ANOTHER MENTALLY ILL MAN has lost his life to prisoner abuse.  This time the inmate was incarcerated in Fulton County, Georgia.  Three prison guards beat the "loud, agitated" inmate beyond recovery last March, but only one was fired and recently arrested according to a report by The Atlanta Journal Constitution published March 21, 2009 (see excerpts below).  This writer started reporting such accounts after the secret arrest and wrongful death of Larry Neal, her mentally ill brother who died in 2003 under secret arrest in the Memphis/ Shelby County Jail and his death was followed by an elaborate cover-up invovling numerous government entities and The (Johnnie) Cochran Firm.  See a full account at this link:

United States District Court, Northern District of Georgia, Judge Timothy Batten presiding, issued The Cochran Firm summary judgment in the matter of Neals v. TheCochran Firm, dismissing the law firm's fraud against the Neal family.  The Neals' lawsuit accused The Cochran Firm of pretending to represent Larry's survivors while merely holding their lawsuits against the Memphis/Shelby County Jail and others inactive for the Tennessee statute of limitations to run.  In fact, the managing partner of the Memphis office of The Cochran Firm was himself a Shelby County Commissioner, and the Shelby County Commission owns and operates the jail where Larry died.  (See http://wrongfuldeathoflarryneal.com)

Not only was The Cochran Firm allowed to defraud the Neals and enter perjury in federal court without censure (irrefutable proof of perjury was also submitted - redacted documents), but The Cochran Firm continues to defraud everyone with its advertising, which the law office in Atlanta itself called false in Georgia Superior Court in 2005 and 2006, when the law office claimed to be no part of The Cochran Firm and disclaimed any affiliation with Cochran Firm offices.

Now Larry's family must decide which of these is best to do:
 
1) file an appeal on this unrighteous ruling;
 
2) file suit against the so-called Cochran Firm Atlanta office for lying in court in our Georgia Superior Court case - disclaiming an identity it held out to the Neals and continuously holds out to the world.  This was done in order to claim the suit was not served to the right party because there's no Cochran Firm office in Georgia;
 
3) file suit against The Cochran Firm and its protectors for collusion regarding the denial of Larry Neal's civil rights under Code 42, Sec. 1983, and his family's civil rights regarding due process of law; or

4) acknowledge we are too black and poor and Larry Neal was too handicapped to get justice in America, so ensure the public is warned and other sick citizens gain support by overcoming the censorship the Neals encounter through demonstrations, books, radio, and film.
 
U.S. Code does not allow attorneys to enter false testimony in court even for high legal fees, it does not allow parties to a legal action to enter perjury, and neither is it legal to intimidate plaintiffs and witnesses.  All of this was done, documented, and proved in our USDC case. 
 
The important thing about the Neals v. The Cochran Firm case is that it shows how far people will go to violate and ignore the rights of African Americans and handicapped persons. 
 
To secretly arrest a handicapped citizen, return him dead and deny explanations and official records to his family; allow corporations like Cox Enterprises, Inc. to ignore federal subpoenas to release advertising information for The Cochran Firm without censure; allow county jails to ignore federal subpoenas for release of records; take a fraud case and call it a malpractice case in order to justify summary judgment; ignore admissions by The Cochran Firm lawyer Angela Mason that she knew the color the vehicle that was following plaintiffs to intimidate plaintiffs or worse. ALL of these things were done in the case of Neals v. The Cochran Firm.  All of these actions were excused in federal court by Judge Timothy Batten, just as Judge Wendy Shoob of Georgia Superior Court issued an order denying the existence of a Cochran Firm office in Georgia in 2006 while it was the most famous and widely advertised law firm in the state.

"Laws in America are upheld only when they are used to hold poor whites and black or brown people accountable to the establishment.  They were never intended to work the other way round," I was told by one attorney.

Who are these people who bought Johnnie Cochran's name?  Was it done to trick disenfranchised people with its claims of being the firm for the "common man"?  Why is the media silent on this?  Oh, I forgot.  The media carries the false advertising that actually does the trickery.

After Larry Neal died under yet undisclosed circumstances in the Memphis jail, a report was due to be made to the United States Justice Department according to terms of the jail's Agreement with the U.S.A. following a federal lawsuit regarding prisoner abuse.  The USDOJ never received the mandatory report on Larry Neal's death from Shelby County Jail, probably because The Cochran Firm's Memphis office with Commissioner Bolton as lead counsel could be counted on to keep the Neal family's legal action against the jail contained, meanwhile writing Larry Neal's family lying letters about work that was not actually being done in their lawsuits.  The USDOJ refuses to investigate.

