MANILA, Philippines – (UPDATE 3) A Manila court has ordered the arrest of Senator Panfilo Lacson on charges he masterminded the murder of a publicist and his driver in 2000.

Agents of the National Bureau of Investigation served the arrest warrant Friday afternoon at the Senate just a few hours after the Manila regional trial court released the order.

Lacson, claiming political persecution, flew to Hong Kong on January 5 and declared earlier this week that he would not be returning soon as he expected to be arrested for the murder 10 years ago of Salvador “Bubby” Dacer and Emmanuel Corbito.

Justice Secretary Agnes Devanadera said the arrest warrant officially makes the former Philippine National Police chief Senator a fugitive.

Lacson’s lawyer Alex Avisado said they would file a motion to stop the arrest.

“It’s not yet an arrest order. It’s a resolution of a pending motion and as soon as we get a copy of the order, we can still file a motion for reconsideration,” Avisado said in a phone interview.

Court set to rule on Lacson arrest

The motion on whether there was probable cause to issue a warrant of arrest or not against Senator Panfilo Lacson on two counts of murder in connection with the alleged 2000 killing of publicist Salvador “Bubby” Dacer and his driver Emmanuel Corbito, is now deemed submitted for resolution after both parties have filed their respective positions.

Judge Myra V. Garcia-Fernandez, of the Manila Regional Trial Court (RTC) is expected to rule on the motion within 10 days after both parties submitted their respective positions last week.

Court personnel confirmed that both the comment and the reply of both parties are on the table of the judge since Friday. The court staff did not disclose the contents of their positions.

Lacson was indicted with two counts of murder charges in connection with the Dacer-Corbito case.

The murder charges were filed based on the complaint filed by the four daughters of Dacer - Carina Lim, Sabina Reyes, Emily Hungerford and Amparo Henson – following the execution of the Feb. 14, 2009 affidavit of former Senior Supt. Cezar Mancao II while he was still undergoing extradition process from the United States.

A panel of prosecutors led by Senior State Prosecutor Peter Ong has found probable cause that warranted the filing of two counts of murder against the senator, giving credence to the positive testimony of witnesses and physical evidence gathered by the National Bureau of Investigation (NBI).

DOJ chief says Lacson now a fugitive

MANILA, Philippines (2nd UPDATE) - A Manila regional trial court judge issued on Friday an arrest warrant for Sen. Panfilo Lacson for his alleged involvement in the double murder of publicist Salvador "Bubby" Dacer and his driver, Emmanuel Corbito, in November 2000.

Judge Myra Fernandez of the Manila Regional Trial Court Branch 18 issued the arrest warrant against Lacson.

The arrest order was issued nearly a month after 2 counts of murder were filed by the Department of Justice (DOJ) against Lacson for allegedly masterminding the killing of the publicist and his driver.

Lacson left the country for Hong Kong last January 5.

There were reports that the senator proceeded to Australia, but the National Bureau of Investigation (NBI) suspects that the former Philippine National Police chief may still be in Hong Kong.

The DOJ earlier said the Philippine government can suspend Lacson's passport and move for his arrest and extradition.

Copies of the warrant of arrest have been distributed to the DOJ and the lawyers representing the senator.
