Taylor, Bean and Whitaker in Trouble: FHA Expulsion
Mortgage lender Taylor, Bean and Whitaker Mortgage Corp. has been suspended from the Federal Housing Administration (FHA), on grounds of possible fraud.
According to the FHA, Taylor Bean failed to submit a mandatory annual financial report and did not reveal they had unresolved issues with an independent auditor, which had found "irregular transactions that raised concerns of fraud".
The firm is the third-largest lender in the FHA, but may not survive the suspension, said David Lykken of consulting firm Mortgage Banking Solutions.
Taylor Bean and Whitaker is known for purchasing FHA mortgages from new lenders during their probationary periods with the agency, something most other lenders refuse to do. The firm also has a reputation of being "less strict" when underwriting FHA and "conventional" mortgages (which may be sold to mortgage companies such as Fannie Mae, who are supported by the government).
“I’ve heard it said it’s good that we have Taylor Bean there because no one else will buy these loans,” Lykken said. “To say they’re a bottom-feeder may be too strong a statement, but that’s how they’re viewed in a lot of cases.”
Some fear that considerable repercussions may result from the fall of Taylor Bean. Based in Ocala, Florida, the firm handles business from all over the United States and accounted for $17 billion in loans during the first half of 2009. According to Michael Moskowitz, president of New York lender Equity Now Inc., mortgage rates may rise with Taylor Bean's fall, due to the loss of competition.
“It’s just a question of demand and supply,” he said in a telephone interview yesterday. “If Taylor Bean goes down, it’s a pretty big deal.”

I am so happy that they are gone every six months my home payment went up range 500.00 every six months every time I called the customer serivce people were rude never helped I was stuck paying my payment at what they wanted me to pay I am up to pay a month 3,500.00 for my house and customer service keept saying because of the value of my home I though home prices went down (live in CA ) I was in the process of refinancing cause I could not take it THANK GOODNESS they are gone

THESE PEOPLE ARE ALL A BUNCH OF SCAM ARTIST!!! These scam artist tried to scam my son and his girlfriend out of money after they purchased a house ! They still owe them money they will NOT pay back - we think they pocketed the money !! I called them scam artist 2 months ago on the phone - I told them they were trying to take advantage of young firstt time home buyers - they cussed me and hung up on me several times !

I am also affected by this TBW mess. I refuse to pay anyone that is in failure any payments by check. I was already set up for the August payment so this money should be deducted by TBW if they are the rightful recipients of these funds. I will NOT send any checks to these people. If they were reliable, they would answer the phone. However, I still don't think Bank of America is taking all of these loans. I called them today, the guy said 175,000 loans were now in the process of being transferred to them and would be at least a week to get the information into their system. He had no idea if my loan would be there or not. I have a conventional loan, not FHA. Ideas?

I learned today from the federal reserve bank today that other banks are servicing some TBW loans. Ocwen, 1-888-746-2936, Saxon, 1-888-422-6451,Cenlars,877-680-5583, and 21st mortgage has the manufactured home accounts. I don't have that number. I even heard that US bank may have some of the loans. I called the numbers I listed and verified that those companies are waiting for TBW loans to post as is BofA.

Fly Boeing Jets: I read in the Ocala Star Banner (I live here) that conventional mortgages were being transferred to several different servicers. I guess you will have to wait for a letter to determine who will service your mortgage. Btw, the Ocala Star Banner is online and has up to date info almost daily.

Deborah Sullivan: Having never been late with my mortgage payment, I was getting very nervous and about to cave in and mail it to BofA. Thanks so much for the info that 21st Mortgage will be servicing manufactured homes. You've saved me a lot of grief! I'm back to waiting for a letter from a new servicer before I send in my payment.

Well is seems like we are all dealing with the same issues. My concern at this time is my homeowners insurance is due and my taxes, yes all the cash in escrow. So my fear is that my homeowners could be dropped and live in Florida (hurricane season), since that is more reasonable I guess I will pay to protect myself and wait for a refund from the insurance company once this get's straightened out. The taxes are a litte bit more difficult, but he final deadline is March 2010, so I will handle that with the new service provider. I spoke with BofA yesterday and they are still entering in the accounts, so not 100% sure if they are my new service provider and not sure where to send my Sept. payment, so for the first time I might be late to make sure the money goes where it needs. Hang in there, things have to get better.

I formally filed a complaint with FDIC to ask that escrow money be covered for customers that can't reach their bank or money has disappeared in thin air and taxes are due. That money is OURS. This has gotten completely out of control and nobody in the media is covering this. I filed a complaint not against TBW but against my current holder of my mortgage as I have not received any information about where to pay my mortgage nor had access to my money. We need our money NOW. Not later.