Since Larry's death in 2003, another three federal lawsuits were filed alleging the abuse and deaths of mentally ill citizens at the hands of Memphis law enforcement, and Duranna Johnson, a transgender person, was beaten in the jail's booking area last February, and the film was widely published.  Many people regard transgender persons as being "deranged"; therefore, she apparently qualified for the abuse that mental patients get.  Before Duanna Johnson's lawsuit was filed, she was killed by an unknown assassin on November 9.  Ironically, former-Commissioner Julian Bolton also worked in the office of the law firm Ms. Johnson had contracted with to represent her against Shelby County Jail.

Unfortunately, the murders and abuse of mentally challenged Americans warehoused in the nation's correctional institutions are not rare. Too many veterans voluntarily answered this nation's call for service, then come home with the scars of battle not on their bodies, but in their minds. Thousands of veterans from Viet Nam, Middle Eastern conflicts, and other battlefields returned to America suffering from Post Traumatic Stress Disorder (PTSD) and became POWs in this nation's prisons. Thousands of citizens never saw a battlefield, yet they also suffer PTSD from the stresses of their daily existence. Many mentally challenged people self-medicate with drugs and alcohol in a poor attempt to "get their heads together" and wind up homeless and eventually in prison. Several recent news reports document children with Autism being arrested and/or Tasered in their schools, and one child was only six-years-old.  Prison is not the answer to mental illness, and people cannot be punished into a state of good mental health.  Assisted outpatient Treatment programs provide a viable solution with an 87% success rate and the potential to relieve prison overcrowding, delete the need for private prisons by removing mental patients from being treated as inmates to becoming inpatients or outpatients, depending on their offenses.  (Google "Kendra's Law" and "Laura's Law" for more information.)

Another mentally ill man has been beaten to death by jailers at Fulton County Jail in Atlanta, Georgia for being "loud and agitated" in March 2008.  Jail employees are accused of lying to cover up abuses and hinder a federal probe.

Federal authorities arrested a former Fulton County jailer Friday and disclosed an ongoing FBI investigation of excessive force and cover-ups that were hatched afterward at the long-troubled county jail.

Former jailer Curtis Jerome Brown Jr., 41, of Lithonia, faces federal charges of civil rights violations, obstruction and making false statements.

In August 2007, Brown beat an inmate whose hands were handcuffed behind his back, leaving him bloodied and in need of medical attention, federal prosecutors said Friday. This prompted an internal affairs investigation of Brown.

Seven months later, Brown was still on the job. Then, he beat a mentally ill inmate who later died, according to the criminal complaint unsealed Friday.

On March 18, 2008, Brown and two others beat a mentally ill inmate who was loud and agitated, the complaint said. The inmate was found unresponsive and not breathing on his cell floor. He died.

U.S. Attorney David Nahmias expressed frustration that jail officials have hindered the federal probe, which began about a year ago. “The people involved are not telling the truth,” he said. “We’re not going to stand for that anymore.”

This writer supposes that the former guard was accused of beating inmates instead of killing the mentally ill man because:

1)  A murder charge would expose the jail to greater liability, and

2)  He was “only” a handicapped American like Larry Neal was.

No explanation was given as to why only one guard was held responsible and the guard apparently does not face murder charges. 

Mentally ill inmates often suffer abuse and numerous sick people die each year while imprisoned. These deaths result from cruelty by guards and other prisoners, neglect, or abusive living conditions. A Texas inmate complained to a prisoner activist group that his cellblock was close to and shared an air vent with the cellblock where mental patients were kept.  As a result, he experienced respiratory difficulty caused by inhaling the gas that was used regularly in the psychiatric cellblock to subdue mentally ill inmates.  Imagine what the air was like within the psychiatric cellblock. 

Homelessness, prison, and death must cease being America's answer to mental illness.  The right to "open disclosure" and "equal justice" should be realized by all, or officials should just retire those cute phrases.  "Liberty and justice for all" should either be deleted from our Pledge of Allegiance or actually honored. Stop lying to school children.

Police brutality is something no citizen should have to endure.  Unfortunately, many law officers are not equipped to deal with mental illness.  Law officers and guards usually perceive disruptive, uncooperative behavior from mentally challenged inmates as being an affront to their authority. Therefore, mentally ill inmates often suffer abuse, including beatings, tasering, gassing, and solitary confinement.  It is unfortunate that abuse and murders of mentally ill citizens (particularly African Americans) are frequently allowed within the U.S. “justice” system, and objections are apparently overcome by any means necessary.

