$50 Million Lawsuit Filed in Oscar Grant BART Shooting Case

The lawyer for the family of Oscar Grant III, who was shot by a BART transit officer on New Year's Eve, has filed a $50 million lawsuit against the officer and the city. This is double the amount filed in the legal claim prior to the lawsuit. It names Johannes Mehserle in the suit, who is facing murder charges in relation to the shooting, as well as the BART police chief and other officers involved.

The hefty price tag is double what the family's attorney originally asked for in its legal claim, which is the first step in filing a lawsuit. In the weeks after the shooting, John Burris, the victim's family attorney, filed a $25 million claim alleging wrongful death. Burris said he decided to raise the amount of the lawsuit after learning more about the shooting of 22-year-old Oscar Grant III on a platform of a Bay Area Rapid Transit train station.

The shooting caused riots across Oakland in the days following the shooting, as videos released online of the event triggered angry protests.

Rioting broke out in Oakland on Wednesday night as protests over the shooting death of Oscar Grant spilled into the streets, bringing out hundreds of police and a large amount of damage in the city.
