Now, that it is official Rahm Emanuel is running for Mayor of Chicago one are legal expert says Emanuel may well not be eligible to run for Mayor.


Attorney Burt Odelson, a noted elction-law expert, is predicting Rahm Emanuel will be ineligible for mayor because he is not a legal resident of Chicago.

Odelson told Roe and Roeper on WLS Radio that when Emanuel leased out his Chicago home he could no longer claim he is a resident.

“He rented his house out in Sept 09 and has not been back since and has no residency in Chicago,” Odelson said.

Odelson says he has been involved in several residency cases in Illinois that “the law is clear.” (source: WLS-AM)

Michael Sneed of the Chicago Sun Times is reporting that the tenant in Rahm Emanuel's Chicago home, is refusing to break the lease of the North Hermitage house belonging to the White House Chief of staff.


In a telephone interview, Halpin, who described himself as an industrial real estate developer in the midst of heading to Louisville on business Monday, told Sneed: "Look, according to the lease I am not allowed to speak to the media about the house. "But I can tell you I have no plans to move."

Apparently, the lease is set to expire in June 2011. It has been widely reported that Rahm Emanuel is hoping to run for the mayor of Chicago and would obviously want his home back.

But now the issue of residency requirements have surfaced even before Emanuel officially throws his hat into the ring. The question is what residency requirements would Rahm Emanuel have to meet in order to run for Mayor of Chicago?


Chicago Board of Elections Spokesman Jim Allen said, "that is a legal question... that issue hasn't come up in the past." Allen then gave me this hypothetical answer: "If there's a candidate who happens to be serving in the White House cabinet and maintains a residence in the city of Chicago, it's possible they could qualify to run for Mayor."

Chicago being Chicago it is virtually guaranteed that if Rahm Emanuel decides to run for Mayor of Chicago has candidacy will most certainly face an opposition petition.

Now, it seems Emanuel has to scramble to find another home so he can meet the November 22, 2010 deadline for filing candidacy papers.

I can't believe there are enough stupid voters that will vote for this guy. Have they been in a closet for two years? This guy is a bum, a thug. I guess that's what most of politicians are in Illinois, but voters can't be that dumb to keep it going by putting this thug as mayor.
