Liquidity Thy Name Is Madoff — Full Court Captured Press & SEC
Madoff had an easy scam going. For years we watched as CNBC paraded out the thugs on tv as they and the media pundits tried to convince us that in the name of liquidity, we had to let the hedge funds and their cohorts, the bankers and Wall Street, lie, cheat and steal our money. A captured press aided and abetted, and quashed any investigations and disclosure about the heist, whenever they were called to serve. Now we have more proof that the press was complicit. There was no regulatory oversight since Cox and the SEC regulators are also captured. We wrote thousands of letters to the SEC, the Government, and the Media, all to no avail. With the recent destruction of wealth of some of the uber rich, we are finally getting the coverage we craved as we tried to ward off this tragedy.
Isn't it funny how Cramer is now acting like he is the face of integrity. He is a liar and a thief imo. He has reinvented himself once again. I wonder how many investors he brought to ruination during the dot com bubble. He claims he warned people, but the record shows, that is a bold faced lie. I have a particular bone to pick with him. He lies and tries to destroy companies doing research on cancer. You can read about that and his reinventing himself later on in this blog.

Discovery documents are coming to light showing "journalist" Bethany McLean conspired with hedge fund Rocker Partners, David Rocker and Marc Cohodes, (who changed their name to Copper River Hedge Fund, and who last week released news that they are closing up shop due to a downturn in their strategy, as reported by another captured "journalist" Carol Remond), to try to destroy Canadian company Farifax Financial Holding. I will try to find you a link to the Fairfax Financial lawsuit. It is a SCORCHER!
Although Rocker Partners/Copper River was dropped from the Fairfax lawsuit, they can be pulled back in if evidence is presented. I think the smoking gun is in the emails between Bethany McLean and Marc Cohodes.

It bears noting that, according to filings in the Fairfax suit, the various participants in the attack on Fairfax stock referred to their effort collectively as “the Enterprise”. Whether or not this is what Cohodes was alluding to when using the term — which might not otherwise belong within quote marks in this context — is not clear, but certainly suggestive.

How can I be certain that this particular story was the direct result of the Cohodes’s efforts? The answer to that question is where the situation becomes particularly disturbing…sufficient to leave me feeling physically ill, and prepared to officially add Bethany McLean to the short but distinguished list of truly captured and corrupt journalists.

Wilson said she would allow Fairfax to revise its lawsuit. Fairfax lawyer Michael Bowe of Kasowitz, Benson, Torres &Friedman in New York said after the hearing he would do that to again try to link Rocker to the alleged conspiracy.
``There may very well be a reason for bringing Rocker back into the complaint,'' Wilson said. ``If Rocker belongs here, I will welcome him back with open arms.''

Carol Remond Tells a Joke She Doesn’t Get

Before publishing the following piece critiquing Carol Remond’s recent article on Copper River, I contacted Carol for comment. Unlike Joe Nocera and Floyd Norris (both of the New York Times), who have at least had the integrity to defend (however haplessly) their work, Carol refused any on-the-record comment on this subject. Thus she joins that tradition of journalistic worthies which includes Bethany McLean, Herb Greenberg, and Roddy Boyd, who refuse to defend or even discuss errors in their work. They can critique, but not engage, opine, but not defend: the sophomores of intellectual discourse.
Last week DowJones reporter and hedge fund shill extraordinaire Carol Remond wrote a story, “Hedge Fund Copper River to Liquidate“, about the implosion of her hedge fund patron, Copper River (née Rocker Partners). Following a course charted by no lesser luminary than Roddy Boyd (cf. “Roddy Boyd Works It Likes He’s Paying the Rent“), Carol devotes the article to shameless apologetics that would make a congressman blush. Quelle surprise.
I am not a bayonette-the-wounded kind of guy (indeed, to investors in Copper River I send my condolences). But buried within Carol’s article is a critical admission that will be of interest both to readers of DeepCapture.com, and to those investors ill-starred enough to have stayed with Copper River/Rocker Partners through to its ugly and ignominious end. Carol states:
“Copper River held large short positions in some illiquid stocks when the Securities and Exchange Commission tightened the rules governing short selling…. By doing away with an exemption that was the backbone of a trading strategy that allowed funds to short stocks through the options market, the SEC effectively restricted their ability to maintain these positions.”
The strategy that was curtailed by the SEC’s decision to do away with the “exemption” that existed in the options market was the strategy of naked shorting via rolling failed positions through the options market maker exception to Regulation SHO. Ms. Remond appears not to understand the SEC’s view of this strategy. A fine paper by noted young economist John Welborn fleshed this out over a year ago (”Married Puts, Reverse Conversions and Abuse of the Options Market Maker Exception on the Chicago Stock Exchange”) . In it, he explained the requirement to locate stock, the exception to that requirement which Reg SHO makes for market makers, and the SEC’s view of the misuse of that exception. I will quote from John’s paper at length:

