Bank and post dated cheques are a passe now. Borrowers from whom financial institutions or money lenders have obtained blank or post dated cheques as security can no longer be prosecuted under section 138 of N.I. Act according to latest Bombay High Court judgement delivered by Justice P.K. Borkar.


Law makers could not have intended or condoned the modus operandi adopted by money lenders ruled the honble judge.
