SCRIVENER'S SCREED (Opinion): As You Idol-Worship, Your Civil Liberties Are Being Stolen. Now It's Time to Fight for Democracy by Scrivener

• WHILE PUNDITS BLATHER, THE RULE OF THE JUNGLE
IS TRAMPLING DOWN THE RULE OF LAW IN YOUR TOWN.

•  IT'S TIME TO FIGHT.  STOP THE FEDERALIZATION
OF LOCAL LAW ENFORCEMENT VIA THE "VIGILANTE" CORPS --
IN THE U.S., IN CANADA, AND WORLDWIDE

It's time to stop the idol worship and the idle chatter and to really get busy.

First task: demand that your candidate for president, whomever that may be, spell out clear and unwaivering positions on matters of civil liberties and the rule of law in America.  Or Canada.  Or wherever democracy is espoused but too often not fully practiced.

Let's begin with the death penalty.  We all know that imperfection exists within any judicial system.  And too often the poor and minorities are disproportionately convicted of capital crimes, and that a percentage of those convictions are later found to be wrongful.  We also know that minorities comprise a disproportionate number of the wrongfully convicted; and that the death penalty, once applied, is irreversible.

Why, then, does the constitutional lawyer Barack Obama support the death penalty at all, let alone its expansion?  Is it so he can talk tough to attract white voters who might not otherwise be receptive to his candidacy?  What is the sentiment in the black community?  Was Obama's death penalty stance one of the reasons why Jackson accused the candidate of "talking down" to black people?  Jackson's "cutting" below-the-belt reference got much publicity; but few explored the outburst's connection to issues other than Obama's lecturing of unmarried black fathers.

Another civil liberties threat that certainly should be raised in a presidential election year: Electronic voting, and how the lack of a paper trail threatens to steal democracy and renders moot the recount process. Have any of the pundit overlords explored the issue in depth?  Tell me if I missed it.  "Process" stories like that rarely get covered in a "horse race" environment, not even on Chris Matthews' Hardball cable show, despite the fact that the host had a cameo in the highest profile media project to examine the issue of electronic voting machine manipulation: A Robin Williams comedy a couple years back called "Man of the Year."  (I highly recommend the flick to all who want to understand why their vote may not count this year -- and may not have counted in 2004 in places where electronic voting was new and untested but employed.

Another issue I've explored in some depth elsewhere on this site: The U..S. federal government has quietly assembled a national police force of vigilante citizen volunteers and moonlighting municipal and utility workers, who target "undesirables" or those fingered rightly or wrongly by someone in power -- maybe YOU -- with no need to bother with that inconvenient institution we call the judicial system... or, for that matter, uniformed local police.

Should the federal Department of Homeland Security and the private armies and black ops squads assembled under its consolidated authority report directly to the President and not through the Justice Department, like the FBI (about the only powerful agency not under the DHS aegis)? Is this healthy for democracy?

Does DHS Secretary Michael Chertoff realize that volunteer groups funded by his department are accused by victims of organized community "gang stalking" of  committing vigilante acts and making unauthorized and illegal personal use of DHS-funded vehicles?

Is DHS investigating how its nationwide network of volunteer "Citizens Corps" are deployed, and whether they have morphed into an American version of the Gestapo or the Stasi?

Is the mainstream media even aware there's a potentially huge national story here?  And if they have heard about it, why haven't they done it? Are their editors under intense pressure from powerful government agencies who don't want the issue to be vetted in the press?  And are those few who have raised the issue in danger of losing their careers and even their physical well-being?  Are they prey for the vigilantes, and are the vigilante now intimidating the uniformed ranks of local police?  And what of those police forces?  Have they now been usurped by federal agents stationed in their localities who lord over a private army comprised of non-professional volunteers?

In my opinion, these extra-legal forces pose a serious threat to our democracy and the rule of law. Is anyone blaring it in the headlines? Not in the mainstream media. And even the "alternative media" has its head up... well, you know where.  You're at the only place where the issue has been raised in a news forum, aside from the many web sites on which victims of state-assisted domestic terrorism cry out for justice, but get little or no notice from the heavily lobbied and pressured mainstream media.

Wake up, people. Your freedom is being whittled away in the name of "keeping America safe." From what? The rule of law? The inconvenient need to afford due process, and not allow the government to summarily spy upon and harass innocent citizens outside of the legal system?

This is more than "warrantless" wiretapping. This involves the blatant and purposeful avoidance of the legal system entirely. This, my associates, is the negation of the rule of law. This is lawlessness, the law of the jungle.

Bob Barr was an establishment Republican. Then he started to get uneasy as he saw the erosion of civil liberties in America. Even John Ashcroft had some serious second thoughts; remember that visit to his bedside, when he held his ground on the very issue upon which Obama now equivocates?

Now Bob Barr's taken possession of the civil liberties torch (which is what Ralph Nader should have done if he had possessed any true political talent; he's a hero of mine, but as a consumer advocate, not as a third-party alternative).

Barr's starting to get some traction. Look at the polls in key states. Has anyone bothered to give him any coverage whatsoever? Haven't seen it.

There are real threats to America, to YOUR freedom, my fellow nowpublic.com readers -- and this downward spiral, this retreat from the rule of law, is happening right in front of you...

... in your cities and towns, at your county seat, within your local government and inside the cop shop, the firehouse, and the clubhouse of the local citizen's "patrol" gang -- what I fear has become America's version of the Bund.

There's an international dimension as well.  Like America, Canada has become infected by the fascist phenomenon of gang stalking.  The concept of state control over individuals outside of the bounds of the law, by way of  a citizen's shadow militia, seems to be unofficial policy of nationstates worldwide, a reactionary ideology that appears to have received tacit support as well as funding from the worldwide security apparachnik.  The United Nations should be investigating this dangerous contagion.

Is Barack Obama, the purported progressive Democrat, tackling these issues? Has any of the slavish D.C. press corps really analyzed the implications of his back-pedaling on civil liberties; his endorsement of the death penalty; his pandering approval of the mingling of church and state? I recognize that last one is not a flip-flop; Obama used religion as his pretext to earn his community organizer bona fides. Nothing wrong with that; but providing public funds for church projects and expecting no discrimination in hiring is wanting to have your cake and eat it, too.

All of you Obamanauts, please start demanding that your candidate show some spine on these issues, and not take the expedient way out on the big issues that impact your personal freedom.

AND... if you agree that it's time to address the issues that threaten our democracy, copy this post and send it to ten people who could make a difference! Do it this week, as the news programs and the print and internet media blather on incessantly about Obama's foreign jaunt.  Take action NOW!

And that's Scrivener's screed; I'm mad as hell, and I'm not going to take it anymore!
