TIME Nominates Moblogged Photo
Within 15 minutes of the London Bombing, Adam Stacey sent a photo directly from the scene to his moblog. Now that photo has been nominated by TIME Magazine as one of the best photos of the year. The problem is that Stacey didn't use Thumbprints and now his work is being used without his permission. Here is what is being reported today:
Moblog co-founder Alfie Dennen is furious that the photo agency Gamma has claimed credit for a well-known photo of last summer's London subway bombing -first circulated on Moblog under a Creative Commons license - that was chosen for Time's annual Best Photo contest. Dennen and others in the blogosphere are hoping that photographer Adam Stacey might take legal action against Gamma for what seems to be a breach of copyright.
We are quickly approaching a time when all big stories will be broken by citizen reporters and these accidental bystanders will need tools that let them distribute their work to news organizations while still protecting their rights. This is the first high profile case but there will be others. Photo sharing is a good thing but citizen reporters need to make use of tools that protect the copyright owner while serving the general public.

Just wanted to note that the paragraph in italics above comes from a blog written by the Institute For The Future of the Book (if:book) and was written by myself. Here's the permalink:

Book Reviews, News and Information is a commercial blog that is basically taking our RSS feed and embedding it in advertising, which is a clear violation of OUR Creative commons License (we have a non-commercial license, unlike Stacey). So as long as we're talking about CC violations, thought I'd clear this up.
