Guy's a pervert, but a criminal?
John Stelmack, who is a former grade school principal in Bartow, FL who was sentenced to five years in prison for a collection of child pornography which strangely wasn't even child pornography. No children were harmed in the making of his child porn but it was at least very icky.
What Stelmack did was take pictures of students and cropped out their faces/heads on the pictures of adults in sexual poses. This man was rightly fired, no question about it. You can't have a person like this as a principal. Heck, you couldn't have this man as a janitor at a school. But did he harm any children? No, other then make them realize what a pervert their former principle was. That might cause future psychology sessions. But, child porn laws exist to protect children from those who exploit them or traffic in them (thus furthering the production of more child porn.)
Although this guy is a sick pervert, being a sick pervert is not a crime and he didn't actually break the law. If someone puts Miley Cryus's head on a pornstar is he then guilty of a crime? At this point, I have no idea. This case illustrates the problem of those who practice zero tolerance. Lastly, to be honest those prosecutors who brought this case and those who convicted him were likely more religiously conservative then the average person. Although religious conservatives are well meaning they still are victims in a sense of the same Puritan mentality that afflicted their ancestors who forced women to wear Scarlet A's.
