News from Washington DC today, highlights an issue that Nacy Pelosi has tried to sidestep. Americans will be forced - under pain of criminal charges - including jail, or fines, to carry health insurance. Apparently, there will be guidelines as to the government's intent.

Let us hope so. The language of the bill: "acceptable health insurance coverage" is broad enough to cause concern for many Americans.

Fines of up to $250,000 and imprisonment of up to five years are the maximum allowed for felony convictions under Pelosi's bill.  Misdemeanor offenders could be imprisoned for up to one year, with $25,000.00 penalties.

It is Pelosi’s decision to have the penalty provisions in her health care plan.  It will be interesting to see just how many uninsured families can afford the $15,000 family premium for that plan.

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail.  The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said:  “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail.  It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

Criminal penalties

Prosecution is authorized under the Code for a variety of offenses.  Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties.  The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration.  Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates.  Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

"..ut the penalties are for willful non-payment of tax, not directly from not having health insurance" A tax imposed for those who do not purchase insurance. A tax that does not currently exist in the Tax Code for people who do not purchase health insurance. If I decide I dont want coverage ( for whatever reason I choose.. because for today, at least, I can still make that choice), then I am not currently taxed.  If this passes, then tomorrow I will be taxed on my choice to not purchase insurance. If my choice is for economic reasons, then I have to subject myself to taking a "tax credit" to purchase insurance at the expense of another taxpayer, so that I am not taxed for not having coverage ( which I couldn't afford anyway). Its horrific and total control. There is no way out, you have no choice.

Dead simple - add a certain % deduction to each pay cheque that every working person earns, use that as a federal national insurance scheme, everyone is insured, everyone pays and then there is no argument - unless you are a for profit company that can kill people at will by no longer insuring them because they, the person, are no longer profitable.

Unemployed people get a credit until they find work, the elderly have already paid into the system all their working life so then they no longer have to. 

Simples.

Yes, it is indeed simple and I can see the logic that you layout, The_Cynic.  I can see how it would work for those that desire to be involved.However, how is it Constitutional to override the will of the individual who says "I don't want government health insurance."   Regardless of their personal reason, that IS their right, is it not?  Free body, free person....free choice.   Levying excise taxes for not going along with "the system" or face jail time seems a bit "coercive" doesn't it?This form of governing sets a dangerous precedent for the future......  think about it....

Once more the politics of politicians are out of step with the reality of their constituent’s - while most (if not all) politicians on capital hill receives medical coverage (free/no out of pocket) via the taxation of American citizens any way. Should it be any surprise for the politicians to milk the American citizen of further taxation and force them into a unaffordable cost of medical protection (aka: Insurance) that no average American can afford while being forced to survive in these times of (aka) recession, while they have lost so much all ready.

I wonder has anyone in their homes; have loss a job, loss a home, had reduction in hours, wages or both, been forced to beg for help from other family member or friends for food, rent (mortgage) to pay utilities or take them in and completely support them until these time get better - I DOUBT IT...
