New Hampshire Legislature Defining Conditions For Secession

New Hampshire, the "Live Free or Die," state is currently framing, HOUSE CONCURRENT RESOLUTION 6 ( HCR6 ), legislation designed to specify under which conditions the state may secede from the federation of the United States of America.


The bill specifically addresses which actions by the Federal government of the United States of America will trigger a secession response from New Hampshire state. Most notable among the various conditions specifically spelled out in the bill is the Federal declaration of martial law.



HOUSE CONCURRENT RESOLUTION 6

That any Act by the Congress of the United States, Executive Order of the President of the United States of America or Judicial Order by the Judicatories of the United States of America which assumes a power not delegated to the government of United States of America by the Constitution for the United States of America and which serves to diminish the liberty of the any of the several States or their citizens shall constitute a nullification of the Constitution for the United States of America by the government of the United States of America. Acts which would cause such a nullification include, but are not limited to:

I. Establishing martial law or a state of emergency within one of the States comprising the United States of America without the consent of the legislature of that State.

II. Requiring involuntary servitude, or governmental service other than a draft during a declared war, or pursuant to, or as an alternative to, incarceration after due process of law.

III. Requiring involuntary servitude or governmental service of persons under the age of 18 other than pursuant to, or as an alternative to, incarceration after due process of law.

IV. Surrendering any power delegated or not delegated to any corporation or foreign government.

V. Any act regarding religion; further limitations on freedom of political speech; or further limitations on freedom of the press.

VI. Further infringements on the right to keep and bear arms including prohibitions of type or quantity of arms or ammunition; and

That should any such act of Congress become law or Executive Order or Judicial Order be put into force, all powers previously delegated to the United States of America by the Constitution for the United States shall revert to the several States individually. Any future government of the United States of America shall require ratification of three quarters of the States seeking to form a government of the United States of America and shall not be binding upon any State not seeking to form such a government; and

That copies of this resolution be transmitted by the house clerk to the President of the United States, each member of the United States Congress, and the presiding officers of each State’s legislature.

Is this serious? Did the south not want to Secede and ended up with a civil war wish they lost? I know the US constitution does allow for any State to Secede, however so far every attempt to do by any one was meet with major force.

Actually through numerous violations of the constitution Lincoln conducted an illegal war against the southern states for exercising their constitutional rights....

We are headed towards the next civil war...a war between those who believe in personal responsibility and those who need a nanny state.

Actually you are missing some important points in history. Every attempt by a state to secede was not met with major force.  Massachusettes wanted to secede while Jefferson was President and he did nothing to stop it, in fact he wrote a letter saying it was thier constitutional right to do so.  He was able to talk them out of it and they obviously did not sedede, but the fact is, Jefferson understood what the Constitution truly meant.

I dont want wars in our country. We cant turn a blind eye as to whats going on."The big picture" as history often repets itself. this when big government imposses un consttutional laws upon the American people. This would be a war againest a government that has taken away our rights. Now, more than ever the good people and some elected leaders are realizing that "WE THE PEOPLE" have more power than they thought. Which is good. We have taken this unjustice long enough. This economy callaps has awakend the American People. The Message we are sending is , we have had enough of this BS and we are all ready to take a stand to fight for out constitutional rights. This is sending a message that we are tired off being run-over by big government. We the people are the voice of change and even one person can make a differance. In fact, that all that ever has. All this tax payer money we are giving out is a joke. Why do we pay so many taxes that we have this huge tarp fund. When many Americans, our elderly, veterans, other working people cannot get help due to the gov saying we dont have the money. Now we have all kinds of Trillions to spend. How do Condoms stimulate our economy. This whole thing is a joke. I applaud the states that have done this. I hope Tennessee is the next on the list. We have thrown God out of our schools and out of what most of the principles our constitution was founded on Biblical principals. We need to all e-mail our state leaders and tell them what we think. They work for us. We pay their salary. I know many of the leaders want to do the right thing, not all of them are bad. They will be the next to join the other states in this movment.

IN THE YEAR OF OUR LORD: 2009  Time for us to speak up. Soon rather than later Oboma is wanting to ammend freedom radio and the press will soon follow. We dont have much time left to let people know whats going on and how we need to prepare.

I think it's time for a concerted secessionist movement in America, one that links all those parties that are seriously working toward that goal. In order to save American ideals, we must end the experiment known as the United States of America and bring forth a new nation.

I am a New Hampshire citizen, I've been keeping tabs on this since it's inception. This is not a declaration of our secession, it's merely stating that if the U.S. government breeches any of the six following criteria, we have the right to secede.

I. Establishing martial law or a state of emergency within one of the States comprising the United States of America without the consent of the legislature of that State.

other states considering such an action are Massachusetts, New York, North Carolina, Rhode Island and Virginia. California and New York are planning to follow our lead should we go through with this action.

Down here, we've already seceeded.  However, the current Governor does not acknowledge the fact.  Oh well.


Anyhow, NH is right to set the stage and let Fedzilla know that there is a line they cannot cross.  Time to break free!

Perhaps the solution is to call a Constitutional Convention where we take back the liberties that have been deminished by the courts over the last few hundred years. We would have to spell out the 2nd Amendment, the 9th, the 10th, the commerce clause, requirements for declarations of war, etc.

I would love for Wyoming to jump in on this! There are alot of people here in my area who would support such a thing! In my opinion, the fed has already breeched two of the above mentioned criteria. The gun laws have been getting more and more strict over the years with more laws in sight. And the fact that they have all but removed God from our country. In this fact I am talking about the new 1 dollor coin that has been produced that no longer has "In God We Trust" on it. I have not seen one of these coins in person as of yet, but I tell you now, I WILL NOT ACCEPT THEM IF I SEE THEM!!!! I ask all of you to reject them if you see them as well. I believe many of the 20 states that has passed bills to this extent (AK, AL, AR, AZ, CA, CO, GA, HI, ID, IN, KS, ME, MI, MO, MT, NH, NV, OK, PA, WA) would wait after Quebec's secession from Canada to attempt outright secession, peacefully this time around. 

We Quebecers complain about federal interference in provincial powers/jurisdictions, for one. New Hampshire and Maine would watch most closely what's happening in Quebec. Who knows... the leader of New Hampshire sovereigntists, Dan Itse, may give them several options regarding secession!
