Legislative bill on short trial. The privilege’s rule in Italy.

 Prescription of trials in progress on first degree for crimes lower in maximum to ten years of reclusion, if elapsed more than two years since indictment request of public prosecutor without a passed judgment. This is the nub of the matter on the short trial law submitted in these days at Senate by some senators of majority. Text has tree articles and refers to citizen’s protection, opposing the undetermined duration of trials in actuation of Constitution and the sixth article of European Convenction of uman rights.

If this new rule on so-called “short trial” will be approved by Parliament, trials where Silvio Berlusconi is charged, will be considered cancelled due to prescription. Trial on tv Mediaset rights and that one on Mills case, would be revoked. Indictment request for the Mediaset incident, where the deputy premier is accused of tax evasion, date back to April 22th. 2005. Trial would be expired since more than 2 years and half. Indictment request to put on trial Silvio Berlusconi for corruption in judicial deeds, date March 10th 2006. After more than tree years and half, this trial expired too.