How can a company disapear with Escrowed fund for its clients???? Uncle SAM is going to have a lighter wallet onec all the tax checks start bounceing. What do you suggest we do? I have a 6k check here that was declined once already by my bank??

Fraud!!!! I recently refinanced away from TBW. They sent me a check for my Escrow balance, over 6 grand and the check was declined!!! TBW was obviously using their clients accounts to fund their failing mortgage portfolio. TBW stole 6 grand from me and I have no clue how I can get it back. Help Please!!!!!!!

I finally just gave up and stopped payment on the check that has been sitting somewhere for 3 weeks. I did get a notice from TBW that my mortgage had been turned over to CENLAR (Central Load Administration & Reporting). Got this on the 24th of August telling me that TBW was no longer servicing my account as of August 11, 2009. Hopefully they will not charge me a late fee since I had to pay to stop payment on the check but I would not be a bit surprised. If anyone needs the payment address for CENLAR it is PO box 11733; Newark NJ 07101-4733. My loan number is not the same as my TBW loan was. The letter they sent has a coupon for a payment until they can send out new payment books. Good luck everybody, I think we are gonna need it if this is gonna be the way of the world.

TBW SENT ME A REFUND CHECK FOR ALMOST $4000 LAST WEEK FOR EXCESS FUNDS IN MY ESCROW ACCT. ITHEN RECIEVED A NOTICE THAT CENLAR WOULD BE SERVICEING MT MORTGAGE. TODAY, MY BANK INFORMED MA THAT THE CHECK FROM TBW BOUNCED!!!!!

Oh my everyone. I got a prerecorded phone call from Bank of America today around noon stating that my payment is past due. Well of course all being automated, I entered in when I mailed my payment, the amount, and it wanted to know if it was regular mail or what not. So when I answer regular mail, it said I'm sorry but the amount of the payment is not enough. You have a past due amount of 115.47. I can no longer help you please call 1-800-blah blah blah. Ok so I call the 800 number. MInd you, I still have not received my welcome letter but went ahead and mailed a personal check to Bank of America on the 25th of August. So I call this number and here it is the Loss Mitigation department and I speak with a rep named Rebecca. Rebecca informs me I am 2 months behind, I say I know I just mailed a payment to you early this week. So she wants me to set up to make Augusts payment. I said that my husband and I will be making that payment within 2 weeks. So she advises me that I will incur late charges and it will be reported to the credit bureaus. I said no mam,I have spoken with 3 different people at your company that told me because Taylor bean transferred my loan that there is a 60 day grace period. Well apparently Rebecca knew nothing of this, and SHE is in the Loss mitigation department! So after arguing with her, she puts me on hold, then transfers me to customer service where I then speak with a lady named Bridget who indeed concurs there is a 60 day grace period, no worries! So at this point Im ticked because after going through all the run around with TBW, I now am feeling the same way about Bank of America. Why does noone know their ass from a hole in the ground anymore? So not taking any of this lightly, I hung up with Bridget and called back the loss mitigation department and asked to speak to a supervisor. Mr. Victor assisted me and I told him how I felt and informed him that his "mitigation specialist" was incorrect. He apologized and said he would be sure she was informed of the policy. I told him he better do so because there is alot of us TBW customers that have been running laps for months only to fall on our faces and then I call the company that is supposed to be better than Taylor Bean and get incorrect information AGAIN! I just want an end to the nonsense. I cant imagine how many upset customers there would be if they had made that call only to hear that they are going to get a late charge and reported to the credit bureau, my goodness! Thanks all for listening, this has been such a mess and it feels good to vent with people in the same scenarios!

wow sorry you went through that, that rep shouldve known better. I am in customer service for bac, so dont worry bac is aware of transition and we just were adv one morning we will be servicing over 175,000 home loans from tb&w, sorry for the confusion.

I just found out my loan is at B of America. After I called them they gave me my new account number and log in information for their site. I can't get any other information from them though. I had been working with TB&W to get some kind of loan help who transferred me to several companies over this past year and each one started the process over again. I was told yesterday that I have to start over again and it might take up to 4 months to get help! I may loose my house by then! Is there a lawsuit I can join????????

I'm glad that we aren't the only one in this position (no offense). This is extremely frustrating! Have spent numerous hours waiting and waiting and waiting on hold for TB&W to talk to us about our august mortgage payment without an answer. Now trying to get through to BOA and that's not much easier. In addition, in June we received a notice from TB&W regarding a signifiant surplus of our escrow account with which they stated that we would receive a check in that amount. Now we are wondering if we may ever see that money with what has happened to them. Is anyone in the same boat? Is there anything we can do to make sure that we see this money?

