Tracy Miner, a lawyer for the Kerrigan family said that they were continually unhappy with the charges against Mark for his role in Daniel's death. Miner did say however, that the family is looking forward to having the case reviewed by a jury. The Kerrigan family believes that Mark is not responsible.
"Mark Kerrigan has been living at home supporting and caring for his mother and is in complete compliance with all conditions of his pre-trial release and we see no reason that the situation should change."
The prosecution think that Mark Kerrigan grabbed his father around the neck during a violent argument and that caused a compression fracture. Daniel Kerrigan died in hospital.
"We allege that the defendant's violent reckless actions and complete disregard for his father's safety and well-being endangered Daniel Kerrigan's life and resulted in the substantial harm that led to his untimely death," District Attorney Gerry Leone said in the statement.
Mark Kerrigan will be arraigned on Friday and he has pleaded not guilty to the charges.
