The United States Supreme Court will not block Tuesday’s lethal injection given to D.C. Sniper John Allen Muhammad.


Three Justices Stevens, Ginsburg and Sotomayor wrote a separate statement, not in dissent to deny certiorari, but in regards to foreshortening the Court's orderly review of first-time habeas petitions by executing prisoners before that review can be completed.


Stevens, Ginsburg and Sotomayor wrote: "By denying Muhammad's stay application, we have allowed Virginia to truncate our deliberative process on a matter — involving a death row inmate — that demands the most careful attention. This result is particularly unfortunate in light of the limited time Muhammad was given to make his case in the district court."


The U.S. Supreme Court has refused to block Tuesday's scheduled execution of convicted sniper mastermind John Allen Muhammad. Muhammad is scheduled to die by injection at a Virginia prison for the slaying of Dean Harold Meyers at a gas station during a three-week spree in October 2002 across Maryland, Virginia and Washington, D.C.

There are many more criminals who fall into the same classification as this one. They are clearly guilty and the resources keeping them alive are better spent on children who need help instead.

He should be put to death just for the terror he caused the area. I lived there during that time and was afraid I would be shot for just leaving my car. I also worked 10 minutes from where he lived, a lady I worked with also was his kids bus driver. Very scary time and he should pay dearly for it. My heart goes out to all those victims families as well.

I continue to believe that the Court would be wise to adopt a practice of staying all executions scheduled in advance of the completion of our review of a capital defendant’s first application for a federal writ of habeas corpus.

(See, e.g., Emmett v. Kelly, 552 U. S. 942 (2007) (STEVENS, J., joined by GINSBURG, J., respecting denial of certiorari); Breard v. Greene, 523 U. S. 371, 379 (1998) (STEVENS, J., dissenting).

Such a practice would give meaningful effect to the distinction Congress has drawn between first and successive habeas petitions. See 28 U. S. C. §2244(b).

It would also serve the interests of avoiding irreversible error, facilitating the efficient management of our docket, and preserving basic fairness by ensuring death row inmates receive the same procedural safeguards that ordinary inmates receive.

Amazing how the State plays God....or really commits the same offense as Muhammad.  Where is the lesson learned?  We learned that a blackman killed people in cold blood, in protest to the State and it's Supreme Court Legal Murdering Machine.. When will the Law recognize they are not above the law?  Who is to say the reasons for his actions are not true.. Or that he is a blackman...always has been a slave to the State..regardless if they say he was freed after the Civil War. No jobs, and nothing but a gun...might as well fight the terror that eminates from within the State.  Saying he deserves to die..because he takes resources from Children is a pretty deceitful lie.... the truth is it teaches kids that yeah you can kill people...when you work for the State and have money..so do well in school and get a job to support the State which is above the law....especially to get rid of the blacks in the neighborhood. Such a travesty is the image of the State. There should be no such thing as Executioners.
