John Grisham Asking Federal Court To Dismiss "The Innocent Man" Libel Lawsuit

OKLAHOMA CITY – Author John Grisham is asking an Oklahoma federal court to dismiss a libel lawsuit filed against him by Pontotoc County District Attorney Bill Peterson and others over their depiction in Grisham’s nonfiction best-seller "The Innocent Man", about the prosecution of Dennis Fritz and Ron Williamson for the 1982 murder of Debra Sue Carter. The Pontotoc County District Attorney Bill Peterson is the prosecutor who sent Dennis Fritz and Ron Williamson, 2 innocent men to prison for 12 years with no real evidence against them. The real killer Glen Gore, was the prosecution's key witness. Other defendants in the case:



  • Author Dennis Fritz ,who tells his story of his unwarranted prosecution and wrongful conviction his book "Journey Toward Justice".
  • Barry Scheck, one of Fritz’s lawyers who helped exonerate him in 1999, and a co-author of “Actual Innocence,” that discusses the case of Williamson and Fritz.

  • Robert Mayer, author of “The Dreams of Ada.” - Mayer’s book discusses another Pontotoc County murder case that is also mentioned in Grisham’s book. The murder of Denice Haraway and the subsequent investigation, prosecution and conviction of Tommy Ward and Karl Fontenot. Bill Peterson got questionable convictions on Ward and Fontenot , and they are still in prison.
    Robert Mayer, author of The Dreams of Ada; and Barry Scheck, with The Innocence Project, have also filed motions asking the court to dismiss the lawsuit against them.


  • The Doubleday Dell Publishing Group, publisher of “The Innocent Man” and “Actual Innocence.”

  • Random House Inc., which owns Doubleday Dell.

  • Broadway Books, publisher of “The Dreams of Ada.”

  • Seven Locks Press and/or James C. Riordan, publisher of “Journey Toward Justice.”
    Seven Locks Press and James Riordan have asked that the complaint against them be dismissed for failure to state a claim.

    In addition to Peterson, other plaintiffs in the lawsuit are Gary Rogers, a former Oklahoma State Bureau of Investigation agent, and Melvin Hett, a retired OSBI criminalist.
    Bill Peterson and Gary Rogers were instrumental in the conviction of Ron Williamson and Dennis Fritz in the murder of Debbie Sue Carter in Ada, Oklahoma in 1982.
    The Peterson and Rogers lawsuit, filed in federal court, alleges civil conspiracy, libel, placing a person in a false light and intentional infliction of emotional distress.
    Dennis Fritz and Ron Williamson were eventually exonerated by DNA evidence after serving about 12 years in prison. A man named Glen Gore was ultimately convicted of the murder of Debra Sue Carter.
    Ron Williamson was sentenced to death for the Carter murder, Fritz received a life sentence. Ron Williamson died Dec. 4, 2004 at the age of 51.
    Dennis Fritz, recently wrote a book called, "Journey Toward Justice" about the case, is also named as a defendant in the lawsuit.
    Attorneys for Grisham, hang much of their argument for dismissal on First Amendment freedom of speech.
    “Grisham’s book, just like each of the other books about which the plaintiffs complain, is core political speech protected by the First Amendment and representing the highest order of public service by raising awareness about important social and political issues – the criminal justice system – and bringing to light issues of public concern about the performance by government officials of their public duties,” their brief states.
    They also told the court that long-established Oklahoma law forecloses any civil liability for criticism of the acts of public officials, except for any statement that “falsely imputes crime to the officer so criticized.”
    The attorneys contend that Grisham’s book amounts to constitutionally protected opinion, and that the complaint “does not contain enough facts to state any claim against Grisham and Doubleday that is plausible on its face.”
    They also said the plaintiffs should be required to identify specifically each allegedly actionable statement made by each defendant.
    “Their suggestion that The Innocent Man portrays them generally as ‘bad guys’ for their roles in the controversial convictions discussed in the book does not state a claim against Grisham and Doubleday,” the author’s attorneys stated to the court.
    The attorneys also contend that the plaintiffs’ false-light invasion of privacy claim is deficient for similar reasons, with the added argument that a public official can have no expectation of privacy with respect to the performance of public duties.

    Bill Peterson recently announced his intention to retire Jan. 2008, after serving some 27 years as district attorney.

