing this lawsuit, and I believed life would proceed as usual, like Mr. Guerra may have imagined.  WRONG!  Now I am a prisoner in my own home, preferring to be a recluse and blog all day than to get caught on the highway by my pursuers.  Unfortunately, DeKalb County, Georgia Emergency 911 services must have been ordered not to respond to my distress call when cornered, because they certainly did not.  

After that fearful incident (one of five times I was cornered in a neighborhood business), I made a couple of YouTube videos to alert the public that not only was the news about the wrongful death of Larry Neal the most censored news probably since television was invented, but now I was being chased because I found a way around the censorship through using independent news sites like NowPublic.com, Care2News Network, IndyMedia.com, and OpEdNews.com.  They must not have liked that one bit.  I have no idea who to substitute for the pronoun "they," but I have three guesses.  From the amount of collusion it takes to keep Larry's death quiet in the news and his family denied any accountability for five years, I am probably right no matter which of the three I choose. 

It really unnerved me when a video I perceive as being another death threat was then added to my videos, which I cross-posted to Y! Video.  Further disturbing is the fact that Yahoo gave me misinformation when I inquirred about the death threat.  But that will be in another story, or I may save it for my book, in case something fishy happens in our federal court case against The Cochran Firm.

Mr. Guerra going missing reminded me of November 9th, when Duanna Johnson, the transwoman who planned to sue Memphis/Shelby County Jail turned up dead - shot execution style. One would certainly hope Mr. Guerra will be adequately protected if he is delivered into "protective custody." 

QUESTION:  Does any of this seem newsworthy?  Censorship is the precursor to fascism.

I hope Mr. Guerra remains safe and sound.  Wonder what put the bee in his bonnet?

Prosecutor who had Cheney indicted yells at judge

(AP) RAYMONDVILLE, Texas – A county prosecutor who brought indictments this week against Vice President Dick Cheney and others pounded his fist and shouted at the judge Friday during a routine hearing. Willacy County District Attorney Juan Angel Guerra asked Presiding Judge Manuel Banales to recuse himself from the case, which alleges abuse at federally run prisons.

Guerra said the judge was wrong to allow motions to quash the indictments to be heard before the defendants were arraigned.

Banales called a recess so he could try to contact the chief justice of the state Supreme Court for suggestions on how to proceed, and ordered Guerra, who had slipped out once during the hearing, to remain in the courthouse.

Guerra first said "I will not obey that order," but then agreed to stay if the judge asked him respectfully.

"You can't have district attorneys across the country bringing charges against federal officials," Treece [a constitutional law specialist and professor] said. And even in a federal probe, Cheney and Gonzales have a "qualified privilege" that would protect them so long as they were acting within their jobs, Treece said.

Thanks for this article, Duo. You definitely 'walk your talk'... with your determination to seek the truth about your brother's death in custody, so far unexplained. And your dedication to helping others who lack a voice - the mentally ill - who are easy prey for those seeking to increase the commodity of successful private prisons, and those who have been silenced.

Rest in peace, Duanna Johnson. I hope and pray that the missing D.A. is safe from harm.

'Assistance to the Incarcerated Mentally Ill' (AIMI) is a successful organization based on the work of Mary Neal, committed to decriminalizing mental illness. 1.25 million of the current prisoners are mentally ill - who surely would be better off in secured mental facilities (cheaper than prison, too).

What benefit to society can the prison system for mentally ill be? The many disadvantages spring to mind, but absolutely no advantages.

My family had no idea what our justice quest would entail when we began this pursuit of truth and justice and the American way!  It is a wild ride so far.  I must confess, I would prefer reading a good drama than living one any day.  But, God works in mysterious ways.  He keeps me safe.  In God I trust.

My new hero is back in court and ready to roll - Mr. Guerra.  See update from AP entitled:  Prosecutor who had Cheney indicted yells at judge.  Guerra reportedly asked Presiding Judge Manuel Banales to recuse himself and accused the court of giving defendants "special treatment."

We who have been treated worse than dogs by the justice system will keep watching this exciting court case.  Mr. Gonzales may have prevented investigations behind allegations of prisoner abuses and deaths, but no trouble was too much to go to for Michael Vicks' dogs.
