Army Flight Surgeon Seeks Truth About Obama's Eligibility
Army Lt. Col. Terrence Lakin is seeking the truth about whether or not President Barack Obama is eligible to serve as president of the United States according to a news release issued on March 30th, 2010.
Colonel Lakin, a lead Army flight surgeon who has received numerous awards and decorations, said he is willing to risk a court-martial if that's what it takes to determine whether or not President Obama is eligible to serve in the Oval Office.
Colonel Lakin said he had informed his superiors that he cannot understand how his oath of office to “preserve, protect and defend the Constitution” does not permit him, as a military officer, to pursue proof of eligibility from his commander-in-chief. In addition, he noted that his efforts have been rebuffed with legal evasions. Given the Obama Administration’s “transparency” initiative, the colonel believes many U.S. citizens are also demanding release of the original birth certificate.
Many U.S. citizens, known as the Birthers, are demanding the release of President Obama's original birth certificate. Furthermore, Colonel Lakin is not the first military personnel to question Obama's eligibility to hold presidential office.
In September 2009 Army Captain Connie Rhodes filed a complaint in the Columbus division of the U.S. District Court. Captain Rhodes, who was fighting deployment to Afghanistan, had also challenged the legitmacy of Obama's presidency. A similar lawsuit was filed by Maj. Stefan Frederick Cook in July 2009. Both Rhodes and Cook were represented by Dr. Orly Taitz, Esq., a national figure in the Birthers movement.
Judge Clay Land, who heard both legal cases, tossed out both cases.
In Cook, Judge Land claimed:
[T]he judicial branch shouldn’t inject itself into “political disputes” and shouldn’t get involved in hypothetical debates that haven’t yet become actual legal disputes.
In Rhodes, Judge Land warned Dr. Taitz against 'frivolous' lawsuits in a 'widely-praised' 14-page Order denouncing Taitz and Birtherism and imposed a fine upon Dr. Taitz in the amount of $20,0000 for misconduct. The warning and fine came as a result of an appeal filed by Dr. Taitz on Rhodes behalf requesting stay of deployment.
Captain Rhodes later denied she authorized Dr. Taitz to file the appeal for stay of deployment.
Court Martial Likely for Lt. Col. Terrence Lakin
Colonel Lakin has refused all military orders, inviting his own court-martial, in pursuit of the truth about the president's eligibility under the U.S. Constitution to hold office.
Article II, sec. 1 of the U. S. Constitution explicitly provides that only “natural born” citizens can serve as president and commander-in-chief. Mr. Obama’s continuing refusal to release his original 1961 birth certificate has brought Lt. Col. Lakin to the point where he feels his orders are unlawful, and thus MUST be disobeyed.
American Patriot Foundation Establishes Legal Fund for Lt. Col. Lakin
The American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, immediately announced it has set up a legal defense fund and will provide Lt.