I have just finished reading John Grisham's book "The Innocent Man". It is both disturbing and confronting. The cases brought against both Ron Williamson and Dennis Fritz were clearly fabricated. Bill Peterson is, in my reading of the book and my judgment an evil person, lacking in morality, integrity and any sense of justice. He appears to lack the capacity to be able to accept criticism or to accept the fact he made serious errors of judgment in his role as Attorney General (would be prosecutor)  He himself has a case to answer as does Pontotoc County. I make particular reference to the comments made by Judge Seay: "God help us, if ever in this great country we turn our heads while people who have not had fair trials are executed. That almost happened in this case". In the light of the facts brought out in the retrial Peterson condemns himself

Thank goodness John Grisham wrote this book. I would have hoped to read that Peterson had been assessed as incompetent by his piers and forced out of the judicial system. I am unable to reconcile how Peterson can live with himself!

I sincerely believe that Bill Peterson should be on death row. At the minimum, disbarred and the target of another major civil lawsuit against him and those individuals within Ada law enforcement who knowingly targeted innocent individuals and illegally trampled upon their rights. Bill Peterson: you are an unremorseful, evil man whom I would imagine many will be happier upon your death. Those of you in law enforcement in the area who still engage in such activity: BEWARE; the public is watching you!

For all practical purposes, Bill Peterson murdered Ron Williamson. He destroyed years of Dennis Fritz life and subjected him to of the most horrible predicaments possible: to be recommended for capital punishment and subsequently sentenced to life in prison and for something of which he was innocent. He sent other innocents to prison including Tommy Ward and Karl Fontenot and apparently is content that they continue to suffer in incarceration.

Residents of Ada and Oklahoma should pressure their senators, congressmen, and govenor's office to conduct police internal affairs (with FBI involvement if possible) into the present and past connection of members of the police department and possibly district attorney's office with illegal drug trafficing. The link between the drug trafficing by Glen Gore and the Ada Police was mentioned in Grisham's The Innocent Man. It just might be continuing today particularly given the large cash flow generally assumed to exist in drug trafficing. John Grisham, Dennis Fritz, Robert Mayer, and the legal team responsible for the exhonoration should be commended for their perseverance, diligence, and call to duty for justice. It is furthurmore a disgrace that Tommy Ward and Karl Fontenot remain in jail. Residents of Oklahoma, you have a civil duty to pressure your public officials to reverse the dreadful injustice lead by Bill Peterson which continues to punish two innocent people who remain incarcerated today. Public officials of Oklahoma and especially those of Pontotoc County and in particular Ada: Shame on You!!! Clean up your act and serve your constituents rather than terrorizing them!!!

I'm just finishing up this book, and have the same thought and feelings that you other posters have stated.  Being a strong supporter of an eye for an eye mentality.... this book has now given me some reservations.  I hope in todays criminal court system, that railroading, and out right lying is not happening, with good lawyers and technology, I hope that innocent people are not charged.  I also feel if you did the crime then you get the punishment, whether you are mentally stable or not.  Anyone who Kills someone else not in the execution of self defence is by my defination CRAZY.  I think if I were crazy and commited a crime, I'd like not to be brought back to a normal state of mind before getting the needle.  Just put me out of my and others misery...

and for that Peterson S.O.B.  he needs to spend 12 years on death row,... eye for and eye!

 I am also reading "The Innocent Man" and find that it upsets me each time I turn the page. I just looked at Mr. Peterson's website. I find him to be even more pompus and delusional then the book portrays him. Maybe he should now sue himself for making himself look even more incompetant. A person who needs to continue to defend himself and not just say "hey I was wrong and I screwed up" has something to hide. He pressured a person to go back and look at evidence and change his finding, he used a snitch that heard Ron "confess" yet noone else in the small cells heard him say anything to her. If Grisham was so wrong about his findings, why does another author who wrote a book long before Grisham basically have the same things to say about this pereson? Also, is Dennis Fritz lying? Was his experience a falsehood also? This man spent 12 LONG years of his life in PRISON!! He wasn't in some resort somewhere, he was locked up. I fully support the death penatly, but not on flimsy questionable "evidence." I will next be reading Dennis' book and then the book by Mayer if I can find it. I believe that the underlying theme will be the same and show that Peterson and his cronies did wrong.
