Military and Law
The American constitutional system postulates that the military must be at all times under a strict civilian control. There is vast wisdom in this constitutional intent. The military governments have the worst record of any kind of government on the planet. And it is this constitutional intent that has kept America from going the way of Abacha's Nigeria, Galtieri's Argentina or Shwe's Burma.
The military, by itself, wants to beat up on the civilians; then it wants to exert over them totalitarian control. Its next plan of action is to invade any place where there's land or people or resources, likewise to beat up on these people and place them under totalitarian rule. It is only when the military is at all times subjugated to rigorous control of civilian authorities that it becomes possible for there to be life and liberty. And in intending the same, the founders of America made possible for there to be life and liberty in America.
As part of this civilian control is ensuring that the military members who go back to civilian life abide by the civil law. And in this is likewise vast wisdom.
Otherwise a gangster could go to the military, learn military fighting skills, and go back to the ghetto to become a brutal gangster despot.
Otherwise a skinhead could go to the military, learn military fighting skills, and go back to kill and rape black and Hispanic people.
Otherwise a neo-Nazi could go to the military, learn military fighting skills, and go back to mass murder Jews.
Otherwise a scoundrel could go to the military, learn military fighting skills, and go back to bully civilians in illegal and ugly ways.
The military must therefore at all times remain under strict civilian control, as was the intent of America's founders - as a result of which intent Americans have been able to enjoy a better way of life than Nigerians under Abacha or the Burmese under Shwe (or, for that matter, anyone who lived in Europe prior to its adoption of democratic covenants). And when anyone who is or has been associated with the military is committing crimes, then he must be held to the same accountability as applies to civilians. That is the case when the crimes committed are assault, rape and murder; but it is likewise the case when the crime is domestic violence, threats of violence, theft, slander, or any other crime.
The true patriot is not one who goes to the military in order that he can bully civilians. The true patriot is one who honors the country's foundational principles, one of which is that military be at all times under strict civilian control. This also means that civilian law applies to members of the military who have been discharged from the military. And in ensuring the same one does true service to one's country.
