Officials from the warehouse next to the nursery are being charged with negligent homicide after it was determined the fire initiated there.Whoever granted permission to have a nursery next to a warehouse and even worst, a nursery which did not meet the safety requirements should be considered  guilty of negligent homicide as well. Apparently that is being investigated. It is well known in Mexico that having a friend or relative in the government makes it easier to get a permit to open up a nursery. Now, due to the great demand of nursery homes SEDESOL ( Secretary of Social Development ) made permits easier to obtain. No one was ever told security standards were going to be overlooked SEDESOL's nursery homes have been found to have the highest number of irregularities, in spite of that, Social Security Delegate in Sonora Arturo Leyva Lizárraga, has been the only one ceased from his functions as a consequence of negligence concerning Daycare ABC's tragic fire.

The attorney general of northern Sonora state said the officials, from the state's finance department, were being charged with negligent homicide.

The department was in charge of the operations at a warehouse next to the nursery, where the fire started.

Investigators found no fire alarms or extinguishers in the warehouse.

The property was used to store cars, tires and paperwork for the state.

The blaze spread to the roof of the day care centre and fire fighters had to knock holes in the walls of the building to rescue children.

It was actually a young man with a Cheyenne Francisco Manuel López Villaescusa who opened up the holes with his pick up truck and some employees from a near by gas station like Othon Mendoza Soliz  the ones who took fire extinguishers to the place and proceeded to rescue children , action had to be taken immediately because the fire spread quickly through the flammable  polyurethane ceiling. Firefighters arrived after civilians had begun rescue actions.
“El muchacho de la Cheyenne que iba pasando, que arriesgo su vida
y su carro para tumbar las paredes, ese fue el héroe yo no sé que
hubiéramos hecho si el no abre esos huecos, porque por ahí salió
mucho humo y se pudo sacar a más niños”, señaló.

Los empleados de la gasolinera explicaron que todo ocurrió muy
rápido, que fueron los mismos civiles quienes rescataron a la
mayoría de los niños y las propias empleadas del Jardín de Niños,
algunas de ellas salían con los brazos totalmente quemados y
cargando niños ennegrecidos por las quemaduras y con tiras de piel
colgando de sus cuerpecitos.