Thus, Carol is explicitly stating, no doubt unwittingly, that the “backbone of a trading strategy” employed by David Rocker and Rocker Partners/Copper River was, in fact, unlawful abuse of an exception which the SEC has specifically deemed out-of-bounds.

Fairfax Financial, is also suing Steven A. Cohen of S.A.C. Capital Hedge Fund and others for financial damages after they implemented a short-selling, disinformation conspiracy to drive down the price of Fairfax's stock.

"“It was a massive and fraudulent disinformation campaign”, reads Fairfax’s statement of claim which used “dirty tricks”, fronts, aliases and bear attacks to ruin the company’s reputation and price.
One defendant is an “analyst” called Spyro Contogouris who Fairfax claims had no credentials and a career of lawsuits and legal hassles.
He and others were hired to spread disinformaton to journalists, online chat rooms, regulators, auditors, rating agencies and even harassed Prem Watsa, Fairfax CEO and Chair and other officers.
“The amended complaint alleges a shocking scheme against a prominent Canadian company and its American subsidiary,” said Fairfax lawyer Marc Kasowitz in a telephone interview yesterday.
The Easter Bunny ran a blog on Sauer after he posted his op-ed piece on the joys of shorting in 2006.
Richard Sauer is the former SEC attorney, NY Times OP ED writer on the glory of shorting and how the SEC should give short sellers a cash bonus for ferreting out bad companies, now exposed by Roddy Boyd New York Post and www.thesanitycheck.com to have been recently hired by David Rocker Short Selling hedge fund.

Short sellers occupy a position in the stock market like that of predators in nature: necessary but unloved.
Corporations, which like to see their stock always rising, despise these traders, who borrow shares and sell them in the expectation that the price will fall soon and they'll make a profit. There are signs, however, that these vilified traders might be coming into a measure of respect for the critical balance they provide in a market frequently dominated by the puffery of companies and sell-side analysts.
The short sellers' skeptical scrutiny of companies they feel are overpriced has led them to uncover many of the major financial frauds of recent years. Yet they continue to be burdened by a regulatory scrutiny of their own actions that springs more from rumors than fact.

Many charities are being decimated by the Madoff disaster. I am truly sorry for that. I see the Robin Hood Foundationl also took a hit. Stevie Cohen of S.A.C. Captial, who is being sued by Fairfax is on the Board of Directors of the Robin Hood Foundation. Hopefully he can fill the gap, perhaps by forgoing the new wing on his digs.

But giving to charity, then having the charity to invest in your hedge fund taints the gift with a potential conflict of interest. In a similar controversy, hedge-fund directors at the Robin Hood Foundation found themselves under scrutiny from Congress last year after directing Foundation money into their own hedge funds (which then pays the 2-and-20 fees). The group quickly ended the practice.

A Dressing Room For Steven Cohen November 20, 2008
For hedge fund kingpin Steven Cohen, 35,000 square feet is simply not enough. Is the SAC Capital Management chief to go without a dressing room, a breakfast room and a garden room at his Greenwich, Conn. estate?
Not if he can help it, that’s for sure. The billionaire has asked Greenwich’s Planning and Zoning Commission for permission to add 1,145 square feet in a pair of additions to his 35,085-square-foot, 14-acre Crown Lane estate. The commission is set to review Cohen’s application at its Dec. 16 meeting. In addition to the aforementioned new rooms, the expansions would also include more storage space.
Cohen’s mansion already boasts an ice rink (with Zamboni machines!), an indoor pool, a basketball court and, based on aerial views of the palatial manor, a tennis court and a two-hole golf course. He has already made copious additions to the home since he and his wife, Alexandra, bought it in 1998 for $14 million.

