Legal Birth Certificate vs Actual and Original Birth Certificate.

Reading between the lines, the tight rope dance of what was said and how it was said against why it was said that way.

Plausible legal deniability:

While the Administration stands by the fact that they have twice released a legal birth certificate, They have in fact refrained from making the claim that they have released the "Original Birth Certificate", excepting possibly in two instances. The president himself merely says "Birth Certificate" in his comments, a broad nomenclature.

It can be suggested that there are several definitions of the phrase "original birth certificate" and my interpretation is that without a doubt it means the document in original unedited, unaltered, un amended form as it existed from the moment of birth until it was signed by the parent (within a several days of birth), the original doctor in attendance (within a several days of birth) and original registrar (within a several days of birth).

The only references to "original" birth certificate In the white house press briefings from April 27th are:

MR. BAUER:" There’s a difference between a certificate and a certification. The certification is simply a verification of certain information that’s in the original birth certificate. "

MR. BAUER::........."we posted in 2008, that information is abstracted, if you will, from the original birth certificate"

MR. PFEIFFER: "Let’s be very clear. You were there for the campaign. There was never a question about the original birth certificate"

(THE EXCEPTING:)

MR. BAUER: 'The certificate with the signatures at the bottom -- and that's a key difference between the short form and the long form -- the long form has signatures at the bottom from the attending physician, the local registrar, and the mother, is the original birth certificate, which sits in a bound volume in the State Department of Health".

MR. PFEIFFER: ................"In recent weeks, the issue has risen again as some folks have begun raising a question about the original -- about the long-form birth certificate you now have in front of you"

Will the "Real and Official and Original and Legal Birth certificates now step forward.

It is now my firm conjecture that while both documents are now considered to be the legal birth certificate of Barack Hussein Obama II by the State of Hawaii and the Administration (and probably in fact by Federal Standards), Neither are in fact the "Original Birth Certificate" by the intended definition I have given above.

Also worthy of note is a phrase as the bottom of the short form COLB posted on fightthesmears.com some time ago, "Any Alterations Invalidate This Certificate". The posted short form COLB has the numbers redacted, and therefore was not valid in its posted form as it was altered. Splitting hairs you might say?, well yes and no. It provides for a legal loop hole as well as a virtual loop in law. If invalid it is therefore not a legal document, and therefore any claims made using that document and referring to that document can not be held to scrutiny due to its status as "Invalid Legally".(More on that COLB in a future story, fascinating information uncovered only yesterday. )

Legal Defense Plan?

MR. PFEIFFER: "Let’s be very clear"........."There was never a question about the original birth certificate during the campaign"........ "I was there for the original decision to release the birth certificate. I was there when we posted it online. I'm not sure I even knew there was an original one that was different than the one we posted online"

Indeed the legal defense plan by the White House has been laid out in this statement. They will contend that they were never asked for an "Original Birth Certificate" and that they did indeed supply a "Legal Birth Certificate" and I would imagine that even with a few missteps in the press briefings on April 27th 2011 it will be found that at that at some point in the recent past this second COLB released has in fact become to be defined by the State of Hawiii department of Health as the "Original Birth Certificate", where historically it had not been.

People in high places who make statements which are recorded for all of history must take great care in what they say so that the exact intent of that statement can not be used against them in a legal fashion, however it is very common to allude to things while using qualifiers to keep plausible deny-ability as a defense (That is not what I meant). I would like to see the president say "This is the Same exact document I wrote about in my book 'Dreams from my Father', It is identical in every way to the one I found in my mothers belongings."

Is a Birth Certificate a Static Document?

An original Certificate of Birth should be a static document. It should be un alterable, a matter of permanent record. But is it? Is that the case legally? Is that the case in all instances? Is that the case as defined by individual states? Is that the case as defined by our national government? Can legal made alterations to an original birth certificate, later become an "Original Birth Certificate"? These are some very Key questions in the debate over Obama's Birth Certificate, Questions that will take a exhaustive legal research to undercover. 

What is a "True and Legal Abstract"?

The stamp on the document released by the White House has the following stamp:

"I CERTIFY THIS IS A TRUE COPY OR EXTRACT OF THE (txe) RECORD ON FILE IN THE HAWAII STATE DEPARTMENT OF HEALTH"

(parentheses mine, to allow for the "txe" debate)

Hawaii in essence, has not claimed this is the actual true, original, unadulterated birth certificate of Barack Hussein Obama II. They have only affirmed it matches some of the records on file in the Hawaii Department of Health and that information could have been done in abstract using a variety of records on file within the Hawaii Department of Health. 

Abstract is legally defined as:

abstract n. in general, a summary of  records or documents,

What will appease me now?

How will I be able to call this issue case closed from a standpoint of action and personally walk away from further investigations? First I need to have in hand "legally binding" statements by the president. Exacting statements concerning the Birth Certificates of question.

Questions such as:

1) Have you ever asked for or been aware of alterations to be made to your birth records? a) If so, please name all instances you can recall, and provide documentation of those instances, and allow for records of those instances to be released.

2) Have you ever asked for or been aware of legal alterations being made to your birth records? a) If so, please name all instances you can recall, and provide documentation of those instances, and allow for records of those instances to be released.

3) Is the recently released PDF on the White House web page a completely accurate representation of the birth certificate you mention in your book? (include exact page and phrase in the question from book)

4) Will you provide a list of all interaction, all correspondence you or people representing you have had with anyone in the Government of Hawaii, including keepers of vital records who could have in any way affected change to the records of your birth.

5) Will you allow all records in Federal government concerning all records about your birth & passports as well as your deceased parents birth and passports to be released to the public or at bare minimum several independent sub committees?

6) Will you provide a list of all names you have used in your life, as well as all names those people in close contact with you (business, personal or government related) have ever used for you or in reference to you? 

7) Concerning documents of your birth have you ever made statements which you knew to be untrue or in some way deceptive (having known the full facts at the time)?

What is my accusation?

I have contended all along that I am not in doubt that the information in the long form COLB which was released by the White House April 27th 2011 is legal and true, However I do firmly believe and will continue to report on and prove that the document as released is not the "Original Birth Certificate" as signed and released within days of his birth (as previously defined) and that at a chosen arbitrary date of before 1990, This information as released in the white house PDF as represented on the front image of the PDF (excluding the modern stamps at the bottom) did not exist on "one single document".

If I am Wrong when the last detail of available information is freely released, and the parties at hand are legally bound to the statements that have made. I Will gladly stand up an make formal apologies.

How many types of Birth Certificate are there?

What seems to be a basic simple issue becomes highly complex when all the legal ramifications come to bear. We must look at statements in full light and those statements now pose many further questions: What is a certificate? What is a Birth Certificate? How many kinds of Birth certificate are there? Which type of birth certificate were "you" (The President Et al.) referring to at all points you mention it in the past

  MR. BAUER........."So the long form, which is a certificate"
