On December 15, 2008, the Electoral College is to meet and certify Barack Obama as the 44th president of the United States of America.  However, questions about his qualifications for this office remain in the mind of Leo Donofrio, who calls himself a “citizen’s advocate.”  The matter is now before the Supreme Court.

In a highly unusual move, U.S. Associate Supreme Court Justice Clarence Thomas has asked his colleagues on the Court to consider the request of an East Brunswick, N.J. attorney who has filed a lawsuit challenging President-elect Barack Obama’s status as a United States citizen. . . .

The High Court’s only African American is bringing the matter to his colleagues as a result of the writ that was filed by attorney Leo Donofrio.  Donofrio sued the New Jersey Secretary of State, Nina Wells, contending that Obama was not qualified to be on the state’s presidential ballot because of Donofrio’s own questions about Obama’s citizenship.

Regarding health care, one of the most striking differences between the Democrat and Republican candidates was the abortion issue.  Senator McCain favors overturning Roe v. Thank you, Rhonda.  After completing my article, it is better suited for Health than World, so I changed the designation.  My work on this article, which I began this morning when I emailed you, was delayed somewhat by the usual interferrence by my Computer Administrators.  Let me know if NowPublic or Karen objects to having this article remain on NowPublic.  I would prefer to move it if it is a source of problems for anyone.  As I recall, a good number of us wrote about the recent bail-out for corporate America and numerous articles were published by different authors about Proposition 8.  Some important stories such as these are covered from a number of angles. 

I always want to cooperate, so please let me know.

Mr. Obama was elected for specific purposes by different electorate, Rhonda.  From the standpoint of health care advocates who supported him on November 4, it would be a great loss to have him fail to be sworn into office as anticipated.  That is the correlation between the two.  Perhaps since you did not see that, I should make that point plainer.  Thank you for letting me know if that point is not as clear as it should be.

If the Supreme Court does decide to hear this suit, it may, within certain parameters, allow an opinion to be handed down that puts an end to this ongoing series of time consuming lawsuits that are clogging up court calendars in states across the U.S.

Thank you, Karen.  I appreciate your willingness to link my article, too.  You are very gracious and kind to agree that this article can stay posted, although yours preceded it. 

Someone wrote to me this morning when I was very angry with Judge Thomas and said that he believes Judge Thomas may have President-elect Obama's best interest at heart in this matter by forcing his eligibility to be decided once and for all to put the matter to rest.  I concede that it is impossible sometimes to know one's motives, but I resent this entire exercise.  These questions arose long before our election and should have been determined at that point, not after America has voted.  It is my opinion that the Court waited too long and the matter should be moot now.

Thank you, Rhonda.  I look forward to reading the article and hope that more will do likewise.  We need to understand what the issues are, and it is best to have them presented to us by numerous sources. 

If any of the information brought up against Mr. Obama or any official is NEW (came up after election but before swaring in ceremonies), it would be right to consider it, of course.  But no country should allow its citizens to brave long lines and celebrate a victory that most people are very pleased about, only to have our votes subjected to the possibility of being nullified later by Court action using information that was known and widely reviewed before election day, don't you agree?  It is almost as though someone said, "Let's see if he wins, then we'll use Plan 2."

Not only is this late review by the Court harassment for Mr. Obama and Mr. Biden, but it strikes me as being grossly unfair to the American people, who they are ALL hired to serve.

I understand from reading Karen's article that there are a number of other "Donofrios" out there with lawsuits.  At least if the Supreme Court issues a decision regarding President-elect Obama's eligibility for office, those court battles must end.  The problem for me is the justices on this Court do not have a good track record for making presidential decisions with which I can agree.

Hello, Heyvenn.  Thanks for sharing your comments.  Most of us believed the election ended November 4.  I have read many accounts lately of soldiers being called home to manage citizens.  Hopefully, "they" are not planning something we will all regret.

Why didn't they decide this before the election? I can't believe this waste now for an investigation that should have been over and done with years ago! The man was a senator for heaven's sake!

Also, if it is true that soldiers are being sent home to "manage" citizens, I say lets all go out! Can they "manage" millions of citizens!

The question of eligibility for the office of president of the United Sates is a simple constitutional issue having nothing to do with validating of invalidating voters.

I despise Clarence Thomas and so I hate that it is through his ill intended action that the Supreme Court will review this case.

But I believe it is essential to learn the truth

I voted for Obama and I want to know the truth about his citizenship status.

If his birth certificate exists there can be no harm in releasing it. 

I want to know the truth.

I believe that anyone who opposes learning the truth is merely afraid of it.

Hello, Jon.  Thanks for your comments.  The issue Mr. Donofrio presented when he sued New Jersey's Secretary of State is not about President-elect Obama's birth certificate.  Donofrio asserts that because President-elect Obama had a father who was a citizen of Kenya, he has dual citizenship.  Donofrio alleges that Obama's dual citizenship makes him not "a natural born citizen."  We all read a good deal about Obama's birth certificate, but I believe that issue was settled.

The issue of Mr. Obama's natural born citizenship will be settled ONLY when Mr. Obama himself presents his valid Birth Record from the vaults of the Hawaii Department of Health to the media and the public. 

At least one court has ordered him to present it.  Unless it is incrminating, why would he risk contemp of courty by withholding it? 

A well known legal principle is, Only the guilty stall and withold evidence.  Obama is witholding evidence.  Not only his birth record, but his college records, his school records, his law school records, his health records, his contributions records, his senate records, and his passport. 

If Mr. Obama has nothing to hide, why is he hiding the record of his birth

I read that our President-elect's birth certificate has been authenticated.  In fact, Leo Donofrio's lawsuit did not call the birth certificate into question, but rather, Donofrio cited Obama's father's citizenship as his reason for allegations against Obama's qulifications to serve as president.

Thanks for your exhaustive comment.  Eligibility criterion for political candidates should be explored well before election day if nominees must undergo judicial review to determine their qualifications to serve.  All such actions should be moot at some point.  If not before November 4, this issue is certainly over now.  The Supreme Court decided to decline undertaking any examination of President-elect Obama's birth.  Not only is that fair for Mr. Obama, but it is fair to the American people who already voted.  Many of us are pleased to welcome a new Administration into the White House.  America needs positive CHANGE.

Regarding this issue, it is moot now.  Most of us look forward to our new Administration with optimism and give all the new elected officials and our returning officials our support.
