Election Day Freebies Could Be A Felony Offense

Voting freebies on election day are making big voting news - between Starbucks free coffee, Ben and Jerry's free ice cream, Krispy Kreme free doughnuts and Chick fil A chicken burger giveaways, there has been a lot of hubbub about the extra perks that come along with casting your vote. 

State that you voted today or show off your "I Voted" stickers, and you could be eligible for free giveaways at a participating location near you.  But beware, as you might taking part in a felony act:

Such freebies might be a violation of election laws -- they could be viewed as bribes even after a vote has been cast.

Leave it to the law to spoil all the fun.

In Georgia, the secretary of state's office issued a statement yesterday reading: "Businesses are free to offer 'Election Day' specials or sales for all of its customers, but gifts, incentives or specials just for voters is prohibited under this provision."


Many companies have tweaked their promotions in order to get around this law, making the election day freebies available to all customers instead of just those who voted:

For instance, Krispy Kreme has tied its voting promotion to its famous "Hot Doughnuts Now" signs that glow in store windows when the circular treats roll off the assembly line, freshly bathed in warm glaze.

"Anyone who visits a participating Krispy Kreme shop today and simply mentions our 'Hot Vote Now' promotion will get a free doughnut," company spokesman Brian Little wrote in an e-mail today. "No one is required to show an 'I Voted' sticker."


Ben and Jerry's wants everyone to have a free scoop of ice cream:

Ben & Jerry's said it would give away a free scoop of ice cream from 5 to 8 p.m. today to customers displaying the sticker, but then learned about the law.

"Originally, we planned to give free scoops away just to those who voted," said Walt Freese, chief euphoria officer of the wacky Vermont ice cream maker. "We found out afterwards that certain laws may not allow it. So instead we're celebrating our election with a national party," he said.


And Starbucks offers free coffee for all:

At Starbucks, which promised a free "tall" coffee today to anyone displaying the "I Voted" sticker, free joe now flows for all, voter and non-voter alike.

"To ensure we are in compliance with election law, we are extending our offer to all customers who request a tall brewed coffee," Starbucks spokeswoman Diana Fullerton wrote in an e-mail. "We're pleased to honor our commitment to communities on this important election day."


So the moral of the story is, cast your vote for the future of your country and not simply to satiate your belly.

How about the promise that if Obama gets elected everyone will get a $1000 stimilus check? IS THIS ILLEGAL? LIKE: If I get elected you will get $1000 for voting for me..........hmmmmmmmmm

Wow, I hadn't realized that there was a law against this, and I guess it makes sense if in some way the company was doing giveaways for voting a certain way... but they aren't doing that, and I honestly doubt that this actually convinced peolple to vote who wouldn't have; but if so, isn't that a good thing?

I'm glad there was a way for these companies to get around this law... who doesn't love free stuff!?

I know I was voting anyway Free things notwithstanding. Free things or not. But it did get me to buy a dozen donuts.

I think if the promise of free gets people out to go vote then it's a win overall. People needs to vote. If capitalism raises voter turnout then it's a good thing.

I dunno, I didn't actually have to show my sticker (in fact I lost it between the trip for donuts and coffee, and still got my coffee). So I guess it was for everyone, but it was still a cool idea by those companies, and it's not like you only got free stuff for voting a certain way. Crappy.
