A 38 year old attorney, her two young daughters, 2 and 4, and her 67 year old mother were found dead in a San Clemente , Ca home in an apparent murder-suicide.
The mother of the children had apparently just lost custody of the children. The father - who had begun the custody proceedings - was out of the area, and is not a suspect.
Police say one of the adult women was the shooter, but have not determined which.

Authorities on Tuesday identified the four victims of a murder-suicide that took the lives of a mother, her two daughters and their grandmother in San Clemente on Monday.Elizabeth Fontaine, 38, her daughters Catherine Fontaine, 4, and Julia Fontaine, 2, and their maternal grandmother, Bonnie Hoult, 67, were found dead Monday afternoon in a home where they were staying in a gated community in the upscale Talega community, said Jim Amormino, a spokesman for the Orange County Sheriff’s Department.
Each was shot and died of a single gunshot wound to the upper torso. A handgun was recovered at the scene, but authorities said it was unclear who fired the shots.
Officials are investigating the slayings as part of a child-custody dispute. The family was visiting Orange County for a hearing Monday during which Superior Court Judge Thomas H. Shulte gave temporary custody of the two daughters to an aunt, and the mother was instructed to return the next day, according to court records.
The family was found lying together in a hallway on the second floor of the home after deputies arrived shortly before 2 p.m. Monday, Amormino said. Their bodies were situated so close together they were touching.
“There’s no question the two children were killed first, and one of the adult females is the killer, which is unusual by itself,” Amormino said.
He said the girls’ father is not a suspect in the case. "The father was nowhere near the crime scene," Amormino said.
Amormino said the victims were in town from Houston for the custody hearing and were staying with friends Kevin and Leslie Herbert, who lived in the rented house on the small cul-de-sac with their young son.
Just an hour before sheriff’s deputies came to the house on Calle Sonador, next-door neighbor Rebecca Vandehei, 43, said she heard a high-pitched cry from what sounded like a young girl and wondered what was going on.
”It was like someone was waking up from a nap or didn’t like something,” she said.
Vandehei said Herbert told her that he realized something was wrong, got out of the house and called police.
“He had heard something that bothered him and told his wife to leave,” Vandehei said. “He heard them talking about some plans and shortly after that police came.”
Investigators are awaiting autopsies, which should determine how each member of the family died. If classified as homicides, they would be the first of the year for the city of 61,000 just north of Camp Pendleton, according to officials at the Sheriff’s Department’s San Clemente station.
In May of 2008, two young women, their parents and their grandmother killed themselves in their San Clemente home using Vicodin, sleeping pills, antidepressants and a gun. Police closed the case after a six-month investigation.
On Tuesday on Calle Sonador, investigators made their way in and out of the home and mourners placed flowers at a gate in front of the home, Vandehei said.
“I’ve been lighting incense since sunrise,” she said. “It’s the little girls that I think about. I’m a little spooked. It’s nothing we would expect out here.”

SAN CLEMENTE, Calif. — A Houston-area attorney involved in a bitter custody dispute was found fatally shot along with her two young daughters and mother in an apparent murder-suicide after she was ordered to bring the children to a court hearing, authorities said Tuesday.Investigators found 38-year-old Elizabeth Fontaine's body next to those of her mother, 67-year-old Bonnie Hoult, and two children Monday at an upscale Orange County home. Forensic tests will be needed to determine who pulled the trigger because a handgun was found between the two women, sheriff's spokesman Jim Amormino said.
He said investigators spoke to the father, Jason Fontaine, and do not consider him a suspect. The father, who divorced the children's mother, was not at the home, authorities said. A message from The Associated Press was left with his attorney.
"He's traumatized," Amormino said. "He's coping with it the best he can."
Elizabeth Fontaine moved to the Houston suburb of Bellaire a month ago with her daughters, 4-year-old Catherine and 2-year-old Julia, but they returned to California after their father requested a custody hearing, according to court documents and authorities. Neighbors said the family and the mother were staying at a friend's home when the killings occurred.
Fontaine appeared in court Monday morning and was ordered to return with the children later that afternoon, documents show. Authorities responded to the red-roofed, yellow stucco house when they did not show and found a bloody scene: Four bodies, each with one gunshot wound, in a first-floor hallway.
Investigators were still piecing together what happened, but investigators believe the child custody dispute may have been a factor, Amormino said.
The deaths jolted the community, which has 42 luxury houses overlooking a golf course. The homes, with four to six bedrooms, sell for more than $1 million each, and Amormino said the area has a "very low" crime rate.
"It's very shocking," said next-door neighbor Rebecca Vandehei, who lit a stick of incense on her property in memory of the children.
"I did a prayer. ... I wanted to try to help," she said.
The last homicide report in town also involved a family massacre. People who hadn't heard from relatives broke into a home in another gated community in May 2008 and found five decomposing bodies.

I guess I have been watching too many reruns of Criminal Mind, but just because the gun was found among the bodies doesn't mean that it couldn't have been planted and this may have been murder by an unsub yet to be determined.

I've also watched many episodes of Criminal Minds. This case was discussed with co-workers. It is the general consensus that the mother killed the children because she didn't want to give up custody. She killed her mother to save her the embarrassment. She then killed herself because there was nothing else to look forward to than spending the rest of her life in jail alone and miserable.

I'm very sorry for your loss, Sarah, and I personally am not speculating about anything. But this is, after all, a story that was released by the Associated Press to many news venues, and it gets a lot of attention. It is beyond tragic, and all are very upset , especially because it involved 2 children. I can only imagine the pain of yourself and all who were close to the victims.

thank u.....its just been really hard and alot of family drama going on. i seen this story mon night and didnt even think it was theem.....just crazy i feel like its everywhere...... i am very young myself and its just a bit overwhelming.....i dont kno who did what theres many scenerios.... it is tragic and i dont care what the reason being NOTHING can justify my little cousins lifes they were still babies and couldnt have possibly done anything wrong its just not right.......thank u to the neighbors that called and for every1s support....
