Amanda Knox: Italian Prosecutors Launch Appeal for Life Sentence

In Italy today,  it was reported that  prosecutors are to appeal and ask for  life sentences against British student killers Amanda Knox and accomplice Raffaele Sollectio. 

Knox, 22, was jailed along with her former boyfriend Raffaele Sollecito, 25, for 26 and 25 years respectively last December, for the brutal sex murder of Meredith Kercher, 21.

Meredith was found semi naked and with her throat cut in her bedroom in the house she shared with Knox and two other women and the court heard how she was killed for refusing to take part in a drug fuelled orgy.

 Originally, the maximum sentence imposed was pleaded for by Prosecutors Giuliano Mignini and Manuela Comodi against American University of Washington student Amanda Knox  and her Italian boyfriend Raffaele Sollecito,  describing them as cold and calculated killers, but the court gave them a lower term due to their young age and clean record.

In Perugia on Thursaday  Mr Mignini   -  who was himself convicted of criminal conduct charges this year  -  deposited a 13 page file outlining his request for an increased sentence and added that because the crime was brutal and committed for "purely casual reasons",  the maximum penalty of life should be imposed rather than the lenient 26 years.  

The family of Meredith Kercher say they stand fully behind this appeal.  

The prosecution maintained at the trial that drug, drink, and sex had fueled the stabbing of Ms. Kercher, which led to her death.  

In December 2009,  after a year long trial,  Knox and Sollecito were found guilty of the murder and sentenced, respectively, to 26 and 25 years in prison. 

  Prior to this,  in October 2008, Ivory Coast drifter Rudy Guede, was given 30 years for his part in the murder and this was later reduced on appeal to 16 years.

All three claim they are innocent of the crime which took place in Perugia in November 2007.

The  legal team  of Raffaele Sollecito have  also filed a 272 page request outlining their appeal against his conviction.  Mr. Sollecito's lawyer Luca Maori said that their client is innocent and has already served three years in prison for a crime he had no part in.  

Struggling to maintain hope in Appeals process 



Since their convictions Knox, from Seattle, Washington, has been in Perugia’s Capanne jail.   Sollecito, from Giovinazzo near Bari, is in Terni prison, 40 miles away.

 Both are said to be 'very depressed' and struggling to cope, and to maintain faith in the appeals process which they hope will release them.  

Last month Knox was awarded 40,000 euro damages after an Italian crime writer published details of her sex life and diary in a book on the murder, after a judge ruled that the information used was a 'breach of her privacy'.

When would she be eligible for parole if she keeps her 26 year sentence versus if she gets a life sentence?

Well, I think she is actually trying to appeal the sentence (the 26 year one):  Either get it overturned, or cut way down (say, to 13 years).  And I think the prosecutors, knowing this, want to go for life (which for one as young as she, would be some 60 or more years)  so that it would be cut down to say, 30, rather than 13.  Of course, if she really is innocent, that would be awful.  As far as parole, I am not sure how it works in Italy.......

Whatever sentence is given to Amanda, it is given to a person for whom no forensic evidence is available to connect her to the room where the murder took place.

There is a lot of forensic evidence in the form of fingerprints, footprints, and DNA to connect one other person to the room and to the murder directly.

But Amanda is now serving 26 years for being scientifically proven not to have been present at the murder of Meredith Kercher.

Please can we have your thoughts on that aspect of the case.

From everything I have read about this case, because I was not scientifically there either, it would appear the Italians were over-zealous in their desire to prosecute and place virtually all of the blame on a non-Italian.  Amanda is the primary evil-doer according to them; she received a higher sentence, despite the boyfriend's past criminal history.   Furthermore, regarding scientific evidence.  Doesn't this case seem a bit familar to anyone?  When all is said and done, scientic evidence isn't going to matter one little bit.  Think O.J. people.  He got away with murder - literally.  Scientific evidence:  you can't have your blood at a murder scene and claim you were not there!   Yet he did, despite the evidence, and he got away with it.  So I feel very bad for Amanda; I don't see a way out for her.  And I don't care if she initially lied to the police.  She's just a kid!  She was most likely scared witless.  I wish her the best of luck.  I hope he attorney can pull a fast one.  She is in my prayers.

There is forensic and circumstantial evidence that links Miss Knox to the crime scene, of course as in most high profile cases the defence dispute this evidence.

