Breckenridge, CO legalizes Marijuana, Paraphernalia

Voters in Breckenridge, CO overwhelmingly voted in favor of legalizing possession of less than one ounce of marijuana, and marijuana paraphernalia.  The pro-marijuana town law was approved by 71% of voters.

The new law will become effective January 1, 2010.  Marijuana and paraphernalia possession will still be illegal under Colorado's state laws, but Breckenridge police will now have the ability to exercise discretion and choose to ignore the state's law.  It will not change existing laws prohibiting smoking in public, use by minors, or driving under the influence.

Currently, the petty, non-jailable offense under town code carries a maximum $100 fine. In 2008, Breckenridge Police Department ticketed 10 people under the town marijuana possession law, according to BPD ticket statistics.
