We at NowPublic have been thinking.
It’s so nice to come to work everyday and know that our faithful contributors are going to be on the site, posting stories, adding their thoughts, and making or breaking the news. So we wanted to hear from you about why you come here everyday, and especially why you love NowPublic. For example, it could be because you like the people, or you have friends here, or because you really like staring at the yellow colour of the site. (By the way, check out our awesome staff examples that we’ve posted here for you to see. It’s always great to put a real face to a name isn’t it? So we want you to tell us, why do you love NowPublic? You can either send in your submission via photo or video (videos are maximum one minute long), explaining why you love NowPublic. You don’t have to show your whole face in the photo or video, but the more the better really, as we want to know our community better. All photos and videos must be submitted by September 1st, and then staff will select the top ten photos and top ten videos of the whole group. On September 3rd, members will be asked to vote for their favourite photos and videos. Voting closes on September 10th. The top photo and video will win a $100 gift card each; the top 3 of each category will win a NP t-shirt and there will be a draw between all remaining entries for another 5 t-shirts. Of course there are rules (check out those below) and they will be strictly enforced as well. If you don’t know how to upload a photo or video to the site, those instructions are below as well. An Upload button under the “Make News” section could be found on the right hand navigation on this story page. Step 2: Fill in the Title of your photo or video. (Suggestion- “Why your name here loves NowPublic” ). Step 3: Click on the “Browse” button under the section for “Upload Your Photos, Video and Audio Files”. Here you can find your photos or videos that you want to submit. You can add more files or edit these later. You can also ZIP files up and add in bulk. Step 4: Chose a license option, and fill in the additional details, and make sure you tag your photos and videos with ‘NP Contest’. Step 5: Scroll to the bottom of the page and hit “add”. Please wait for the upload to process. After the process is finished, you should be taken to a page where you can edit the details to your photos or videos. You may choose to do this in the future. Your photo is now uploaded to this Contest Story Page. After uploading, you can now return to your member page and see your submissions under “your latest photos and videos”. THE RULES and JUDGING CRITERIA (the fine print) Questions to ask: - Criteria for judging - What exactly are we looking for? Is this “why we love NP”/ Slogan for NP1. Description: The “Why do you love Nowpublic Contest” is designed to promote member retention and interaction with the site. Prizes will be awarded to those individuals who submit the best entries as determined by a member poll in accordance with these Official Rules. The top three of both the photos and videos submissions will receive a t-shirt. All submissions will be entered into a draw for t-shirts.

3. Binding Agreement: In order to enter the Contest, you must agree to these Official Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Official Rules unless you agree to these Official Rules. These Official Rules form a binding legal agreement between you and Nowpublic with respect to the Contest.
4. Eligibility: The Contest is open to individuals who are at least 18 years old and who are registered users at Nowpublic. Employees and agents of Sponsor (nowpublic), its affiliates, subsidiaries, and any entity involved in the development, production, implementation or fulfillment of the Contest, and the immediate family members (defined as parents, children, siblings and spouse) and persons living in the same household as such individuals are not eligible to participate. You must have access to the Internet and a valid e-mail address in order to enter the Contest.
5. How To Enter: The Contest begins at 12:01 a.m. Pacific Daylight Time (PDT) on August 20, 2008 and ends at 11:59 p.m. PDT on September 1, 2008 (the “Contest Period”). To enter the Contest, upload your photo or video to the existing ‘story’ at ____________. Only eligible entries actually received by Sponsor before the end of the Contest Period will be considered. Illegible, unintelligible, incomplete or garbled entries will be disqualified. All entries submitted must represent the original work of the Entrant and may not have been previously published or sold. If the same _______ is submitted multiple times by an Entrant, only the last submission of that model within the Contest Period will be judged. The submission of an entry is solely the responsibility of the Entrant.
6. Conduct: By entering the Contest, Entrants agree to comply with and be bound by these Official Rules, which will be posted at the Contest website at _________________ throughout the Contest Period. Failure to comply with the Official Rules may result in disqualification from the Contest. Entrants further agree to comply with and be bound by the decisions of the judges, which are final and binding in all respects. Sponsor reserves the right, in its sole discretion, to disqualify any Entrant it finds to be: (1) tampering or attempting to tamper with the entry process or the operation of the Contest; (2) violating the Official Rules; (3) violating the terms of service, conditions of use or general rules or guidelines of any Nowpublic property or service; or (4) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any false information provided within the context of the Contest by any Entrant concerning identity, postal address, or ownership of rights in the entry, and/or non-compliance with Official Rules may result in the immediate elimination of the Entrant from the Contest. Sponsor further reserves the right to disqualify any entry that it believes, in its sole discretion, infringes upon or violates the rights of any third party or otherwise does not comply with the Official Rules. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
7. Judging and Selection of Winners: Entries will be selected by the judges based on such criteria as they determine to be appropriate, including but not limited to: (a) adherence to the submission guidelines, (b) uniqueness and originality of design, (c) creativity of design, (d) completeness of design and (e) appropriateness to design categories. In the event that no winning entries are received, no prize will be awarded. Decisions of judges are final and binding. The winners will be announced on September 11, 2008.
