Yesterday, word came out that eBay was suing Craiglsit (in which it is a stakeholder) regarding a share dispute. More detail has come to light, as Craigslist claims the suit is unfounded.

In a tiff over its 28.4 percent share in Craigslist, auction giant eBay has filed suit against the online classifieds site in a Delaware court of chancery. According to Reuters, eBay has accused Craigslist's board of directors of diluting its share.

The court confirmed that eBay filed its complaint Tuesday afternoon but could not provide further details, because the suit was filed under seal.

In a phone conversation, Craigslist founder Craig Newmark said, "We're still trying to digest it," and recommended contacting CEO Jim Buckmaster for further comment. Buckmaster did not immediately reply to an e-mail inquiry.

Okay, it's been digested:

We are surprised and disappointed by Ebay’s unfounded allegations, which came to us out of the blue, without any attempt to engage in a dialogue with us.

Coming from a shareholder that views craigslist as a prime competitor, filing suit without so much as mentioning these assertions beforehand seems unethical, and hints at ulterior motives.

Ensuring the future well-being of craigslist and the craigslist community is admittedly very important to us. But Ebay has absolutely no reason to feel threatened here — unless of course they’re contemplating a hostile takeover of craigslist, or the sale of Ebay’s stake in craigslist to an unfriendly party. (In which case, they’re out of luck.

If eBay sells it shares do you think they would auction them off on eBay or place a free ad on Craigslist? Maybe both?

Maybe under "barter". I'd totally trade my old DVD player for a few shares in Craigslist.
