Iowa Supreme Court says gay marriage ban unconstitutional
The Iowa Supreme Court has now ruled that the state's gay marriage ban violates the constitutional rights of same sex couples.
It was in 1998 that the Iowa legislature made changes to the marriage ruling that defined it as a union between a man and a woman. However, despite this ruling six same sex couples wanted a marriage license to be issued to them, but they were refused.
The Supreme Court ruled that the ruling limiting civil marriage to between a man and a woman violates the equal protection clause in Iowa.
“If gay and lesbian people must submit to different treatment without an exceedingly persuasive justification, they are deprived of the benefits of the principle of equal protection upon which the rule of law is founded,” the court wrote. “Iowa Code section 595.2 denies gay and lesbian people the equal protection of the law promised by the Iowa Constitution.”
The Court said:
while other courts have allowed their state legislatures to create parallel civil institutions for same-sex couples, such as civil unions, "a new distinction based on sexual orientation would be equally suspect and difficult to square with the fundamental principles of equal protection embodied in our constitution."
The conclusion said that Iowa must allow same-sex couples to marry.
"The language in Iowa Code section 595.2 limiting civil marriage to a man and a woman must be stricken from the statute, and the remaining statutory language must be interpreted and applied in a manner allowing gay and lesbian people full access to the institution of civil marriage," the court wrote.
Iowa joins the other states of Massachusetts and Connecticut to allow gay marriage.

I couldn't be more proud of my state right now. Reading the comments from our openly gay senator was heartwarming. I'll try to pull them up if I have time.
There's a rally taking place in the pentacrest (our sort of town-square) in a half hour. I'd grab my camera and pen/paper if I weren't cooped up in a library while I type this.
