Bell Cries Wolf on File Sharing and Congestion Numbers

Bell might just have gotten called out on crying wolf regarding P2P and file-sharing congestion rates. On June 24, they were forced by the CRTC to release their data proving their claim that high-usage customers were causing upwards of 95% of the congestion.
However, the numbers released in the report show only 2 to 5 per cent congestion on the lines. What gives, Bell? Did someone get the numbers flipped around?

In revealing the details, Bell explained in an accompanying letter that “while these numbers may seem low to the average lay person, they are significant to network traffic engineers such that it is important to consider the number of congested links in the proper context.”If only a single link in the network is congested, end users may still experience slowdowns or dropped connections, the company said, because the situation is similar to the road system — where if one major artery is backed up, all connected roads will also have problems.
“Just like a single traffic roadblock can hinder drivers going to multiple destinations that pass through the road that is blocked, a very small amount of congested links can seriously affect a large number of high-speed end-users’ traffic,” Bell said.
"As ordered by the CRTC, Bell has released (some) of its data on how torrents and P2P in general are affecting its network. Even though there's not much data to go on, it's pretty clear that P2P isn't the crushing concern. Over the two-month period prior to their throttling, they had congestion on a whopping 2.6 and 5.2 per cent of their network links. They don't even explain whether this is a range of sustained congestion, or peaks amongst valleys."

Rob Walker, I like this story. It's good stuff. Interesting. Nice to see the courts taking an interest and telling the companies to put up or shut up. IE, show the actual numbers and whether they're fudging them or whether there's an actual real-world concern over network congestion...
Could perhaps use a bit more exegesis. What are the implications if Bell fudged their numbers or overstated their case? What can come of the issue if the court finds they did overstate their case?