Human rights organizations expressed dismay that Secretary of State Hillary Clinton did not address human rights abuses strengently during her recent trip to China.  I think she acted appropriately, given the circumstances of civil liberties in the U.S.A., especially regarding certain citizens.

Thank you, Barry.  Sometimes that happens because our officers overreact to stimuli due to sleep depravation and poor training. Such tragedies are not always purposeful murder. Many police officers work two jobs. Therefore, when confronted with a situation they perceive as being threatening, law officers are sometimes incapable of assimilating the information before reacting rashly. This puts citizens in peril and erodes confidence in law enforcement. I believe fire fighters and police officers should all get a pay raise sufficient to prevent their having to hold two jobs so they can be at their best when dealing with crisis situations.

A raise might help honest officers who make mistakes due to fatigue, but only proper enforcement of citizens' rights coming from higer up will end the intentional police brutality done by sociopaths who have been armed with lethal weapons like Tasers and handguns and nightsticks and turned loose on the citizenry.

Another thing that would prevent so many deaths of mental patients when they go into crisis and police are called to arrest them would be to use crisis intervention teams - officers specifically trained for such arrests. Rape victims have special officers to take their testimony, and hostage negotiators stand ready to address kidnapping situations. Rape victims, hostages, and sick people are all innocent victims in situations that need trained officers.

Regrettably, there is resistance to prosecuting prisoner abuse cases and defending the lives and health of institutionalized persons, which is a major function of the USDOJ.  Please see this article and horrible TORTURE VIDEO of prisoners being tortured and dying right here in the U.S.A.:

Thanks so much for reading and commenting on the article. Numerous cases that dominated the news recently all come together in the wrongful death of Larry Neal case. I believe prison profiteering is at the root of why investigations are withheld and justice denied.  Americans are very concerned for prisoners in  Guantánamo Bay. I thank NowPublic for helping to expose similar conditions right here at home.

You're right. With regard to your last point, however, I would say this.  Many know that we're already "sliding down the slippery slope to Hitlerville."

The abuse/s are ubiquitous it seems - within our prisons, on our streets, and within our homes.  Mary and many others are being harassed (in the most cruel and sadistic fashion).

(Check out mindjustice.org (regarding human rights abuses, including non-consensual "human experimentation").  Terrible things are taking place in this country and many turn a blind-eye.  We're seeing some progress, but will we see enough.  And will it come soon enough to help people like Mary.  Our "system" certainly failed her brother (and many others).

Now I guess you can understand why I say the NWO is already here. It took lots of togetherness to end up five years later with no records on Larry's demise.  If you followed my justice quest, you know we have knocked on every door, and they are all locked tight.  Apparently, none of the people in justice or civil liberties or civil rights, or mainstream media, etc., care enough about the things they make speeches about to speak to me.  And there are constant threats to our safety for even asking about Larry.  It is like waking up in the Matrix.

It makes a person very sad to be told repeatedly that she and her family count less than dogs.  Can you imagine being jealous of Michael Vick's dogs because their deaths were investigated by the man who is now our Attorney General, but your own brother's secret arrest and death does not merit investigation by even a city dog catcher?

It is disgusting, and I try to be angry, but I only end up crying.

And within two weeks, hundreds of Larry's relatives have to file our tax returns.  Where are Fluffy's taxes? Where are Spot's taxes? We pay taxes, but dogs have more rights than my black family who lost a very sick relative in the bowels of a county jail by undisclosed circumstances.

Oh, thank you, NP, for making this top story in Health.  Maybe someone will see it and care enough to do something. 

I cannot write the mini-articles for the photos now.  I can write about other sick people suffering, but it is so much harder to write about Larry and our own struggles.  What hurts my mama most is having lost her son, but I think I am most hurt over the rejection.  Total rejection. But I am consoled by reminding myself that God is with us. Most of the time, that helps.

Is there any way to record any of it -- from a window perhaps? Are you saying that some or all of the cars/vehicles don't have any license plates at all?

I know a little of what you're experiencing and it's nothing short of "hell on earth."

I have some footage from the day I walked and took license no.'s.  After I wrote so much about there being no tags, some of the cars got tags.  The cars are not always the same, you see.  They change up. 

