Former teacher Ashley Jo Beach was sentenced to 20 years in prison for having sex with a 13-year-old boy. In September, 38-yar-old Ashley Jo Beach was found in some bushes with the young teen near his house in Meridian, Idaho. The boy's name has not been released. Ashley Jo Beach also admitted ti "inappropriate relationships" with five other students. Ashley Jo Beach's lawyer argued that his client was not a pedophile and should be getting psychiatric treatment instead of prison time.

Ashley Jo Beach is married with three children; she pled guilty to felony lewd conduct as part of a plea bargain.

“I failed to be the moral and responsible adult I should've been," Ashley Beach said in court.
"I was thankful I was caught," Beach told Wilper. "Because it was a train wreck I couldn't stop on my own."

Rationale of statutory rape laws

Statutory rape laws are based on the concept that a young person is legally unable to consent to sexual intercourse by reason of their age. Thus, the law assumes, even if he or she willingly engages in sexual intercourse with a legal adult, the sex is not consensual

Critics argue that a young teenager might possess enough social sense to make informed and mature decisions about sex, while some adults might never develop the ability to make mature choices about sex, as even many mentally healthy individuals remain naive and easily manipulated throughout their lives.

Another rationale comes from the fact that minors are generally economically, socially, and legally unequal to adults. By making it illegal for an adult to have sex with a minor, statutory rape laws aim to give the minor some protection against adults in a position of power over the youth.

Another rationale presented in defense of statutory rape laws relates to the difficulty in prosecuting forced rape (against a victim of any age) in the courtroom. Because forced sexual intercourse with a minor is considered to be a particularly heinous form of rape, these laws relieve the prosecution of the burden to prove lack of consent. This makes conviction more frequent in cases involving minors.

The original purpose of statutory rape laws was to protect young, unwed females from males who might take their virginity, impregnate them, and not take responsibility by marrying them. In the past, the solution to such problems was often a forced marriage or "shotgun wedding" called for by the parents of the girl in question. The original rationale was to preserve the marriageability of the girl and to prevent unwanted teen pregnancy.

In some states a man can defend himself against statutory rape charges by proving that his victim was already sexually experienced prior to their encounter (and thus not subject to being corrupted by the defendant)"

Does make you wonder doesn't it, a draconian sentence I would say. Punish, yes, but robbing her of such a huge chunk of her life is a bit ott.

Adult survivors tell the tale best when they explain that they really didn't know better but that it did radically damage them for life.  Certainly not all people victimized by sexuality as children have been damaged, but the majority have.  children being sexual is not the problem, but children being involved in adult sexuality is.  Adults and children do not belong together sexually, not at all.  This behaviour leads to a wide variety of damaged behaviour in adulthood including but not limited to pedophilia, drug abuse, prostitution, suicidal issues and other mental health matters, depraved self image, sexual addiction, predatory acts, and failure to thrive.  

The damage done to the child is for life.  Particularily heinous is when the adult is employed in a position of trust with children, such as teaching.  Should the punishment not reflect the damage done?  Will this perhaps help to discourage foolish adults from falling for the innocent wiles of foolish children who don't understand how their childish sexuality transmits to adults?  

keep in mind that a 20 yr sentence often results in but half a decade actually spent in confinement.  With early parole, reduced sentences, double time served and other little "perks" for "poor misguided fools" the average convict does not serve the time as sentenced by even a fraction these days.  this woman's prison is also very likely to be more of a large woman's residence with a lot of rules, comfortable accommodations, and very open visiting rights, possibly even day parole in a short time!  Hotel Fed indeed.

I'm not disputing that people who take advantage, sexually, of children should be punished. It's the severity of the sentence, particularly in comparison with those handed out to men, and also to those in other countries that annoy me.

If she is fortunate enough to get out early and enjoy the wonderful life in prison you portray, is that any worse than, or even comparable to, male rapists child sex offenders being released early to reoffend time and time again? At least she isn't going to be the menace to society that the majority of male reoffenders turn out to be.

Regarding Turkish criminal law, Article 103 "(1)     "  Any person who sexually abuses a minor shall be sentenced to a penalty of imprisonment for a term of three to eight years.  "103/2 "Where the sexual abuse occurs as a result of the insertion of an organ or a similar object into the body, a penalty of imprisonment for a term eight to fifteen years shall be imposed." (3)       Where the sexual assault is committed by the direct ascendant, second or third degree blood relative, step father, the adoptive parent,  guardian, tutor, teacher, carer, other persons in charge of providing health services or who bears the obligation for protection or supervision, or through abuse of the influence derived from a working relationship or is committed together by more than one person, the penalty to be imposed in accordance with the above sections shall be increased by half.    It seems if the perpetrator had committed this crime in Turkey she would have been sentenced to at least 12 years. However Judges have a room to reduce the sentence up to 1/6. I mean it may be reduced to 10 years. Given that she pleaded guilty, the sentence would have been most likely to be reduced. However there is another detail that she admitted other rapes. This is another story.   Personally, as a Turkish Jurist, I do not agree that these sentences should be as hars as like this. A rape, in any circumstances, may not be as serious as a MURDER. I am sorry for the teacher. She did not deserve to be punished like this.
