Tyrone Banks Sued By NHL Team Over 'Carolina Hurricanes' Song
Rapper Tyrone Banks is being taken to court by the NHL's Carolina Hurricanes over the musician's song "Carolina Hurricanes," which they believe violated trademark laws.
In the lawsuit, the Hurricanes accuse Tyrone Banks of improperly aligning himself with the team by wearing a Hurricanes jersey and referring to "Carolina Hurricanes" as "the official Carolina Hurricanes song."
Banks produced gave a copy of the song to the Hurricanes back in 2007 in the hopes of having the team play "Carolina Hurricanes" during games. The lawsuit states that the Hurricanes did use the song during games. It was also featured briefly in a TV ad and online video.
The Hurricanes say, however, says that Tyrone Banks crossed the line by using incorrectly implying that their was an official affiliation between the rapper and the team. The Hurricanes sent Banks a cease-and-desist notice earlier this year. As a result, Banks excised the words "official" and "anthem" from his website.
That wasn't enough for the 'Canes. The team was still upset that Tyrone Banks wore a Hurricanes jersey in promotional material and filed the lawsuit.