Perhaps Mr. Winters could explain how anything could possibly prove that you were NOT somewhere?  And especially with attention to a crime scene that someone has obviously tried to clean up on a selective basis (for example, the bloody footprints which were later revealed by 'Luminol'). Also, perhaps he could explain why Amanda Knox was seen buying cleaning supplies at 7:45 am the morning after the murder, when she testified to sleeping until after 10:00 am?  And why were she and Rafael Sollicito seen outside of the apartment with a mop and bucket when the "cell phone police" unexpectedly arrived?  Upon entering, the police wondered why had she put in a load of Meredith Kerchers clothes to wash the morning after she was found dead?  And last but not least, Amanda initially admitted to being at the scene of the murder!

hi there lawrence l am a woman that was born in italy but raised here in canada.let me say this amanda knox was at the home because she took a shower after arriving from her boyfriends place.amanda did not know what was going on so she had a shower and yes she went out to buy things she needed to clean up whats wrong with that?in italy you have water just for a few hours then the shut it off so thats why she was cleaning .her friends room was locked so she proceeded taking her shower and washed what she thought clothes that were placed there.l can tell you that the court system over there is not the same as here in canada.why would a teen go to the country and kill?it did not happen.she had 3 other friends that were living there as well why would amanda kill meridith?does not make sense right now so please think about what you are saying.l believe it was the big tall black guy.they found that big foot print plus money was taken from a purse plus it was time for rent so he took it after he molested meridith.why really blame a young girl that went to italy for a change of paste so she decided to go to peruga big deal.she is a school student why the killing dont make sense my love.nothing matches the knife that the police took had amandas DNA because she had used that when getting some food for all of them and dont forget she did live there.so she washed what was there just to make a few loads before they shut the HOT WATER.l know a lot of things too.l have not been back at all to the country because l fear from planes and boat so l dont travel sad but true.you have to try and understand why family is spending all their life savings plus remorgage everthing because they know their daughter but none the less the court system in italy sucks trust me on that.this procecution is a piece of shit he needs to go to jail for what he has done to others and now to amanda.that same person was in the papers for doing wrong to people that are innocent just remember where you are not a nice place.italy of all places and that procecuter sucks.AMANDA IS INNOCENT PERIOD.GOOD DAY TO ALL PLEASE LETS PRAY FOR THE FAMILIES.

Amanda and Raffaele are innocent people.  They had nothing to do with this terrible crime  - WHY because they WERE NOT THERE.

I belong to all the free Amanda groups and contribute to her defense fund. I am too upset for words with the railroad job Mignini pulled off. He WILL rot in hell for it. In the meantime the wrong should be undone. I think that both families should get aggressive and begin to sue Mignini, the court, the newspapers and the city of Perugia for defamation of character, false imprisonment and for tampering with witnesses and evidence, for not releasing the tape of the interrogation (or not recording it, pick one Mignini, you can't have it both ways), for coercing statements and using unprofessional methods to get confessions, for not releasing evidence to the defense until well into the trial, for destroying evidence on computers (oddly they were working just fine when picked up and I even recall some very specific incriminating non-evidence that they said they'd found) , destroying evidence of Amanda's and Raffaelle's  presence in Raffaelle's place, moving evidenced from one place to another, and on and on and on. Police tapes of the investigation show mishandling of evidence and evidence of things at Raffaelle's place that later were said to be found in Amanda's room. This man must be called on his deeds before his upcoming trial for doing the same stuff in Florence. Mignini should be in prison. Amanda and Raffaelle should be free to live their now very-tarnished lives. If the Kirchers would just wake up and smell the roses they could be an immense help. But for the moment they seem to prefer burying their heads in the sand. Wake up folks, punishing these two for something they didn't do taints your memory of Mez. I used to feel sympathetic toward them, but not anymore. They had the power to look beyond Mignini and see the forest for the trees. They chose not to. Perhaps they think that taking these kids from their parents will make them feel better. It won't.Their lawyer needs to have his head examined. Please take the time to discover the truth today. Amanda Knox and Raffaele Sollecito are innocent.  There is no credible evidence that links either of them to this crime.  Find out the facts before you take someone else's word that the verdict is just.  Injustice in Perugia org

Yes, there was forensic evidence that involved Amanda. Let me assure you Italy is quite prepared to administer a high level of justice under an international spotlight.  The Italians see it that Amanda Knox and to a lesser extent Raffaele Sollecito, with Rudy Guede as a hopeful sex partner, initiated a sadistic play session with Meredith Kercher that spiraled out of control.  The session got out of control when they frightened or injured Meredith until she screamed and perhaps struggled or threatened them with arrest.  They all panicked and one strong possibility is that Knox and Sollecito ran, Guede choked Meredith to death, and then also ran.   Meredith is seen as the person who organized and planned the event.  This makes it a very unusual case in any country.   With full awareness that a finding of guilty for Knox would be offensive to Americans and others, the Italian court has nevertheless determined that this unfortunate scenario is too compelling and convincing to set aside.   When Knox attempted to slander Italian police with false accusations I doubt it helped her case.

A bright young honor student with a reputation for kindness and honesty goes off to study in Italy and overnight turns into a vicious murderer and liar? I’m skeptical. Seems hard to believe without some real proof. I looked all over the net for proof and didn’t find it. Found lots of slurs and allegations but all of it shown to be untrue or reasonably refuted. I’m firmly convinced she is innocent. Now someone has collected the information and posted it here  injusticeinperugia.org

Amanda Knox and Raffaele Sollecito are innocent people.  It is crystal clear that they are innocent of ths horrific crime.  Free them now!
