To be honest, is Ed Lester really able to send someone in to do the work he has contracted to do? Is he contracted for a project rather than for an amount of time? Does he use his own tools for the job? Is he taking any risks with this job? It seems to me that Ed Lester comes squarely under the IR35 rules and so should be pursued by HMRC and be made to pay back any tax he has evaded. It doesn't matter if your employer (in this case the Government) is complicit as Ed Lester's company is the one liable for paying back any taxes due.