I too, have an account with TBW mortgage lender. I have been trying to contact them to discuss my situation but couldn't get a real person to speak to so ...I have fax all required documents for loan modification and I did received a letter 3 weeks later since it was faxed saying; they did received all of my documents. The letter says, it will take 2 weeks to have my documents reviewed by mitigation officer...and that I will be contacted by them. It has been over a month no answer yet. I tryed to get on their webpage and trying to logon to my account but wouldn't let me log on. I have called BoA, if indeed they are taking over my mortgage, I was told that I should be getting a welcome package from BoA soon in 2 weeks. Up until now,. I have not received anything from them. I don't know what I supposed to do, Oh another thing too, I have been getting a bill from Clark County Property tax that TBW supposed to be paying includes my monthly mortgage. Isn't it TBW supposed to be paying my property tax by now? They paid for my home insurance but why didn't pay CC property tax. Is it wise to hire a lawyer for loan modification, should just wait until I get a letter from BoA. Please let me know, if any of you receiving a well come package for BoA.

so we refinanced and paid TBW off before they ceased operations. We finally get our escrow refund and it was returned as "UNPAID" and I got a bank charge for that and it caused our checking to be overdrafted...luckily no bank charges for that, but still. And now I can't get a hold of them, they have over $2000 of our money in escrow and we won't ever see that money! this is BS!

I have not as yet heard one word from BOA or anyone else regarding my mortgage. My second payment (September) is now coming due, and I haven't been able to pay August yet! I spoke to BOA several times, and they keep telling me a letter is coming, it must be invisible ink as it seems to have disappeared! Sorry for the weak attempt at humor, but I'm really starting to be nervous about all this! This afternoon, I am going to my local bank and see if they can find out anything for me, or at least advise me as to what to do. I wish you all better luck, and by the way, they have my escrow money too!

They have almost 2,000 dollars of my escrow money. I too deposited a check and had it bounce and incurred fees. I called TBW, and actually got through after about 45 minutes of waiting. I asked where my dam* escrow money was and they said that they had a problem with their bank (yeah, they probably had all their money seized) and they would be re issuing checks in about a week. I hope that they did not lie to me and that I will see my escrow money again soon. If for some reason I don't, I will want to file a class action lawsuit.

Well we received a letter from our new loan servicer, CENLAR which indicates that if we previously had auto payment set up with TB&W, it would continue with CENLAR?? The letter also indicates this would occur by the end of the month. It is the end of the month and no payment has been drafted yet for August, nor do their phone lines see to be working. Clearly we have ALL entered mortgage hell. This sucks!!

We received our welcome letter today in the mail finally. I called BOA on Friday and they finally had us in their system. They gave me our new loan number and also the address where to send our payment which is due tomorrow. We were told to mail it to Dallas, TX. We have an FHA loan. I also have been freaking out cause our school taxes were due today to get teh discount amount when you are talking about $4100.00 in school taxes I want that 2%. BOA had the wrong amount and of course TBW never sent the tax bill over to BOA when I mailed and faxed to them back in mid July. Anyway, the tax dept at BOA cut a manual check while I was on the phone with them for the amoutn I told them to with the discount and said they were mailing it out on Friday. I called our school district several times to keep them in the loop of what was going on. They said that they actually received a fax that same day from BOA with our name on it saying they were taking our loan over as well. They also told me that if they receive our tax payment within this week we are good with the discount. This has been a complete nightmare this whole TBW!! I am hoping that it is finally over and have to say I am loving the customer servvice from BOA so far.

Hey everyone, I read a article about TBW today in the star banner out of ocala florida. I think it sums up why escrow checks are bouncing! Google ocala florida news and click on the star banner. I live in Ohio but have found that website to be pretty informative of TBW and their problems.

I also have a loan with TBW and I just received loan information from Cenlar, that is where I am supposed to send my payments. I had been working with TBW since February to lower my interest rate since it was a Freddie Mac loan and nothing has been done with it, when I try to contact them, noone ever gets back to me. Anyone else having this problem? And what to do next? Thanks

We are in the same boat as all of you. We have a homeloan with TBW and we made July's payment only to receive it back from Western Union. We never received any notification of what was or is going on. I have been reading several stories about this on different sites and they are all pretty much the same...where the hell do we make the housepayment and did are taxeses and insurance get paid? I think a class action lawsuit needs to be filed by all of us in regards to this matter.

OK...today is 9/5! Received a collection call (had to be off shore due to accent) indicating that I have a past due payment w/BOA! Received paper copy of late payment on 8/31...with a large packet indicating where payments should now be made...interesting it was dated 8/23..also indicated that no payments were to be made to TBW after 8/5!!! I NEVER received any communication from TBW. Where is my August payment? Theft on the part of TBW? I also had a home warranty that was being escrowed ...where is it? These turkeys are thieves...and now I have been thrown to the mouth of wolves...BOA! Shitsville for sure. I am interested in a class action suit ..anyone game?