You know, none of this makes sense to me.  Secrets are confidences between two or three people.  Anything ten thousand people know about is no secret.  So what is the point?  Soon everyone will know.  We are putting together a demonstration for May 16 and prisoner activists conferences for May 17.  See this announcement that people with an interest in human rights are already responding to.  It was suggested that we should have simultaneous demonstration on the West Coast for people who cannot make it to Atlanta.  It is still in the planning stages, of course.

ANNOUNCEMENT TO PRISONER ACTIVISTS AND ALL THOSE WITH AN INTERESTIN HUMAN RIGHTS

DOES ANYONE FEEL LIKE MARCHING IN A PEACEFUL HUMAN RIGHTS FOR PRISONERS MARCH IN ATLANTA IN MAY?  May 16 and 17 would allow enough time for interested persons to schedule.

There are 2.3 million people in prisons and jails.  Each of them likely have at least 10 people who care about their welfare and just treatment.  Also, there are many human rights activists and supporters as well as religious people (like Christians) who have a mandate to care about those who are incarcerated.  Hebrew 13:3.  That equals about 30 MILLION VOTERS who support an end to police violence and prison reform, but we need to come together to be more effective.  When our legislators see that there are more of us than one little group of prisoner activists at a time coming to them with another petition or one little family at a time begging for humane treatment for their relative who is behind bars, THINGS WILL CHANGE.  What 30 million Americans want - fair treatment for prisoners, reasonable sentencing laws, and the death penalty repealed - we will get.

Of the 2.3 million people behind bars in America, over 2/3 are non-violent offenders.  1.25 million are mentally ill people - many who were turned out of the nation's mental institutions in the 1970's and some who were born after they had already shut down many mental health services and facilities.  It is time for CHANGE.  But it will not come free.  Change will cost rich folks money.  Prison profiteering is big business.  PEW reported that our prison budget is $50 BILLION ANNUALLY.  That amount does not count all the money paid to police officers, judges, courtroom staff, lawyers, etc., that keep the criminal justice system running.  It is estimated that taxpayers pay $185 billion annually for crime and punishment. 

Much of the revenue is generated by three-strikes laws, mandatory sentences, incarcerating instead of treating mental patients, arresting people for lenghty sentences for petty crimes, denying DNA testing that would free the innocent, and the $90,000 EXTRA it costs PER YEAR to keep each man on death row rather than in a maximum security prison for life wihtout parole. 

Chronically ill prisoners cost taxpayers significantly more per year per prisoner than well ones, so there is no incentive to provide good medical care.  Let them be exposed to overcrowded conditions and contract hepititis and be injured by gang violence, all of which generates more money if inmates are seriously sick or injured.  Is there any wonder why prisoner healthcare is dangerously substandard?

DOES ANYONE FEEL LIKE MARCHING IN A PEACEFUL HUMAN RIGHTS FOR PRISONERS MARCH IN ATLANTA IN MAY?  It would be a nice spring getaway for prisoner activists.

The general public has no knowledge of the PRISON TORTURE that goes on right here in America, or they would put a stop to it like they are doing in the prisons America runs in other places.  The public would be outraged to know the big money they are being made to spend to enrich prison profiteers while treating their fellow Americans like dogs, many over petty crimes, including children, mentally ill people, and non-violent offenders.  THE PUBLIC IS NOT BEING TOLD by mainstream media, which is corporate-owned and government controlled.  But the media cannot ignore hundreds of people in front of CNN, which is right downtown Atlanta. 

Please remember that people do not start being prisoners after being arrested, charged, and standing trial.  Oscar Grant was a prisoner, and he never made it to the jail.  People on the East Coast care about what happened to Oscar Grant, but people on the East Coast do not get to show solidarity and support for his family in the way that people in California do.  MANY PRISONERS NEVER MAKE IT TO THE JAIL, but are killed at the scene. 

A demonstration would help honest police officers and prison guards.  Abusive behavior by police officers and prison guards make it hard for honest law officers and guards who really want to protect and serve.  Their reality is that they must depend on their corrupt comrades to watch their backs - and they don't want to get hit with "friendly fire" some day.  Therefore honest officers and prison guards do not come forward with damaging reports on their co-workers.  The level of hostility between our law enforcement and the communities they are entrusted to protect grows with each occurrence of overuse  of force by officers, especially when such violence is not curtailed by authorities who should censure the officers.  Abusive prison conditions are responsible for creating a more dangerous workplace for prison guards.  Bringing attention to police overuse of force and prisoner abuse will not only help citizens on the street and prisoners, but also honest officers who desire to work in a less volatile atmosphere.

