Catherine Pierce Likes Gardening in Her Front Yard Practically Naked and She Isn't Breaking Any Laws

Neighbours in Boulder Colorado are upset because Catherine Pierce who lives in their neighborhood is a nudist who likes gardening in her front yard semi-naked. She wears only a thong and some pasties (coverings for the nipples), and last year she was threatened with eviction according to The Huffington Post.

However, police have found that Pierce is not breaking any laws, as one is not allowed to expose their genitals in public, but with Pierce wearing a thong and gardening gloves, she is not exposing her genitals. (Abbey House in the UK allows for  completely naked gardening)

On March 17th neighbors complained that Pierce was in her front yard topless, but police could do nothing legally because being topless is not exposing your genitals. When the police came to her house they advised her to maybe wear a shirt as young children were playing outside at the school across the street.

Pierce's husband then complained that his wife was being harassed unnecessarily as she was not breaking any laws. He says that he will fight any ruling that will force his wife to have to cover up.

Huntley said a police supervisor agreed with Pierce's husband that Pierce wasn't breaking any laws.

The Arizona Daily Star reports that the Boulder Housing Partners are now planning to amend their rules so that all residents have to cover up when they are outside.

Two thumbs up for the Pierces for their practice of nude gardening.  They are not doing anything to compromise the "public's health, safety, or welfare".  According to the comments made by their neighbors, the nude gardening has caused a little irritation and suprise but not grave offense.  Most neighbors have mentioned that they did not want their children exposed to the nudity as some of them have expressed embarrassment. I enjoy hiking nude in some of the larger parks where I live.  I like to wear a thong in case I should run across someone who would have a different viewpoint regarding my choice of dress.  There is legal precedent that the sexual organs are the primary cause of "justified offense".  Perhaps this is because the offended thinks that the sight of a penis or vagina signifies that they will be sexually assaulted ( in some fashion )?  I am not sure.  Among nudists a thong is actually dressing kind of conservative. In addition to "how nude" one is there is also the issue of "place".  The area of the park that I choose to hike in has a good deal of acreage and is seperated, by a hill, from the majority of park users.  Should I come across someone in the "back acreage" it is usually apparant to them that my dress is "reasonable" given the surroundings.  A large nude beach such as Black's Beach works because the nude beach is seperated from the parking lot and hang gliding facilities by a very steep cliff.  To be offended by the nudity, one would have to repel down the cliff, not advisable, or walk down a lot of stairs.  From the parking lot the nudists on the beach truly look like ants. Upon their own property, the Pierces are visible to their neighbors.  If the neighbors are "offended" by nudity, they are captive to having to view it.  I think that the precidence for allowing nudity in residential neighborhoods is fairly weak.  I do not think that the Pierces could ever win this.  It is the business of governments to restrict the rights of the few for the benefit of the many.  I do not know if the Pierce's neighborhood association allows for privacy fences. It is kind of neat that restrictions regarding women's breasts have not made it onto the books in Boulder.  The typical course of events would be for the homes association to point to the Pierce's gardening and make a case before the City Council.  The City Council will usually then write the new "dress code" into ordinance and the homes association will match it in their rules/regulations. One ( possibly positive ) thing the Pierces could do is; 1. attend the City Council meeting. 2. explain that they have always liked the fact that Boulder's public nudity restrictions have     been favorable to some allowed nudity, as compared to other cities and in regards to     women's right to be "top free" as the same right is already given to men. 3. possibly provide a sentence or two as to why they enjoy gardening nude. 4. finally, the Pierces should make a promise to the City Council that they will no longer     practice nude gardening on their property as their neighbors have requested that they     cease. Perhaps the City Council will leave the current public nudity ordianance alone perhaps they will change it.  Best of luck to the Pierces.

what scares me is how terrified of the human body people in the USA are... despite being obsessed with it. fear of sex and obsession with sex... they shouldn't go together, but in the USA they really do. so somehow, nudity = sex = embarrassment. uh... sorry. no sense.

and quit with the whole "male nipples are ok, but women's nipples are offensive" crap, USA. i can't believe i was born in an insane nation... then again... most of them are because they're populated by insane animals refusing to accept that they ARE animals.

Amy, what are the laws on nudity in Canada's provinces?? i've observed there is less insanity and madness in Canada...

We allow total public nudity on some beaches and allow women to go topless everywhere in public (Canada Supreme Court ruling).  Yes we are less anal about nudity, for sure.  There are some places in the US, however, that take the more enlightened view like South Beach, FL and Black's Beach in San Diego that I know of personally.

I agree with Doug Wyatt's comments.  Being topfree is a women's rights issue and Americans need to get over their post-Victorian prudishness.  Naturism is one of the most healthy of lifestyles that advocates not only being nude but fresh air, exercise, healthy eating, respect for oneself and for others. It has nothing to do with sex and everything to do with connecting with nature. All of the attributes in naturism help us become more connected to the environment and nature. Catherine Pierce is celebrating the connection with nature and I would think those living in Colorado would be more understanding of that interest.  Also, Catherine's interest is hardly unique. In a poll completed in 2000 by the Naturist Society, nude gardening is one of the top rated activities of things to do in the nude. Good. Finally an informed police department which actually leaves people alone.Ms. Pierce is harming no one. She’s getting her gardening done, minimizing her laundry, and gaining vitamin-D from the sun.The neighbors need to leave her to enjoy her garden and find something else in life to worry about. It's only skin...we all have it.  We all have nipples.  Get over those too. Thanks.

Thankfully, she has the body for it. As for the right or wrong issue, I fail to see why a man can go shirtless and a woman can't. Throw out the sex issue, it doesn't play. Why should it be treated differently?

My husband & I are planning on coming to Boulder, Colorado next February for a holiday.  I say good on Catharine Pierce, God made us naked, why should we have to cover up in our own garden. If they don't like the look of her, stay indoors.

I agree completely.  God made a lot of things though and I wonder if you feel as strongly about some of the other things God made like opium poppies, cocoa and marijuana?