You want my top 10 stocks for who is going to make it in the New World? You know what? I am going to give them to you. Right here. Right now.
OK. Here goes. Write them down — no handouts here!: 724 Solutions (SVNX:Nasdaq - news), Ariba (ARBA:Nasdaq - news), Digital Island (ISLD:Nasdaq - news), Exodus (EXDS:Nasdaq - news), InfoSpace.com (INSP:Nasdaq - news), Inktomi (INKT:Nasdaq - news), Mercury Interactive (MERQ:Nasdaq - news), Sonera (SNRA:Nasdaq - news), VeriSign (VRSN:Nasdaq - news) and Veritas Software (VRTS:Nasdaq - news).
We are buying some of every one of these this morning as I give this speech. We buy them every day, particularly if they are down, which, no surprise given what they do, is very rare. And we will keep doing so until this period is over — and it is very far from ending. Heck, people are just learning these stories on Wall Street, and the more they come to learn, the more they love and own! Most of these companies don’t even have earnings per share, so we won’t have to be constrained by that methodology for quarters to come.

We try to own every one of them. Every single one. And if I had my druthers, I wouldn’t own any other stocks in the year 2000. Because these are the only ones worth owning right now in this extremely difficult, extremely narrow stock market. They are the only ones that are going higher consistently in good days and bad. I love every one of them, just as I loathe the rest of the stock universe.
How did this stock market get like this, to where the only people who can make a dime in it are the people who are interested in the most arcane subject, the moving of data from one space to another, via strange new machines and software? How did it get to the point where nothing else matters, most particularly the 90% of the stock market I have studied for the last 20 years? How did all of that knowledge become totally irrelevant and the only stocks that work are the stocks of companies that didn’t exist five years ago and came public in the last two or three years?
A-ha, that just leaves us with tech. That’s why we keep coming back to it. That’s why, despite the 80% increase in the Nasdaq last year, we are looking at another record year now. It is by that process of elimination that I have picked my top 10. And my next 10 and my next 10 after. Only those companies are worth owning. The rest?
You can have them.

Cramer lies about Dendreon on CNBC. He said Provenge failed FDA approval. Provenge wasn't up for approval until 5/15/07.

Mark Haines of CNBC apologizes on the morning show, Squawk Box, for Cramer's error.
Cramer later that night apologized but then went on to lie by saying the problem with Provenge was survival. Survival was the reason the FDA called for an Advisory Committee.
Cramer's degrading rant on Monday's show, 9/26/05, was right before Dendreon's CEO was presenting at UBS. It is important to note that UBS is the only company that downgraded Dendreon, not once, but four times in 12 months after Dendreon reported good steps of progress.
And then Mr. Cramer went into adisgusting berating of us shareholders, calling us drunken, carousing, gambling Falstaffs. He called Dendreon a battleground stock. "Dendreon investors might as well take their money to Vegas."

The message is simple - all the markets are rigged and gamed, and the connection in the scam is that delivery is a sham. The crooks and thieves figured out that you can game anything if you can eliminate checks and balances that require delivery of the actual item purchased, and can substitute accepting counterfeits and IOUs. You can manipulate prices, disconnect price from supply of the asset, destroy companies for profit, move the value of underlying assets using derivatives, BK the global financial system...you name it.
This is the market system as it exists in the US.
The cops are bent. The thieves run the game. You are the food, the raw material that goes into one end of the sausage grinder and is turned into their next meal.
And that's the tame version. The sad part is that the press is now nothing more than an arm of the swindling machine. They parrot whatever the thieves want you to hear. And other than a few websites which have been remarkably prescient, there is no dissenting opinion to the pabulum foisted off on the nation's mouth-breathing hordes. On CNBC, all is well. At the SEC, everything's fine. At the WSJ, couldn't be better. NY Times, Floyd's a gentleman and a scholar.
