San Diego resident John Tyner says he could be facing a $10,000 fine, and civil lawsuit from after he refused a body scanner at SAN aiport and after he asked the subsequent pat-down to stop,  saying to the TSA agent (caught on video) "If you touch my junk I will have you arrested).

John Tyner recorded much of the incident and posted it about it on his blog. John Tyner story provides a good sense of the TSA security process from what happens after one refuses a body scan and then what happens when one refuses a pat-down.
After he refused to be "groped" things went downhill from there for John Tyner...


He, a bit taken aback, informed me that he would have to involve his supervisor because of my comment.

We both stood there for no more than probably two minutes before a female TSA agent (apparently, the supervisor) arrived. She described to me that because I had opted out of the backscatter screening, I would now be patted down, and that involved running hands up the inside of my legs until they felt my groin. I stated that I would not allow myself to be subject to a molestation as a condition of getting on my flight. The supervisor informed me that it was a standard administrative security check and that they were authorized to do it. I repeated that I felt what they were doing was a sexual assault, and that if they were anyone but the government, the act would be illegal."

 

Besides, TSA officials, airport security, one police officer was involved, and of course American Airlines which ultimately refunded the cost of the plane ticket.

So now John Tyner figures he is free to leave but wait it does not end there, airport officials still wanted John Tyner to be screened even though he was not getting on the plane.


I began to make my way to the stairs to exit the airport, when I was approached by another man in slacks and a sport coat. He was accompanied by the officer that had escorted me to the ticketing area and Mr. Silva. He informed me that I could not leave the airport. He said that once I start the screening in the secure area, I could not leave until it was completed. Having left the area, he stated, I would be subject to a civil suit and a $10,000 fine. I asked him if he was also going to fine the 6 TSA agents and the local police officer who escorted me from the secure area. After all, I did exactly what I was told. He said that they didn't know the rules, and that he would deal with them later.


John Tyner was left to stew until airport officials mulled over his fate. The conversation continued with officials asking for his name - Tyner replied they have a full report with all his information.

I reminded him that he was now illegally detaining me and that I would not be subject to screening as a condition of leaving the airport. He told me that he was only trying to help (I should note that his demeanor never suggested that he was trying to help. I was clearly being interrogated.), and that no one was forcing me to stay. I asked if tried to leave if he would have the officer arrest me. He again said that no one was forcing me to stay. I looked him in the eye, and said, "then I'm leaving". He replied, "then we'll bring a civil suit against you", to which I said, "you bring that suit" and walked out of the airport.


Reports of incidents at airport screening areas seem to be cropping up as the TSA rolls out its full body scanners, and if that is declined the more aggressive full body pat-downs. 

At least two civil liberty organizations have are collecting TSA airport security incident reports. The ACLU has a airport screening watch list as does EPIC (the Electronics Privacy Information Center).

john tyner is 100% right. because TSA is wrong. do you know how many "MEN" of different nationality "protrude" in the gential area.  there will be definitely "lots" "lawsuits" because of "MEN" different nationality "protrude" in the gential area and is and will be documented. Keep in mind TSA employees use the same "dirty and nasty" glove to touch and put their "dirty and nasty" on other people items in their luggage. and, now they want to "share" the same "dirty and tasty" glove to pat passengers down. TSA  touching the gentials is "forced rape". TSA IS WRONG FOR TOUCHING PASSENGER "GENTIALS" IN PUBLIC VIEW. TSA IS 100% WRONG.

Sorry, but I agree.  TSA is full of thugs who couldn't get hired at Micky D's.  Forcing a pat down until you are being molested would result in a lawsuit (as well it should).

I refuse to let something as narrow-minded as "if you don't like it, don't fly" be the last word.  What most people don't understand is that the TSA is run by the government.  Rather they are considered officials.  They are the POLICE of the sky.  Our 4th amendment in the Bill of RIGHTs protects us from unlawful search and seizures by ANYONE.  Our privacy is supposed to be protected by said amendment in our persons and our properties.  Anyone wishing to search me is welcomed to do so as long as they go through the due process of law (obtain a warrant).  Furthermore, the statement made by the director of TSA that they've been inspected six ways from sunday is completely unsubstantiated.  We're talking about X-Radiation which is absorbed by your skin and subdermal layers and DOES NOT GO AWAY.  Over time this exposure can cause skin cancer.  An improperly configured backskatter machine can deliver 20x the "safe" dose.  Also not to mention the FDA is the one that approved the use.  This is neither a food nor a drug but is radiation exposure.  The FDA has no reason to be approving this at all with exception that they want to tag a respected organization to the process.  OK - all you sheep line up for processing.

John Tyner is 100% within is constitutional rights and the TSA is 100% outside of the law on this.  I don't care what some document says that differs with this.  We are still Americans and this is still the United States of America.  The constitution is still the supreme law of the land and article 4 prohibits unreasonable searches. 

Groping anyones genitals is unreasonable without an extremely good reason which clearly does not exist in this case.