8. Prizes: Each Entrant in the top ten submissions of each category, as determined by the judging panel based on the criteria listed in Section 7, will be awarded a prize of a $100 Amazon gift card each. The gift card will be awarded by e-mail unless this service is not available to the winner. The top three of each category will also be awarded a t-shirt and there will be a draw out of the remaining entries for five t-shirts. The t-shirts will be delivered to the winner by Canada Post. No substitution, assignment, or transfer of any prize component is permitted, except by Sponsor, who reserves the right to substitute any or all prize components with another prize of equal or greater value. ALL TAXES, FEES, AND ANY APPLICABLE WITHOLDING AND REPORTING REQUIREMENTS ARE THE SOLE RESPONSIBILITY OF THE WINNERS. Any unclaimed Prizes will not be awarded. Limit one (1) prize per person.
9. General Conditions: This Contest is governed by the laws of British Columbia of Canada. All national, provincial and local laws and regulations apply. By submitting an entry into this Contest, an Entrant agrees to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within fifteen (15) days of attempted first notification will forfeit his or her prize. Potential prize winners may be required to sign, notarize and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release, Parental/Guardian Consent Form, and provide any additional information that may be required by the Sponsor within thirty (30) days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. The intellectual and industrial property rights to the Contest submission, if any, will remain with the Entrants, except that these terms do not supersede any other assignment or grant of rights according to any other separate agreements between Entrants and other parties. As a condition of entry, Entrants agree that Sponsor shall have the right to use, copy, modify and make available the submission to the public via Sponsor's websites for any purpose, including but not limited to advertising and promotion of the Contest using screenshots, animations and video clips. Acceptance of a prize constitutes permission for, and winners consent to, Sponsor and its agencies use of winner's name and/or likeness and Entry for advertising and promotional purposes without additional compensation, unless prohibited by law. Sponsor is not responsible for any typographical or other error in the printing of these Official Rules, administration of the Contest, or in the announcement of the prize. In the event a winner/potential winner's employer has a policy which prohibits the awarding of a prize to an employee, the prize will be forfeited and an alternate winner may be selected. Entrants certify that their Entry is original and that they are the sole and exclusive owner and rights holder of the submitted Entry and that they have the right to submit the Entry in the Contest. Each entrant agrees not to submit any Entry that: (1) infringes any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; (2) contains lewd, obscene, or pornographic content; or (3) otherwise violates applicable law in any countries in the world.
10. No Recourse to Judicial or Other Procedures: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any entrant expressly waives any and all such rights. Entrants agree that these Official Rules are governed by the laws of the State of <?xml:namespace prefix = st1 />California, United States.
11. Privacy: By entering the Contest, Entrants agree to Sponsor's use of personal information. Entrants further agree that personal data, including name and address, may be processed, stored and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to check Students’ identities, postal addresses, and telephone numbers, or to otherwise verify eligibility to participate in the Contest. Entrants have a right to access, review, rectify or cancel any personal data held by the Sponsor by writing to Sponsor at contest@nowpublic.com
12. LIMITATIONS OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH ENTRANT INDEMNIFIES AND AGREES TO KEEP INDEMNIFIED THE SPONSOR AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION OF THE ENTRANT AND/OR A BREACH OF ANY WARRANTY SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH ENTRANT INDEMNIFIES AND AGREES TO KEEP INDEMNIFIED THE SPONSOR AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH THE SPONSOR WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY AN ENTRANT UNDER THESE OFFICIAL RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE OFFICIAL RULES BY AN ENTRANT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENTRANTS AGREE TO HOLD SPONSOR, ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE CONTEST AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON.
13. Internet: Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Sponsor is not responsible for theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Sponsor is not responsible for inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest.
14. Disputes. You agree that you will submit any dispute you may have with regard the conduct of the Contest, interpretation of the Rules, and/or awarding of prizes to the Administrator, whose decision regarding such dispute shall be binding and final.
15. Severability: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
16. Winners List: The names of the prize winners will be available at ______________________ on September 11, 2008 for a period up to 30 days.
17. E. Submission Agreements- Original Works. All entries must be the original creations of the entrants, not contain any intellectual property not owned by the entrant and must never have been published or professionally developed unless written authorization from the intellectual property owner is provided at the time of entry submission. Contestants agree to indemnify and hold harmless sponsors from any copyright, trademark or other intellectual property infringement claim or liability with regard to their submissions. License to Submitted Material. By submitting any design entry for the Contest, the contestant grants Six Apart a perpetual, irrevocable, fully-paid, royalty-free, transferable, non-exclusive, world-wide right and license, with rights to sublicense, to use, copy, modify, reproduce, market, publish, distribute sell and otherwise exploit the style, fonts, look and feel, images and other material submitted as an entry in the Contest (the "Material") for any purpose whatsoever, including, without limitation, modifying the Material, copying the Material, improving the Material, making derivative works thereto, reproducing the Material, and distributing the Material. Use of Personal Information. A contestant's submission of entry constitutes permission for Six Apart and, in Six Apart's sole discretion, such other Contest Sponsors to use contestant's name, photograph, likeness and other material provided in the entry for any business purpose, including for promotional purposes in any media. Representations. The contest represents and warrants to Six Apart that: (a) the reproduction, exhibition, or any use thereof or any of the Material shall not defame any person or entity nor violate any copyright, right of privacy or publicity, or any other right of any person or entity; and (b) the Contestant is sole owner of the Material, together with the title thereof and all rights granted to Six Apart hereunder, and no rights in the Property have been granted to others or impaired by the Contestant, except as specified, if at all, in these Rules.
Protection of Material; Confidentiality. It is the sole responsibility of Owner to register his or her rights in and to the Material. The Company shall be under no obligation to maintain confidentiality of the Material.