A MASS OUTPOURING OF SUPPORT FOR PRISONERS WOULD MAKE A DIFFERENCE.  We should march on Friday during rush hour around 4:00 p.m.  That way, our HUMAN RIGHTS FOR PRISONERS demonstrartion cannot be ignored by the media.
 
We can march on Friday, and on Saturday we can have conferences.  PRISONER ACTIVISTS NEED TO COME TOGETHER TO LEARN FROM EACH OTHER, SUPPORT PRISONERS, AND DEMAND AN END TO POLICE BRUTALITY.  I would like some to attend from each of the diverse areas of prisoner activists groups - those who protest the death penalty, those who are in each region of the country protesting the many problems that inmates face.  I want the families of slain prisoners - those who made it to jail, and those like Oscar Grant and Ms. Kathryn Johnston, who never made it past the scene. 

I need help planning the march and conferences.  Please let me know your thoughts.

We congratulate Ms. Mazer and wish her the best in her new position.  Thank you for notifying us of this news.  I certainly had hoped for change when the administration changed in January.  I gave them two weeks to settle in and then called them about the USDOJ's role in the secret arrest and wrongful death of Larry Neal cover-up.  I was put on terminal hold.  I sent two emails to which the USDOJ responded with automatic acknowledgement.  But the agency made no attempt to call or write me back.  To my mind, the USDOJ did a criminal act in allowing known perjury in federal court proceedings and now it exacerbates that offense by ignoring the online and in-person stalking that I endure.  This type of behavior makes my family wonder what did the powerful folks decide to do instead of investigate and exact justice in this case:  http://wrongfuldeathoflarryneal.com?

Regarding the "glimmer of hope," I will believe it when a police officer is assigned to ask Cochran Firm attorney Angela Mason how she was able to slip up and report to United States District Court the exact color of the vehicle that followed me home from work at night throughout Jan. and Feb. 2008, although I never told anyone the color.  I will believe in the "glimmer of hope" when someone asks why this evidence and proof of the defendants perjury in court was determined to be "immaterial" by Judge Timothy Batten. 

I will believe in restored justice when the USDOJ asks Judge Shoob of GA Superior Court how she could dismiss our case against the law firm by an order of summary judgment, saying there is no Cochran Firm in Georgia, the most famous and widely advertised law firm in the state with its office spitting distance from her judge's chambers. And within six months The Cochran Firm was on the scene in Atlanta to represent another black family when 92-year-old Ms. Johnston was shot and killed by police and police tried to cover that up like Larry's death.

I would like for the USDOJ to ask Judge Shoob how it is that of all the judges in Georgia, cases regarding deaths of citizens by police in Memphis, Tennessee always get assigned to her - probly 2 out of 2.  Judge assignments are supposed to be a random process.  I'd like them to ask Ga. Sup. Ct. how pleadings got "lost" from the court record which were firmly secured in a file underneath other secured pleadings, and no one could even look at the file without a court clerk present to observe their perusal and to copy any records needed.

All of those judges and lawyers have fine records.  I found that it is not hard for folks in the legal business to have fine records, because the agencies that should monitor them will not even accept complaints.  Georgia Bar did not even send me the form to complain about The Cochran Firm until it was forced to do so by the Georgia Attorney General's office.  The FTC and FCC opened a file when I complained about the firm's dubious identity, but they did no followup.  I even wrote Homeland Security and inquired why citizens needed more I.D.s than ever before, but The Cochran Firm was allowed to deny their public identity in court without censure.  No answer.  I wrote the FBI.  No answer.

I think if the government is using law firms as undercover government agents to run surveilance on African Americans like it used to do to MLK, or whatever is going on, the law firms should still do the legal work for its clients like the contract reads.

While I am chased by up to four vehicles and a USDOT truck at 10p.m. in my neighborhood and police don't come to answer my 911 call, the only protection we have is being able to TELL THE PUBLIC about our distress.  But most often, they have my Yahoo emails so they won't go past my kitchen ceiling, and on my Care2 blog, the posts that show are the ones they allow.  I look from a computer when I am not logged on as myself, and totally different data is showing than when I am logged on.  They contain this news not only in mainstream media, but by censoring me to no end.  UNTIL THEY GET A CHANCE TO DO WHAT?

And I am sick of having to stay home broke, because I am not the criminal here.
