According to reports, the Willacy County prison abuse case against Vice President Dick Chaney and former Attorney General Gonzales is unraveling.  Prosecutor Guerra, who successfully argued for their indictment before Willacy County’s grand jury, has reportedly been removed from prosecuting the cases and ordered to turn over his files.  Guerra requested last month that Judge Banales be recused, but instead, it is Guerra who is eliminated from prosecuting the criminal cases that he worked on for the last six years.

December 10, 2008 - Raymondville, TX - In a story that is already disappearing from view, Willacy County District Attorney Juan Angel Guerra has been removed from prosecuting the prison abuse scandal case that brought national attention to this South Texas town by charging Vice President with conspiracy to profit from prisoner abuse and neglect.

Though the case initially portended to possibly have national impact, today's news is just the latest act of what has evolved into an ongoing battle of wills between prosecutor and judge, State District Judge Manuel Banales, a judge Guerra attempted to have recused from the case and had warned would be prejudiced against him. Banales, who had already thrown out Guerra original set of indictments on technicalities, has now barred Guerra from in any way working on the case which appears to be the only criminal charges likely to be filed against any high ranking member of the Bush administration.


Guerra was further ordered to turn over all files in his possession regarding the case, thus effectively dismantling the investigation Guerra has been pursuing for the last six years.

His investigation finally came to light on Nov. 17th when a grand jury impaneled by Guerra returned indictments against a handful of local officials who had been harassing Guerra as he attempted to conduct an investigation into charges of corruption and abuse/negligence at a local ICE immigration prison. While infighting and corruption among law enforcement officials is hardly new in the four borderland counties that make up the Rio Grande Valley (note this bizarre case occurring on the same day), what caught the eye of reporters and pundits nationwide was that Guerra's indictments included two astonishingly high profile names: Dick Cheney and Alberto Gonzales, as well as a state senator, Eddie Lucio.

I am not surprised by this story. If more checking was done by duo, they would find that TX is also in trouble within the state for the treatment of Mentally ill and/or Mental retardation in the state hospitals that are for Treatment of these folks.

Thank you for your comments, Gayla.  It is true, unfortunately, that folks who are inpatients in mental health facilities often face abuse.  Why people who have brain dysfunctions are so hated, I cannot say.  Perhaps those who abuse them are just as sick or more sick than the patients.  The link below has several stories of extreme abuse to mental patients, including this:

Reuters reports the indictment alleges, "Former attorney general Gonzales used his position to 'stop the investigations as to the wrong doings' into assaults in county prisons . . . .”

Reuters went on to report, "The grand jury wrote it made its decision 'with great sadness,' but said they had no other choice but to indict Cheney and Gonzales 'because we love our country.'

The families of mentally ill Americans, people who face mental health challenges themeselves, and all those who care about human rights should demand an immediate end to punishing people for being sick.  There is money to be made in treating mental health issues just like there is in imprisoning sick folks, so what is the problem? 

Why would prison profiteers rather contain our mentally ill citizens in prison "holes" where many endure solitary confinement 23 hours a day, rather than to have our sick citizens treated in secure hospital environments with a compassionate, skilled staff?  Where is the financial loss to them?  They can bill the government for treatment just like they presently bill the government for keeping our most vulnerable citizens in prison - captured, shackled naked, and sometimes killed like rabid dogs!

Prison Profiteers should re-invest their money into mental health treatment; enact and enforce laws to ensure that acute mental patients who do not realize they are sick get the treatment needed to avoid repeated hospitalization.  Invest in inpatient hospitals and outpatient community care for mental illness. 

Most mental patients do well in society with proper psychiatric care.  But that is precisely the problem, right?  Not enough money is gained by restoring Americans to health.  The money is in keeping our mentally ill citizens deranged by treating them like animals!  Any sane person might lose his mind if treated similarly.  See how our sick citizens sometimes live!

I read somewhere that in America, we have a government OF the people, BY the people, and FOR the people.  TAXPAYERS, stand up and demand that mental illness be decriminalized in our country.  Demand equal justice under the law for accused persons and humane treatment for all prisoners.  You will be held accountable some day for what you allow to be done in your names.  Yes, you will.  Amen.
