When a president is in power there is very little that can be done to make him do something through the court systems without a probable cause.
Even if there is a "good" reason to suspect a leader of wrongdoings it is virtually impossible to prove since the CIA controls most all documentation that exists worldwide.
The very best agents in the world control what goes in and what comes out and therefore, to rely on the Justice system in defense of a crime is ludicrous.
President Obama has been ridiculed and accused of being a non-US citizen and many people in government have asked to see his birth certificate so that he may prove his citizenship.
Even if the birth certificate is brought into court it will appear legitimate and the Hawaiian vital statistics department employee that printed his certificate out will never be intelligent enough to notice even one reason why that birth certificate could have been created many years after the actual birth and this is why the information is irrelevant in the Lakin case.
Unfortunately for LTC Terrance Lakin, on trial for disobeying a deployment last year, Army judge Lind ruled on Thursday that Obama will not have to testify during his case and that means he will not have to supply Lakin with a copy of his birth certificate.
Lakin is defending himself in court and asked the judge to order the president to the courtroom to produce his birth certificate for public perusal. Army Judge Denise R. Lind refused to allow the motion.
"With her decision, Lind plunged into lockstep with a number of federal judges who have ruled on civil lawsuits over Obama’s eligibility. They have without exception denied the plaintiffs’ any access to any requested documentation regarding the president's eligibility."
A career officer in the U.S. Army acting as a judge in the court-martial process for Lt. Col. Terrence Lakin today ruled that the military is no place for Barak Obama’s eligibility to be president to be evaluated. Army Col. Denise R. Lind today ruled in a hearing regarding the evidence that will be allowed in the scheduled October court-martial for Lakin that he will be denied access to any of Obama’s records as well as any testimony from those who may have access to those records.

It should be noted that the founder of the site highlighted here is Major General Paul E. Vallely, himself a birther, who appears on FOXNews as a military strategist.
He is affiliated with Center for Security Policy, a secretive Right Wing organization whose president is Frank J. Gaffney.
Mr. Gaffney has been most recently in the news for his claims regarding the re-design of the U.S. missile agency logo being meant to pay tribute to Islam by the Obama administration, although the logo change had been commissioned during the BUSH administration and his claims he is aware of a secret code being used by President Obama to signal the Muslim world.
Mr. Gaffney and the Center for Security Policy have been written of in my article, Religious Extremism and U.S. Politics: Often an Ominous Pairing, published here in October 2009.

Birther dudes are wasting time except they are all benefiting from the publicity. Claiming the CIA controls everything is nonsense and they know from personal experience.

A person who appears on Foxnews as military strategist must be of dubious character and doubtful credentials.YJ,I agree with you that these BDs are wasting their time,hoping that one day some of them may attain celeberity status through cheap publicity stunts.Best way is:ignore them,and never watch that program in which they appear as guest or host.

t k: Where do you get your news from? CNN, MSNBC, the BBC or some American hating Jihadist rag? The criticism of FNC is not only getting old, but it's to the point of hysteria. I think I'm going to start watching Fox more often because apparently 4 times more Americans watch it than CNN. Fox must be doing something right if Jihadists and PC types go into hysterics over it. No doubt about it. Obama even wanted to shut it down. And when Obama wants to shut something down, I know right away that what he wants to shut down is good for America.

Rory,as far as I can recall,couple of months back in response to your same question I replied that I do not watch TV channels,24x7 news channels dissiminate misinformation and are paid for by vested interests.So-called mainstream newspapers are,in fact,gutter newspapers.I read independent journals,some online magazines.
I am not American hating,neither the magazines nor journals or books I read.What is hated is not an average American,movies,literature,culture,values etc.etc.What is hated is US foreign policy of intervention.Howard Zinn,Noam Chomski,William Blum,Michael Moore and many more other Americans are as good and patriotic and loyal as you are.Recently, I finished two books titled'Cofessions of An Economic Hitman' by John Perkins and 'Selling Sickness' by Ray Moynihan and Allan Cassels.Authors of both the books are Americans.They have exposed how American system is manipulated by big corporations and pharmaceutical giants.You may call them,for your own satisfaction,American hating Jihadist rag.There is always a difference between government of a country and its people.both are not same.Muntazar Al-Zaidi hurled shoes at Bush,it gave me immense pleasure.On the contrary,had he thrown his shoes at Ramsey Clark,it would have hurt me.

If the CIA DID control everything though, well, maybe these paranoid conspiracy theorists would be kept quiet, and we would not have to hear the ranting and raving. ""Government Mind Control Terrorist Microwave Rays" and "Obama is a muslim plant." Many people have Birth Certificates printed up at a later date. Origionals get lost, damaged, stolen, or destroyed all the time. To claim a lack of intelligence on the part of an employee of Vital Statistics in Hawaii for printing up such a replacement is a clear show of ones own ignorance.

it is funnier that when faced with any opposition at all, which is based not on political or ideological standings, but common sense, the "republican/right-wing" response is to label those in opposition socialists. After all, the Soviet Union fell, Communism is all but passed, and the cominturn that was the great subversive force for so much of the last century has been disbanded. Capitalism won out, so lets move on. Socialist witch hunts should have died out with the USSR. Who cares who started the movement, the fact of hte matter is it is asinine, and those that are rallying behind it, Republican, Democrat, Fascist, or Socialist, need to stop and take a look at the issue in a rational way, not let someone on CNN, MSNBC, Fox News, or anywhere else tell them what to think.

President Obama's birth certificate is not on trial here. A military officer did not obey an order, plain and simple. If we were allowed to disobey orders we did not agree with or like, then chaos (think Somalia) would occur. I respect the LTC for his service, but I would recommend (in my opinion) that he not disgrace it by making a mockery of the US Military justice system. I would think the LTC should possibly just retire and take up his crusade against this issue as a civilian and then it would be more palatable. IN the military, rules must be followed.

Oddly enough, Chain of Command Follower (not verified), this is a point lost on those arguing in the defense of this officer, claiming it is his duty to disobey because of his personal beliefs.