Flying is the only industry where you can pay 100s or 1,000s of dollars to get treated like a sheep in a herd.  The government should start supplementing the costs if we have to be suggested to stuff like this in our travels.  This is turning into '1984' and if we are not careful we will wake up one day ad big brother will have taken away all of our rights without us realizing it was happening.  I grew up in NY and was there for September 11, 2001.  I lost my cousin on floor 107, Cantor Fitzgerald.I am against these intrusions.  Flying is nerve racking enough without these terrible measures.  I can't even fly back from NY with a Roast Beef sandwhich and Thousand Island dressing on the side.  It is a matter of National Security now.

HDSINOK,I challenge you to show me where in the constitution there is a reference made to airport screening. You people are all nitwits. I hope he's on the next plane that gets blown out of the sky. As someone who flies frequently, I don't care about the full body scans or the pat downs. He doesn't want the scan, he doesn't want the pat down--what the hell makes him think that he's so special that he shouldn't be searched at all.

If scans or pat downs stop one plane from crashing into a high rise is'nt it worth it, Only people who have something to hid don't want searced. you have a bigger chance of skin cancer from the sun then the scanner

@fishon Ok but he DID have the right to refuse processing so the airport DID have the right to kick him out of the airport.That is where it should have ended,,but it didnt.He was threatened with further legal action making the TSA wrong in this case.I think the TSA is abusing thier power.

I fly alot!!!  All those that dont want to be screened..........move to a differnt country.......who cares....about the body screens....Go fight for something better then that...like hungry children..homeless people.....GET OVER IT PEOPLE... whats the big deal... go see a therapist....!!!

Hooray for John Tyner. The TSA is a group of people who were unemployed yesterday, are given a 'limited subject short course" today, then become rude and demanding authority figures tomorrow. Where is the experience and courtesy? Their leaders are political appointees "with no experience". Radiation accumulates and is stored in the body forever. And a patdown is controlled by no legal rules and limitations. I want to fly safe, but must all human decency be forfeited to a untrained person "licensed to grope"? And most of all - I AM A CUSTOMER!

lol... no offense to other reserves who actually have a brain, but thats the problem with ppl like u. you play like ur military a few weekends and you forget that ur 'job' (i mean, parttime volunteer gig that you tell people is ur job) is defending peoples rights to stand up against the gov. just because the gov does something doesnt mean its right. maybe you should enlist in the fulltime military and ull get more of a clue. ive been in 8yrs so lemme know if ya need help choosing.

It's all well and good to say don't fly, however, I have two stepsons, one is sixteen and the other is thirteen,  are they to be subjected to either being exposed or groped?  If anyone else took a nude photo of them it would be child porn.  And if anyone other than a government official gropes them, he or she would be thrown in jail.  I don't have a choice in them flying; it is the only way they can get to visit their biological dad.  So just how far do we let the TSA go on this.  It would be much safer to just do a strip search, are we willing to go that far?  I for one think it has gone too far already!

I think its pretty pathetic, that this gentleman went up to the machine and instigated a argument between him and the TSA agents. Understand this people, you are GROWN UP'S. You know that this procedure is for your safety and these people are trained to do the procedure. If you are nervous understand that we are human, we all know what the naked body looks like. So get over it and let these people do their jobs which is keeping YOU and I safe.You know that word? Safety? the word that you screamed to the 'government' your so pissed off for when 9-11 happened? Oh that was then huh? When people got on the plane and blew them up, or when they pulled out a knife, or some other weapon and held others hostage. I am pretty sure that then you were all crying your eyes out demanding for SAFETY.Now you are bitching because the TSA is making things safer? Give me a break! You are all hypocrites, MALE TSA's are allowed to pat down another Male, this is procedure this is a safety issue you ALL wanted a few years ago.There is nothing ' sextual ' about it. Female TSA agents are allowed to pat down FEMALE passengers. This gentleman didn't want to do either.He went through the area, knowing that he was going to cause a fight, started an argument, held up tons of people waiting to go through the detector and made a scene, he made himself a suspect. He brought unwanted attention to himself refused a safety check and then just expected to walk out of there no problem? I don't think so. This isn't a court where you go through a metal detector, this is a AIRPORT where hundreds of other people can be flying with you in the air at the same time, this is a place where you cannot run or escape a mad man with a bomb, you are stuck in the air with a crazy lunatic planning on killing you all including your ' babies 'But thats okay because you cant even walk through a scanner.... because you feel like your privacy is being broken... PLEASE....  pathetic.This man walked up to the TSA like he had something to hide, REFUSED to be checked claiming he would have TRAINED professionals arrested for ' Molesting ' him (right) and then he planned on just walking away after making a scene.I would HOPE they would detain him and make him be patted down anyway for EVERYONES personal safety.... If he actually HAD a bomb taped to his inner thigh, and made a scene, and then tried to walk away he could potentially carry the bomb right back out into the open to try again later.... Did you ever think about that?They did the RIGHT thing, you are all just winey little babies that don't know what the hell they want.... you want to be safe, and you want the airport to keep you safe, but you wont allow them too because your ' uncomfortable' ... pathetic, hypocrites.

Chill out and don't burst a blood vessel.We didn't "all" want these procedures. In fact, most of us did not. TSA is not making anything safer; it is all security theatre. Sure, some forms of search will help deter certain forms of attack, but at some point it gets really invasive with no added benefit.
