The new (Jan-Feb) issue of Mother Jones includes an article dismissive of DeepCapture, giving this site a 4 out of 5 on their tinfoil-hat meter without pretense of contradictory argument or evidence. Instead, Elizabeth Gettelman (research editor of Mother Jones) simply says “Fuhgeddaboutit” regarding DeepCapture’s thesis (which she also distorts). As far as I can tell, Ms. Gettelman’s idea of reasoned discourse is, “I work at Mother Jones, so I do not need to make as coherent an argument as one would expect from a college sophomore.”

Seventy-five years ago, during the peak of the Great Depression, the SEC was created by Congress with the passage of two landmark laws: the Securities Act of 1933 and Securities Exchange Act of 1934. At that time — and with stark similarities to today’s financial crisis. — there was a consensus that for the economy to recover, the public’s faith in the capital markets needed to be restored.
Over the last 75 years, thousands of men and women of the SEC have selflessly devoted themselves to law enforcement and regulation to protect investors, markets, and capital formation. Eric Swanson was hired as general counsel in January 2008 and moved immediately into the role of working with the Securities and Exchange Commission as BATS seeks SEC approval of its exchange application. He is based in BATS' New York City office.
Mr. Swanson has a significant history with the SEC, having served at the Commission from 1996-2006 and rising to the title of Assistant Director in the Office of Compliance Inspections and Examinations' market oversight unit in Washington. His duties included supervising the Commission's inspection program responsible for regulatory oversight of trading on the securities exchanges and ECNs.
"We're excited to add Eric to our growing team and look forward to his contributions as we move towards Exchange status," said Chief Executive Joe Ratterman, noting that Mr. Swenson will report directly to him. "With his strong background and knowledge of the SEC and market centers, Eric is the ideal individual to work with the Commission during this process."
During his tenure at the SEC, Mr. Swesnon , supervised and conducted inspections and examinations that involved a wide range of issues including best execution, order handling, insider trading, market manipulation, and compliance with Regulation ATS. In addition, Mr. Swenson was responsible for the identification of regulatory risks and the development of parameters for surveillance and examination programs.
A frequent speaker at securities industry functions, Mr. Swanson was most recently chief counsel and vice president of regulatory strategy at Ameriprise Financial. He graduated from the University of Minnesota and earned his law degree at Hamline University School of Law in St. Paul, Minn. He and his family live in New York.

Barack Obama's selection of Mary L. Schapiro to head up the Securities and Exchange Commission is a bitter disappointment to investors. Her appointment will do nothing to reinvigorate an agency that has been a toothless tiger and a puppet of the industry it is supposed to regulate.
Here are some questions she should be asked at her confirmation hearing:

Dear Ms. Schapiro,
First off, congratulations on your appointment as head of the SEC. The public’s (both foreign and domestic) faith in the agency’s ability to protect it from Wall Street abuse has never been lower. The commission is in dire need of reform and hopefully you can institute the changes needed to instill investor confidence in our markets.
To this end, Ms. Schapiro, I suggest the following:
1. As the pendulum has swung to the extreme benefit of hedge funds and broker/dealers/market makers, a plan to re-establish balance must be enacted. By necessity, the plan will initially swing the pendulum to favor the Main Street investor, the backbone of the nation, much as Affirmative Action has done to address bias against minorities. Call it a “Financial Affirmative Action Plan” if you will, designed to restore transparency and trust. Thus,
A. All communication (electronic, emails, phone) between the agency and any Wall Street firm must have its full transcript made publicly available online within 48 hours.
B. At all meetings of any Wall Street firm and the commission, representatives from investor protection organizations must be given ample opportunity to attend and be present during the entire meeting.
C. All civil actions undertaken by the SEC be turned over to the Department of Justice. Criminal charges and penalties against the violators should then be forthcoming from the DOJ.
D. Quarterly meetings be held with investor protection groups to discuss ongoing or new concerns.
2. The commission review and adopt the regulatory trading proposals recommended by Dr. Patrick Byrne, the National Investor Protection Coalition (NIPC), David Patch and the National Investor Protection Coalition (NCANS). These are readily available at the SEC’s website.
3. That a substantive position be extended to Mr. Gary Aguirre, preferably as Director of the Division of Enforcement in place of the current Director, Ms. Linda Thomsen, whose integrity has been compromised and is beyond repair. I, and thousands across the country, would applaud such action.
I realize, Ms. Schapiro, that while these measures may seem draconian in nature, the onus to restore investor trust lies squarely on you and the Commission.
Time is short. And the time is now.

In 2001, two parents were convicted of manslaughter in Colorado for allowing their daughter to die from untreated diabetes-related infection. Had she been taken to a doctor, she would likely have lived. Several of her surviving siblings were also found to be sick with strep throat, with which they had apparently been infected for months.
The parents were punished with probation in lieu of confinement and are marked with the stigma of being felons.
This is most unjust, since regulators working for the FDA are committing the same crime and are being praised and rewarded, even though they are harming not a handful of defenseless children, but millions of their countrymen as the CATO institute points out:
